Social Media and Recruiting - Legal Considerations for Every Employer. Renee Jackson - an employment attorney from Nixon Peabody - discusses the key legal issues to consider when leveraging social media for your recruiting efforts.
Like it or not, social media has become the norm. Social Media sites such as Facebook, Twitter and LinkedIn, as well as other informationsharing sites and blogs have forever changed the way people communicate. Employers need to recognize that their employee's personal use of these social networking websites - whether or not the employer permits personal use of these websites at work - is rife with these potential employment issues and other legal exposures, such as potential claims or employee harassment, unfair labor practices and unauthorized disclosure of statutorily-protected information about the company, its customers and employees. This session will address how employers can avoid exposure arising from such risks and how employers need to protect themselves.

U.S. Equal Employment Opportunity Commission (EEOC)
Overview
The U.S. Equal Employment Opportunity Commission (EEOC) is responsible for enforcing federal laws that make it illegal to discriminate against a job applicant or an employee because of the person's race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information. It is also illegal to discriminate against a person because the person complained about discrimination, filed a charge of discrimination, or participated in an employment discrimination investigation or lawsuit.
Most employers with at least 15 employees are covered by EEOC laws (20 employees in age discrimination cases). Most labor unions and employment agencies are also covered.
The laws apply to all types of work situations, including hiring, firing, promotions, harassment, training, wages, and benefits.
Authority & Role
The EEOC has the authority to investigate charges of discrimination against employers who are covered by the law. Our role in an investigation is to fairly and accurately assess the allegations in the charge and then make a finding. If we find that discrimination has occurred, we will try to settle the charge. If we aren't successful, we have the authority to file a lawsuit to protect the rights of individuals and the interests of the public. We do not, however, file lawsuits in all cases where we find discrimination.
We also work to prevent discrimination before it occurs through outreach, education and technical assistance programs.
The EEOC provides leadership and guidance to .

How Employees Can Defend Themselves
Against Sexual Harassers In The
Workplace
posted May 10, 2018, 3:44 AM by Daniel E. DeKoter [ updated May 10, 2018,

Sexual harassment in the workplace is not always reported. Sexual
harassment may amount to sexual discrimination under civil rights
laws, which refers to treating a person differently because of their
gender. Females are usually the victims of sexual harassment, but
there are times when men fall prey, too.

Sexual harassment includesunwelcome sexual advances, as well as
requests for sexual favors when submission is made as a condition
(implicitly or explicitly) for an individual’s employment or
employment opportunities. Harassment can be intentional or
unintentional, but what matters is how the victim perceives the
behavior. In general, there are four kinds of harassing conduct.
1.Physical - touching a person in a sexual manner (pinching,
rubbing, patting, or assault)
2.Verbal - jokes or comments of sexual nature, catcalling, or
demeaning comments about one’s sexuality

Pinterest 3.Visual - drawings or cartoons of sexual nature, display of offensive
and sexual objects in the workplace
4.Hazing - teasing, spreading rumors about one’s sexual activities
If this happens to an individual, her os he is powerless. Here are
some steps to take:
1.Learn about the company’s policies about harassment and
procedures for reporting it. An individual may report to their
supervisor or HR officer, for example..
2.Be firm and assertive in telling the harasser that the behavior is
not welcome.
3.Keep a written record of the offensive behavior. If there are
witnesses, keep a record of their names so they can help by giving
information during an investigation.
