Agencijski model javne uprave kao novina?
- Zahuktavanje procesa europeizacije nametnulo je percepciju agencija kao
nezamjenjivog “alata” hrvatskog puta u EU; danas imamo percepciju agencija kao
rastrošnih, moralno i stručno sumnjivih aktera, dvojbene opravdanosti – indikacija
političke (zlo)upotrebe agencija
- Upravne organizacije s određenim stupnjem samostalnosti izvan ministarstava nisu
novina ni u svijetu ni u Hrvatskoj
- Naziv “agencija” je relativno novijeg datuma
- Novijeg su datuma i nezavisni regulatori, koji se pojavljuju i pod nazivom agencija
- Preteče nezavisnih regulatora kakve ne poznaje upravna teorija su SIZ-ovi
- Koncept hrvatskog Zakona o sustavu državne uprave iz 1993. (sa svim novelama) je
tradicionalan, spominje se tek pravne osobe s javnim ovlastima, nema agencija
- Zakon o agencijama nije nikad donesen ni pripremljen, premda je sustavna regulacija
njihovog položaja potrebna radi zaštite javnog interesa, a i radi zaštite samih agencija
- Zakon o ustanovama uglavnom nije primjeren za regulaciju pitanja agencija
- Svaka vrsta agencija traži nešto specifičniju regulaciju, ali unutar opće regulacije za sve
agencije – sve se može obuhvatiti jednim zakonom

- porast broja od 1986. do 2002. u 36 zemalja s 28 na 164; ipak prosječni broj nije velik
(4,5); u Hrvatskoj 2009. čak 12 – potreba za racionalizacijom?
- Ekspertne agencije
- ekspertiza i znanstvene metode; relativno manji broj njih
- Izvršne agencije
- preko 40 takvih za različite upravne, nadzorne, razvojne i slične poslove
- U 21 zemlji bilo ih je krajem 2000-ih 106, prosječno 5; najveći prosjek u tranzicijskim
zemljama – u 4 zemlje 47 njih ili prosječno 12; Hrvatska daleko odudara sa
svojih oko 65!
