• REPUBLIC ACT 9442- An Act Amending Republic Act No. 7277,
Otherwise Known As The “Magna Carta For Disabled Persons,
And For Other Purposes”
• “An act providing for the Rehabilitation and Self-Reliance of Disabled Persons
and Their Integration to the Mainstream of Society and Other Purposes
granting Additional Privileges and Incentives and Prohibitions on Verbal, Non-
Verbal Ridicule and Vilification Against Persons with Disability,” which
required the Department of Health (DOH) to institute a national health
program for PWDs, establish medical rehabilitation centers in provincial
hospitals and adopt an integrated and comprehensive approach to the health
development of PWDs which shall make essential services available to them at
affordable cost.

Department order no. 26 s. 1997 on Institutionalized of SPED
Programs in All Schools
established resource centers in regular schools to provide
continuous support to children with special needs.
In support to the implementation of the Republic Act 7277
(Magna Carta for Disabled Persons) and to achieve the target set
for the Asian and Pacific Decade of Disabled Persons (1993-2002)
that 75% of the 4 million children with disabilities should be
provided equal educational opportunities, special needs

REGULATIONS FOR PRIVATE HIGHER EDUCATION
It encourages private higher education institutions to admit
students with disabilities.

REPUBLIC ACT 10410 - AN ACT RECOGNIZING THE AGE FROM
ZERO (0) TO EIGHT (8) YEARS AS THE FIRST CRUCIAL STAGE OF
EDUCATIONAL DEVELOPMENT AND STRENGTHENING THE EARLY
CHILDHOOD CARE AND DEVELOPMENT SYSTEM, APPROPRIATING
FUNDS THEREFOR AND FOR OTHER PURPOSES
“KNOWN AS EARLY YEARS ACT OF 2013”

It is hereby declared the policy of the State to promote the rights of children to
survival, development and special protection with full recognition of the nature of
childhood and as well as the need to provide developmentally appropriate
experiences to address their needs; and to support parents in their roles as
primary caregivers and as their children’s first teachers. Further, the State hereby
recognizes the age from zero (0) to eight (8) years as the first crucial stage of
educational development of which the age from zero (0) to four (4) years shall be
the responsibility of the Early Childhood Care and Development (ECCD) Council.
Therefore, the responsibility to help develop children in the formative years
between age five (5) to eight (8) years shall be with the Department of Education
(DepED).

The State shall institutionalize a National System for Early
Childhood Care and Development (ECCD) that is comprehensive,
integrative and sustainable, that involves multisectoral and
interagency collaboration at the national and local levels among
government; among service providers, families and communities,
and among the public and private sectors, nongovernment
organizations; professional associations and academic institutions.

The System shall promote the inclusion of children with
special needs, provide for reasonable accommodation and
accessible environments for children with disabilities and
advocate respect for cultural and linguistic diversity, including the
use of Filipino Sign Language as the visual language of the deaf
community. It shall be anchored on complementary strategies for
ECCD that include service delivery for children from age zero (0)
to four (4) years, educating parents and caregivers, encouraging
the active involvement of parents and communities in ECCD
programs, raising awareness about the important efforts that
improve the quality of life for young children and families.

establishes a non-discriminatory and pro-gender
equality and equity framework for policy formulation
and implementation.
Indigenous People Right to
Education
“Indigenous peoples have the right to establish and control their
educational systems and institutions providing education in their
own languages, in a manner appropriate to their cultural methods
of teaching and learning.”
2019 Special Education Act
It aims literally to institutionalize inclusive education
through the institutionalization of at least one special education
center in each school division and three such centers in larger
divisions, equipped with adequate qualified staff and
administered by the principal of the regular school
The 1983 Act to Enhance the Mobility of Disabled Persons
by Requiring Certain Buildings, Institutions, Establishments
and Public Utilities to install Facilities and Other Devices
to promote the realization of the rights of
persons with disabilities to participate fully in
the social life and the development of the
societies in which they live in for the full
enjoyment of the opportunities available to

s. 2008- Guidelines on the Issuance
of PWD ID Cards relative to 9442
Identification Cards shall be issued to any bonafide PWD with
permanent disabilities due to any one or more of the following
conditions: psychosocial, chronic illness, learning, mental,
visual, orthopedic, speech and hearing conditions. This
includes persons suffering from disabling diseases resulting to
the person’s limitations to do day to day activities as normally as
possible such as but not limited to those undergoing dialysis,
heart disorders, severe cancer cases and such other similar
cases resulting to temporary or permanent disability.

Local government units shall promote the
establishment of organizations of persons with
disabilities (PWDs) in their respective territorial
jurisdictions. National agencies and local
government units may enter into joint ventures
with organizations or associations of PWDs to
explore livelihood opportunities and other
undertakings that shall enhance the health,
physical fitness and economic and social well-
being of PWDs.

Health Insurance Program of the Philhealth and Philhealth
shall develop exclusive packages for PWDs that will address
their specific health and development needs.
The Individuals with Disabilities Education Act (IDEA)
The Individuals with Disabilities Education Act (IDEA) is the
nation’s federal special education law that ensures public schools
serve the educational needs of students with disabilities. IDEA
requires that schools provide special education services to
eligible students as outlined in a student’s Individualized
Education Program (IEP).

" means an order made by the Commission under section 27;
"appropriate" means whatever is necessary to meet the
individual need or needs of a person with disabilities;
CHINA- DISABILITY DISCRIMINATION
ORDINACE
1. assist educational establishments to develop policies and
procedures that prevent and eliminate disability
discrimination;
2. provide educators with practical guidance on making
provisions for students with disabilities that are consistent
with the provisions set out in the DDO; and
3. enable persons with disabilities, their parents, and their
associates (such as family members, carers, and business
associates) to understand their rights and responsibilities
under the provisions of the DDO.

  • 2. PHILIPPINE LAWS, POLICIES AND PROGRAMS • 1987- PHILIPPINE CONSTITUTION • ARTICLE 14 SECTION 1- The State shall protect and promote the right of all citizens. to quality education at all levels and shall take appropriate steps to make such education accessible to all.

PHILIPPINE LAWS, POLICIES AND PROGRAMS • REPUBLIC ACT 9442- An Act Amending Republic Act No. 7277, Otherwise Known As The “Magna Carta For Disabled Persons, And For Other Purposes” • “An act providing for the Rehabilitation and Self-Reliance of Disabled Persons and Their Integration to the Mainstream of Society and Other Purposes granting Additional Privileges and Incentives and Prohibitions on Verbal, Non- Verbal Ridicule and Vilification Against Persons with Disability,” which required the Department of Health (DOH) to institute a national health program for PWDs, establish medical rehabilitation centers in provincial hospitals and adopt an integrated and comprehensive approach to the health development of PWDs which shall make essential services available to them at affordable cost.

In support to the implementation of the Republic Act 7277 (Magna Carta for Disabled Persons) and to achieve the target set for the Asian and Pacific Decade of Disabled Persons (1993-2002) that 75% of the 4 million children with disabilities should be provided equal educational opportunities, special needs

PHILIPPINE LAWS, POLICIES AND PROGRAMS REPUBLIC ACT 10410 - AN ACT RECOGNIZING THE AGE FROM ZERO (0) TO EIGHT (8) YEARS AS THE FIRST CRUCIAL STAGE OF EDUCATIONAL DEVELOPMENT AND STRENGTHENING THE EARLY CHILDHOOD CARE AND DEVELOPMENT SYSTEM, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES “KNOWN AS EARLY YEARS ACT OF 2013”

PHILIPPINE LAWS, POLICIES AND PROGRAMS It is hereby declared the policy of the State to promote the rights of children to survival, development and special protection with full recognition of the nature of childhood and as well as the need to provide developmentally appropriate experiences to address their needs; and to support parents in their roles as primary caregivers and as their children’s first teachers. Further, the State hereby recognizes the age from zero (0) to eight (8) years as the first crucial stage of educational development of which the age from zero (0) to four (4) years shall be the responsibility of the Early Childhood Care and Development (ECCD) Council. Therefore, the responsibility to help develop children in the formative years between age five (5) to eight (8) years shall be with the Department of Education (DepED).

PHILIPPINE LAWS, POLICIES AND PROGRAMS The State shall institutionalize a National System for Early Childhood Care and Development (ECCD) that is comprehensive, integrative and sustainable, that involves multisectoral and interagency collaboration at the national and local levels among government; among service providers, families and communities, and among the public and private sectors, nongovernment organizations; professional associations and academic institutions.

PHILIPPINE LAWS, POLICIES AND PROGRAMS The System shall promote the inclusion of children with special needs, provide for reasonable accommodation and accessible environments for children with disabilities and advocate respect for cultural and linguistic diversity, including the use of Filipino Sign Language as the visual language of the deaf community. It shall be anchored on complementary strategies for ECCD that include service delivery for children from age zero (0) to four (4) years, educating parents and caregivers, encouraging the active involvement of parents and communities in ECCD programs, raising awareness about the important efforts that improve the quality of life for young children and families.

NCDA Administrative Order No. 001, s. 2008- Guidelines on the Issuance of PWD ID Cards relative to 9442 Identification Cards shall be issued to any bonafide PWD with permanent disabilities due to any one or more of the following conditions: psychosocial, chronic illness, learning, mental, visual, orthopedic, speech and hearing conditions. This includes persons suffering from disabling diseases resulting to the person’s limitations to do day to day activities as normally as possible such as but not limited to those undergoing dialysis, heart disorders, severe cancer cases and such other similar cases resulting to temporary or permanent disability.

IDEA requires that schools provide special education services to eligible students as outlined in a student’s Individualized Education Program (IEP).

CHINA- DISABILITY DISCRIMINATION ORDINACE 1. assist educational establishments to develop policies and procedures that prevent and eliminate disability discrimination; 2. provide educators with practical guidance on making provisions for students with disabilities that are consistent with the provisions set out in the DDO; and 3. enable persons with disabilities, their parents, and their associates (such as family members, carers, and business associates) to understand their rights and responsibilities under the provisions of the DDO.
