Unit Lesson
We are now coming down to the last two units in this course. Each unit should be new information to you, and
your constitutional knowledge and awareness should start to take shape. In Chapter 11 of your textbook,
“Substantive Due Process, Privacy, and Other Liberties,” we will explore the Due Process Clause as it relates
to our U.S. constitutional rights and protections in detail. If you remember in Chapter 8, we briefly explored the
Due Process Clause; however, we will now further analyze the Due Process Clause providing for a two-
dimension approach and analysis.
The Due Process Clause can be broken down into two processes: procedural due process and substantive
due process. Procedural due process requires the government both at the federal and state levels to treat
persons fairly, while it attempts to interfere with their liberty interests and requires the government to process
and safeguard individuals and their claims (Hall & Feldmeier, 2012). So what does this actually mean? The
government should allow for a timeframe compatible and suitable for individuals to respond to a claim,
provide for an appeals process, and ensure all claims are handled in a fair, balanced, and objective manner.
Now, substantive due process is the second dimension of the Due Process Clause found in the Fifth (federal
law) and Fourteenth (state law) Amendments to the U.S. Constitution. Substantive due process concerns the
type of substance of behavior that is included as a “liberty” under the Due Process Clause, and examines the
activities and protections, which are included under “liberty” (Hall & Feldmeier, 2012).
Take a minute to think about the word liberty. In your perspective or definition, what does liberty mean to you?
Each person sees liberty through their own personal lens and experiences in life. What should be noted is
that the word liberty is not defined in the U.S. Constitution. Therefore, interpretation is left up to the U.S.

An 18-year-old high school student walks to class carrying a backpack. He is stopped by the school security guard and his backpack is searched. A loaded handgun is discovered. The school security guard takes the student to the principal’s office. The principal calls the local police. In the state where the school is located, it is illegal to carry a concealed weapon without a permit and all weapons are prohibited on campus.
Officer Smith arrives at the school approximately 10 minutes later. Officer Smith takes a statement from the school security guard and searches the student’s backpack. He seizes the gun and places the student under arrest. Officer Smith then asks the student if he would like to make a statement to explain why he was carrying a concealed weapon on campus.

Children are children however the question asked is should they be liable for their own intentional torts or should the parent and/or guardian be liable. Would my argument change if the injured party is the child themselves or an adult?
According to Schubert (2015) an intentional tort is “a civil wrong in which the defendant is alleged to have intentionally interfered with the plaintiff’s person, reputation, or property (p.375).” If a child’s conduct reflects that they have intentionally committed a civil wrong then yes, they should be held liable. However, there is another as if the child is not at the age of knowing right from wrong then the child needs to be taught and corrected therefore the parent and/or guardian needs to be held liable.
If the act is against the child themselves then the parent and/or guardian is liable no question asked. For a parent and/or guardian are the ones who are to protect children when they cannot protect themselves. We are the voice for them when they cannot speak for themselves.
If the act is against an adult, then I ask as to why this act occurred. How did it happen and why, for a child is not going to attack an adult without cause or reason.
In conclusion, children need to be held accountable for their actions within reason. If I child does not no better, then how can he be held liable for his ignorance? There is a difference between stupidity and ignorance for ignorance is not knowing and stupidity is knowing and choosing to continue anyhow.

That would mean that the child intentionally interfered with some one person, property, or reputation. my team through all the planning meetings, directed them in the preparation of the menu items (we made all the appetizers for the cocktail reception, 20 different passed and buffet items), resolved issues with the linen company (they sent the wrong color tablecloths the week before the event), used email and cell phone communication channels for all decisions and activities planned.
The day prior to the event, I was at the church hall
controlling
and ensuring that all activities where being done as planned, the tables where set with the linen (the new corrected color), the china, the centerpieces and all décor.
I made sure that all the food was being prepared to my specifications and taste, did a half hour training of the service staff (40 of them) to ensure they knew what to serve on what platter and with what accompaniment, and to make sure they had the right tools to do the best job.
This was the largest catering job that I had attempted in my career, so I feel that the planning was the most crucial function that I needed to control.
Organizing and leading where the second most important functions and controlling was the final function performed.
I enjoyed the challenge and I know that we did an exceptional job because I have since booked over 75 (and counting) new events from the people that attended the event and told me how impressed they were with the quality of our food, décor, and organization and how well our staff handled themselves.

When working with any client, you must consider the impact of human development and culture. This is especially true when working with survivors of critical incidents. A 4-year-old child’s cognitive processing is different from that of a 35-year-old adult. Thus, you must be familiar with developmental stages, specifically those that incorporate cognitive and emotional understanding, when working with survivors of critical incidents. The cultural context of survivors also has an impact on their responses to critical incidents. For example, Haiti is an impoverished country with limited resources. The earthquake in 2010 devastated this country, the extent of which was at least partially the result of culturally relevant factors. The systems to filter and purify water in this country are not easily reconstructed, resources to rebuild houses and buildings are not immediately available, and food sources that are destroyed from an earthquake are not easily replenished. In an environment where there are more financial and systemic resources, the experience of an earthquake might not have such a significant impact on the continued health of the survivors.
For this Discussion, select a critical incident that would require a professional response for survivors and think about a culture in which this critical incident might occur. Consider the different stages of development of potential clients from the following: 6-year-old child, 14-year-old adolescent, 26-year-old young adult, and 50-year-old older adult. Think about how you would respond differently to each of your clients depending on their stage of development when experiencing the event or situation you selected.
By Day 4
Post by Day 4 a brief description of the critical incident you selected and the culture in which it might occur. Then, briefly describe your “clients” in terms of their stages of development. Next, explain how the developmental stage may influence the needs of your clients. Be specific and provide examples to illustrate. Identify any ecological factors that may influence survivors of the critical incident. Finally, explain how intervention with this critical incident might be different if the client(s) was/were of a different culture.

Part 1: Law Enforcement Officer Arrives at the Scene Scenario
An 18-year-old high school student walks to class carrying a backpack. He is stopped by the school security guard and his backpack is searched. A loaded handgun is discovered. The school security guard takes the student to the principal’s office. The principal calls the local police. In the state where the school is located, it is illegal to carry a concealed weapon without a permit and all weapons are prohibited on campus.
Officer Smith arrives at the school approximately 10 minutes later. Officer Smith takes a statement from the school security guard and searches the student’s backpack. He seizes the gun and places the student under arrest. Officer Smith then asks the student if he would like to make a statement to explain why he was carrying a concealed weapon on campus.
The student replies, “What weapon? That’s not my backpack and I never saw that gun before.”
The student is then transported to the local jail. However, on the way to the local jail, Officer Smith asks the student again why he brought a loaded gun on campus. The student admits that it was his gun and stated that he needed it for protection. Upon arrival at the local jail, the student is booked. Six hours later, the student is interviewed by a Detective Columbo. The detective reads the student his Miranda warning and asks the student if he would like to make a statement.

Children are children however the question asked is should they be liable for their own intentional torts or should the parent and/or guardian be liable. Would my argument change if the injured party is the child themselves or an adult?
According to Schubert (2015) an intentional tort is “a civil wrong in which the defendant is alleged to have intentionally interfered with the plaintiff’s person, reputation, or property (p.375).” If a child’s conduct reflects that they have intentionally committed a civil wrong then yes, they should be held liable. However, there is another as if the child is not at the age of knowing right from wrong then the child needs to be taught and corrected therefore the parent and/or guardian needs to be held liable.
If the act is against the child themselves then the parent and/or guardian is liable no question asked. For a parent and/or guardian are the ones who are to protect children when they cannot protect themselves. We are the voice for them when they cannot speak for themselves.
If the act is against an adult, then I ask as to why this act occurred. How did it happen and why, for a child is not going to attack an adult without cause or reason.
In conclusion, children need to be held accountable for their actions within reason. If I child does not no better, then how can he be held liable for his ignorance? There is a difference between stupidity and ignorance for ignorance is not knowing and stupidity is knowing and choosing to continue anyhow.

I believe that a child should be held for their own intentional torts. One of my arguments would be the word “intentional”. That would mean that the child intentionally interfered with some one person, property, or reputation. The goal of the Session Long Project is to identify and evaluate the ethical principles used in resolving ethical dilemmas, and to apply the principles to specific ethical issues that may have professional, sociological, economic, legal or political implications.
Often times a patient needs a lot of resources prior to being discharged from the hospital. Some organizations use discharge planners or case managers to aid in acquiring these resources. The topic of this SLP is about Jenna, a young woman who could not be discharged home until the issue of resources to care for her was resolved. This story demonstrates that resource allocation decision making is inherently complex, a process that is dynamic, multidimensional, and iterative. After reading the article, "The relational nature of case manager resource allocation decision making: An illustrated case" by Fraser, Estabrooks, and Strang and doing additional research, please respond to the questions listed below:
1. Provide a brief summary of Jenna's case. What was her medical condition? What was her prognosis? Why was it important for her to go home? Did she get to go home? If so, how did that impact her recovery?
2. What were the resources that Jenna needed to go home? What barriers did her case manager encounter in acquiring these resources?
3. Discuss the theory of relational ethics as it applies to this case. What is it? How does it impact the allocation of resources? Think about your own discipline of study, how does this theory apply to acquiring scare resources? Provide an example.

a volunteer event committee that consisted of the president of the parish, and 10 other key church individuals.
We had 3 months to finalize the details, plan our agenda for the day of the event, and make all the food, order the flowers/centerpieces, the linens, the china and anything else needed for a spectacular celebration.
I
led
my team through all the planning meetings, directed them in the preparation of the menu items (we made all the appetizers for the cocktail reception, 20 different passed and buffet items), resolved issues with the linen company (they sent the wrong color tablecloths the week before the event), used email and cell phone communication channels for all decisions and activities planned.
The day prior to the event, I was at the church hall
controlling
and ensuring that all activities where being done as planned, the tables where set with the linen (the new corrected color), the china, the centerpieces and all décor.
I made sure that all the food was being prepared to my specifications and taste, did a half hour training of the service staff (40 of them) to ensure they knew what to serve on what platter and with what accompaniment, and to make sure they had the right tools to do the best job.
This was the largest catering job that I had attempted in my career, so I feel that the planning was the most crucial function that I needed to control.
Organizing and leading where the second most important functions and controlling was the final function performed.
I enjoyed the challenge and I know that we did an exceptional job because I have since booked over 75 (and counting) new events from the people that attended the event and told me how impressed they were with the quality of our food, décor, and organization and how well our staff handled themselves.

Discussion: Cultural and Developmental Implications for Survivors
When working with any client, you must consider the impact of human development and culture. This is especially true when working with survivors of critical incidents. A 4-year-old child’s cognitive processing is different from that of a 35-year-old adult. Thus, you must be familiar with developmental stages, specifically those that incorporate cognitive and emotional understanding, when working with survivors of critical incidents. The cultural context of survivors also has an impact on their responses to critical incidents. For example, Haiti is an impoverished country with limited resources. The earthquake in 2010 devastated this country, the extent of which was at least partially the result of culturally relevant factors. The systems to filter and purify water in this country are not easily reconstructed, resources to rebuild houses and buildings are not immediately available, and food sources that are destroyed from an earthquake are not easily replenished. In an environment where there are more financial and systemic resources, the experience of an earthquake might not have such a significant impact on the continued health of the survivors.
For this Discussion, select a critical incident that would require a professional response for survivors and think about a culture in which this critical incident might occur. Consider the different stages of development of potential clients from the following: 6-year-old child, 14-year-old adolescent, 26-year-old young adult, and 50-year-old older adult. Think about how you would respond differently to each of your clients depending on their stage of development when experiencing the event or situation you selected.
By Day 4
Post by Day 4 a brief description of the critical incident you selected and the culture in which it might occur. Then, briefly describe your “clients” in terms of their stages of development. Next, explain how the developmental stage may influence the needs of your clients. Be specific and provide examples to illustrate. Identify any ecological factors that may influence survivors of the critical incident. Finally, explain how intervention with this critical incident might be different if the client(s) was/were of a different culture.
