1. EXCEPTION LIST
1. CHAPTER 13........ “FACILITY”….. “IN GOOD CONDITION” AND “EXCEPTIONS”… “OF
ALL ITEMS THAT ARE NOT IN PROPER WORKING ORDER”.
2. LACK OF PERMITS…..SEE FILE.
3. GERALDINE MADE DETAILED EXCEPTION LISTS THAT WERE DISCUSSED WITH S.G.
MANY OF THE MOST SIGNIFICANT WERE NEVER PROPERLY RECTIFIED AND WERE A
MAJOR DISRUPTION TO AN EFFICIENT USE OF THE FACILITY.
4. EVEN AS LATE AS APRIL 3, 2002, GERALDINE WAS TRYING TO GET THINGS FIXED THAT
WERE ON THE “EXCEPTIONS” LIST.
3. ALTHOUGH THE LIST IS FULL OF DETAIL IT IS IMPORTANT THAT GERALDINE BE
GIVEN THE OPPORTUNITY TO SHOW THAT FROM JAN.1. 2002 SHE WAS OPERATING THE
FACILITY WITH ONE ARM TIED BEHIND HER BACK.
THIS IS AN IMPORTANT ISSUE.
FACILITY WAS NOT IN A GOOD STATE OF REPAIR ON JANUARY 1, 2002.
2. 4. LANDLORD GAVE NO “WRITTEN NOTICE TO TENANT OF THE ITEMS FOUND TO BE IN
NEED OF REQUIRED MAINTENANCE, REPAIR OR REPLACEMENT”.
THEREFORE LANDLORD’S CLAIM TO “DAMAGE” AND
“CANNIBALIZATION” TO THE FACILITY CANNOT HAVE OCCURRED
WHILE TENANT WAS OPERATING FACILITY (BEFORE OCTOBER 11,
2002).
