Preface
The people of South Korea have overcome more in their modern history than
most other developed nations. They have a right to be proud of the “Miracle on
the Han” that has catapulted Korea into the status of a technological and cultural
leader on the global stage.
Of course, the ongoing development of the Korean legal system has not been
without challenges. In any healthy democratic society, fundamental questions of
human rights are always being debated – often vigorously and stirring up deep
passion. But observers sometimes interpret the contentious nature of such
debates as a sign of national weakness. In reality, the debate surrounding
important human rights should be vigorous in any society that calls itself a
democracy.
Good of All is a non-profit organization dedicated to promoting the human
rights enshrined in the Universal Declaration of Human Rights (United Nations,
1948) and created this report to provide information for the ongoing debate on
human rights. As documented in this report, South Korea still faces challenges in
living up to the full vision of the Universal Declaration in key areas such as legal
and social equality for women. For example, it is striking that South Korea is
regularly ranked by international monitoring agencies as falling far behind other
developed nations in this key area. But these challenges should not obscure the
remarkable record of South Korea’s progress in the face of extraordinary
pressures such as decades of military threats and provocations from a nuclear-
armed totalitarian state to the north.
The Universal Declaration of Human Rights (UDHR) has been called the
“Magna Carta for Humanity” because it is the most widely accepted statement of
human rights principles in history. The Universal Declaration does not address
itself to every human rights issue but focuses instead on those human rights
principles that are most fundamental and therefore most transcendent across
both cultures and time. Indeed, this critical feature of the Universal Declaration
reflects the shared commitment of a drafting committee of scholars from both
the East and West.
This first edition of our annual report on human rights in South Korea
attempts to survey some of the most important articles of the UDHR in their
application to South Korean law and society. Our primary goal is to provide an
educational resource for the media, public opinion leaders, researchers, students
and the general public. While there is still plenty of room for improvement, this
first edition of our resource guide is unique in that it surveys the institutional
landscape of human rights in South Korea down to the desk officer level. It is
also unique in that it pulls together the international sources of the rights and
ties those to the implementing laws, regulations, court cases, agencies, and
scholarly as well as academic sources. It is useful for both the student doing an

introductory report and for the professional practicing in the field of human
rights in Korea. We also hope that it will serve as a model for how other
countries can make their human rights infrastructure more transparent and
understandable – particularly when combined with digital resources that are free
and accessible to members of the public apart from any government oversight or
control.
Our second goal in developing this annual survey is to begin to document
important human rights trends affecting the South Korean law and society. We
intend to expand and release this report in order to create benchmarks and
measure progress in the development of the human rights in South Korea. In so
doing, we also hope to contribute to the larger enterprise of human rights
education in South Korea which is essential to the ongoing development and
maintenance of democratic institutions and culture.
This year, among other findings, our report highlights the following key
issues:
1. Freedom of Speech Online
Articles 19 and 12 of the UDHR guarantee the closely related rights of Freedom
of Speech and Privacy. Given the growing importance of online communication
to all aspects of modern life, these two key rights are facing a host of new
challenges in South Korea – challenges that are not going away any time soon.
Indeed, as the most digitally wired nation in the world, South Korea is at the
cutting edge of defining what these freedoms mean in the Digital Age
With only a few exceptions – including some rooted in legitimate national
security concerns unique to the Korean peninsula – South Korea allows a
remarkable degree of freedom of speech online. However, as reported in this
year’s report, the South Korean legal system still allows the use of defamation
laws to punish the speech of individuals who would be protected in most other
developed democracies.
2. Privacy Online
In August 2012, the Korean Constitutional Court ruled unanimously to overturn
the controversial real-name registration system, joining the majority of
developed nations which afford the public anonymous access to the internet.
This development is especially noteworthy, given that Korea is a global leader in
the adoption and use of digital technology.
However, today, even after the abolishment of the real-name system, its
progeny continue to cause controversies in Korean society. For instance, the
Korean Communications Commission, a government agency, allows certain
mobile-service companies to verify the personal identification of their users and
to collect their users’ ID numbers. Given the widespread use of mobile devices
as a means to access and communicate over the internet, this becomes a real
threat to privacy. Also, certain acts remain in place, such as the Juvenile
Protection Act and the Public Official Election Act, that still require netizens to

register with their ID numbers in order for them to post comments or writings
online.
Of course, even in nations without such a registration system, public privacy
online is by no means guaranteed. This year, international media has highlighted
the “Snowden effect” and the accompanying concerns of violations of the right to
privacy in the US. The widely reported public dissatisfaction with U.S.
government policy in this area – and a resulting decrease in public trust in U.S.
government institutions – should serve as a cautionary lesson for South Korea at
a time when more rather than less public support is needed for the continued
growth of Korea’s democratic institutions and culture. As in the case of taxes,
the natural tendency of most government officials is to find reasons to expand
government intrusions into the online speech and privacy rights of the public. In
authoritarian or oligarchic regimes, such restrictions are a natural extension of
the government’s distrust of the people and disregard for their fundamental
rights. But the imposition of such limitations on the basic freedoms of the public
come at a high cost with respect to the maintenance of public support for the
leaders and institutions of any democratic society.
3. Legal and Social Equality for Women
The election of the first woman to serve as South Korea’s president – combined
with some important progress for Korean women in the realm of education – are
positive and encouraging trends. However, as pointed out in this year’s report,
the difficult realities facing Korean women in the workplace remain a stark
reminder of the challenges facing South Korea with respect to legal and social
equality for women. As a group, women possess half of the talent and
intellectual potential of any nation. So any society that systematically limits the
ability of women to express their talent and intellectual potential in the
workplace is a society with significantly diminished human and social capital. In
an increasingly competitive global economy, human capital is one of the most
precious resources that any nation possesses. So there is no question that South
Korea will continue to fall short of achieving its full national potential apart from
significant progress in achieving meaningful legal and social equality for women.
As in the case of the other findings in this year’s report, we offer the above
analysis with an eye towards encouraging the overwhelmingly positive trends
that have transformed Korean society over the past half century. Indeed, in
creating this report, we hope to demonstrate the degree to which South Korea’s
remarkable progress in the realm of human rights can serve as a model for other
nations who wish to emulate the economic, political and social success story of
South Korea. In this respect, we believe that the “Miracle on the Han” should be
viewed as a global success story that can and will have lasting ripple effects
across Asia and the Pacific Rim.

Research Methodology
Protection of human rights is part of the landscape of Korea. Given the vibrant
dialogue occurring daily in the government, among NGOs, in the media, and on
the internet, one must humbly consider how best to approach this discourse in a
way that is positive and adds value. The following materials represent nearly two
years of research with the kind assistance and encouragement of our editor,
Attorney Daniels, and his team at Good of All.
We wished to create something that featured the deep institutionalization of
human rights in the Korean government, civil society, media, and at the
individual level, thereby demonstrating how Korea is uniquely positioned as a
model that can be built upon in the region and highlighting the infrastructure
that other key nations in Asia and the Pacific Rim may seek to emulate. While at
the same time, we wished to be useful in a very practical way.
What resulted was this Human Rights Guide that connects key issues relating
to human rights to the international sources of those rights as well as to the
implementation of those rights in Korean law and to the key scholarship
discussing those rights.
Specifically, we chose ten core articles of the Universal Declaration of Human
Rights, the document that serves as the touchstone for human rights discourse.
For this first publication, we limited our research to ten articles of the
Declaration relating to civil and political rights.
We then chose specific human rights concerns that arise under those ten
articles and connected those rights guaranteed by the Declaration to the
unassailable sources of those rights in the international plane, as enshrined in
Korean domestic law, and as articulated in academia.
Each right has been connected to the international conventions and treaties
guaranteeing such right as well as to the implementation of that right in the
Korean Constitution, laws, court decisions, and regulations.
In addition, where possible, we have provided links to and a map of the
organizational structure of human rights apparatus of the Korean government
including executive agencies, courts, commissions, and legislative committees
with contact information down to the desk officer level. This feature is meant
both to demonstrate the deep institutionalization of human rights in Korea and
to provide an invaluable resource in the protection of the rights of the
disadvantaged.
We have also connected each right to sources of scholarship discussing that
right including books, journal articles, and reports. The scholarly annotations are
not intended to be comprehensive but are offered rather as a sample of the deep
dialogue on human rights in Korea in the past ten years as reflected in the
collection maintained by library at the Human Rights Commission. Where
possible, we have attempted to organize the scholarly annotations based on

three criteria, namely where the topic was addressed by a prominent author,
addressed with rare specificity, or addressed with rare depth. Any omissions are
unintended, and we value suggestions as to additional scholarly sources that
should be added to future editions of this guide.
Finally, we have included links that demonstrate how the Korean media has a
continuing interest and open voice in discussing human rights by providing links
to the top stories for the past year relating to the ten core articles of the
Universal Declaration of Human Rights.
We have also included video footage from NGOs, government archives,
government educational broadcasts, public YouTube and other public video sites
including all of the major news outlets in South Korea as well as other
government resources such as legislative hearings.
We recognize that with any such undertaking there are bound to be
inadvertent omissions, and we welcome any comments, emendations, or
animadversions so that such oversights may be corrected in future versions of
this document.

School Bullying
Introduction:
The importance of education is heavily emphasized in Korea. However, schools
have been increasingly confronting issues concerning school bullying over the
past several years, which is a violation of the fundamental human right to
receive an education. The government has reacted by creating a zero-tolerance
policy for violence in schools with a long-term goal to eradicate violence from
schools completely. However, it seems that violations of human rights arising
out of school bullying are becoming severe. For instance, the OECD reports that
Korean children are the unhappiest among developed nations, despite the
material wealth of their families. School bullying may be one of the reasons for
this unhappiness. In the past few years there have been several high-profile
suicides of school children that resulted from bullying. In this section, we will
look at the current status of school violence as shown in the media and will
examine human rights violations caused by school bullying from various angles
such as the international law sources, Korean law sources, as well as scholarship
on the topic.

Right to Life – Abortion
Introduction:
In Korea, abortion is prohibited, with the exception of special circumstances
specified in Article 14 of the Mother and Child Health Act. However, illegal
abortions are frequently performed. Consequently, Korea has the highest
abortion rate among the OECD member countries. Recently, there has been a
strong push among obstetricians and gynecologists for self-examination
regarding illegal abortions. Concurrently, there has also been a strong push for
the legalization of abortion. In this section, we will deal with issue of abortion in
as a violation of the right to life, and further, we will examine the on-going
conflict in Korea between the right to life and the right to choose.

Right to Life – Euthanasia
Introduction:
Korea does not allow euthanasia. There is no provision for a doctor to end a
patient’s life. Yet, euthanasia remains a hotly debated topic in Korea. Some
support the concept of “Death with Dignity,” whereby a patient or their family
can decide to assist the patient in passing, in order to prevent financial hardship
or to protect the patient’s dignity as a human being. This section includes links

Police Use of Force
Introduction:
Moving away from right to life issues, we come to the question of the use of
force by police. As is the case with many countries, Korea faces the question of
what degree of force may be used by the police in dealing with alleged criminals.
Certainly the issue is also a bit delicate given the use of the police as an
instrument of suppression during the days before full democracy – for instance,
the infamous, violent repression of student protests in Gwangju in 1980. Even
now, there are some questions about what kind of force is appropriate in dealing
with protests. What follows is a survey of the international norms followed by the
implementation of these norms in Korea and some key literature focusing on the
issue.

Immigrant Workers
Introduction:
As the Korean population has declined, and given the desire by young people to
obtain college education and white-collar employment, immigrant workers have
become a part of the landscape in the Korean workplace. However, some
problems with the current system have been noted. For instance, Korea has
memoranda of understanding with many developing countries. There is some
concern that workers coming to Korea from those counties may face exploitation
or face a system that is difficult to navigate. This increases the likelihood that
such immigrants might overstay their visas or work illegally, which consequently
puts them at even greater risk for exploitation. Some human rights
organizations are on record as requesting that the Ministry of Employment and
Labor withdraw the Revised Employment Permit System that started in August
2012 for these very reasons.

Human Trafficking & Sex Trafficking
Introduction:
Human trafficking, including sex trafficking, is a big problem worldwide.
Unfortunately, Korea is no exception. There is concern about victims who are
trafficked to Korea and about the exploitation of young Korean women lured
abroad with offers of employment only to find themselves victims of trafficking.
To combat trafficking, in 2004, Korea enacted the Act On The Prevention Of Sex
Traffic And Protection, Etc. of victims thereof. This section will discuss this law

Torture
Introduction:
Torture is a serious violation of human rights that is prohibited by international
conventions and treaties. Torture was one of the first issues that was dealt with
by the United Nations, as torture infringes upon the very heart and nature of
political freedoms. In 1949, the first measures to abolish corporal punishment
were established in colonial territories. South Korea is a signatory of the
Convention against Torture, and has been taking measures in implementing
regulations and legislation in order to strengthen and further prevent the use of
torture in society.

Illegal Detention, Illegal Arrest
Introduction:
Under Korean Criminal Procedure, a person may be arrested or detained if a
warrant is issued. Additionally, a person may be arrested or detained without
warrant if the person is committing a crime when the police are present at place
of the crime. However, it is alleged by human rights groups that many illegal

Racial Discrimination
Introduction:
The number of people coming from other countries to Korea has been increasing
each year. For example, according to Ministry of Security and Public
Administration, in 2013 the number of non-Koreans residing in the country is
1,445,631, which is 2.8% of the population. Immigrant workers and
multicultural families are becoming a part of Korean society. However, there are
concerns that within our homogenous society, the human rights of non-native
residents and multicultural families may suffer some forms of discrimination.
This section examines the current situation of racial discrimination in Korea and
introduces materials and systems that are in place to correct and prevent racial
discrimination.

Sex Discrimination
Introduction:
In December 2012, the Republic of Korea elected their first female president. In
addition, more and more women are entering the workplace in areas that include
medicine, education, and government. This shows that Korea has become more
serious about promoting gender equality. For instance, female students now
have a higher college entrance rate at 75% than do males at 70.2 %. This
carries over into the entry of women in public affairs. In the workforce, however,
there remains a concern that Korean women are underrepresented or that they
do not have proportional levels of responsibility. The number of high-ranking
female officials is still low. Currently there is no female mayor in Korea. The rate
of female senior managers is the lowest of Asian countries. Based on data from
the OECD, women in Korea have the worst chance of equal treatment at work
because so few women hold senior positions. Moreover, the wage gap between
men and women is double that of other OECD counties. Also, the OECD reports
that in 2005, female employment was at 52.1% as compared to an OECD
average of 56.1%. However, concerns about female employment are coupled
with concerns about the low birth rate in Korea which is the lowest of all OECD
countries with women aged 15 to 49 having just 1.1 babies, which is below
replacement levels.
Historically, Korea has been seen as a patriarchal society. In the modern age,
this leads to problems when it comes to figuring out how gender equality should
work in the Korean context. For instance, the “Hoju” or family registry system
became controversial and was abolished in the last decade, though many
families still utilize the system informally. In addition, there is a historic
preference for male children deeply rooted in Korea, though there is some
evidence that this trend is changing. For instance, according to a report listed
below, for 2013 the female to male birth ratio was 1.07. Moreover, while there
had been a ban on doctors discussing the sex of a fetus in order to prevent
abortions based on sex preference, in 2008 that law was overturned by the
Constitutional Court, claiming that the practice was no longer prevalent and that
parents had a right to know.
