Introductory lecture of Master on Food, Law and Finance at International University College of Turin (Italy), class 2017-18. Module Global Food Policies. What does it mean to be critical/radical versus being conventional when analysing food policies? Two case studies are presenting on how corporations shape academic discourses in Nutrition and the unaffordability of eating five vegetables/fruits per day in UK and Global South.

Critical theories emerged to question and challenge mainstream international relations theories. These alternative approaches differ in their ontology, epistemology, and methodology. Two examples of critical theories discussed are feminism and constructivism. Feminism examines how gender is constructed and impacts power relations. The current industrial system of production, transformation and consumption of food is the major driver of planetary destruction. This system, sustained by the normative valuation of food as a commodity, is pursuing resource enclosures and unsustainable exploitation beyond planetary boundaries to satisfy the profit maximization ethos. Because food is only a commodity, for-profit initiatives are fully justified.
In this lecture, I propose a different value-based narrative, one based on the multiple dimensions of food relevant to human beings, dimensions that cannot be valued in market monetary terms. Food as a commodity just use the treadeable dimension of food. But what about the others (i.e. a human right, and essential resource, a cultural determinant). Therefore, food shall be valued differently, as a multi-dimensional commons with public good dimensions that require a different kind of governance and allocation mechanisms othern than the market.
If we need to change drastically the global food system in crisis, we need to start by having a different narrative and different food values. Here is a first approach to that. Rights-based Civic Actions for Food
Lecture at IUC Turin as part of a Module on Social Food Movements. Here I present the right to food constituency, NGOs, associations, legal scholars and the few institutions and countries that actually support politically and financially this fundamental right (closely linked to right to life). I explore major barriers (normative, academic and political) to the full implementation, and analyse the different developments in Latin America (progress) and Europe (stalemate).

Several very common food policies often implemented in countries of the Global South are presented and analysed through a critical approach (who wins/who loses, balance of power, visible outputs VS underlying causes, collateral effects, paternalism VS universalism, rights-based or needs-based). taxing unhealthy ultra-processed food and beverages (Mexico soda tax as case study), conditional cash transfers and their impact in stunting (Mexico and Brazil as case studies) and patented technologies to save lives VS public research (Plumpy Nut, ready-to-use therapeutic food to save lives in humanitarian situations). The idea is to understand the advantages, impacts and challenges of those well-known food policies.

The Global North, that used to be dubbed "Developed Countries" or "First World", is experiencing a growing pandemic of malnutrition (growing obesity and stagnant undernutrition) due to its complete reliance in the industrial food system and its driving ethos: profit maximisation out of food production. This low-cost food system is killing us and destroying Nature. Specific food policies found in the Global North will be analysed, including the huge Farm Bill (US) and CAP (EU). Amongst the topics addressed, one can mention: Can we afford a healthy diet?, the productivist paradigm, Corporate Ethos VS Public Policies,
GMO Labelling in US and Civic Collective Actions for Food. At the end, a set of alternative Policy Options for the North will be presented and discussed, based on a different valuation of food: not as a commodity but a commons.
The Paradoxes of the Industrial Food System
1) The global industrial food system produces 30-40% of the world's food but contributes greatly to environmental degradation, hunger, and diet-related diseases. It favors high productivity but is unsustainable.
2) Small farms using agroecological practices occupy less than 25% of farmland but produce 60-70% of the world's food on lower yields. They are more socially and environmentally resilient.
3) The current industrialized food system cannot be maintained for more than 50 years due to its negative environmental and social impacts. A transition to more sustainable and equitable food systems is urgently needed.

Intervention at the European Parliament (12 Dec 2019) to propose a narrative change in the valuation, governance and allocation of food: from considering food as a commodity to be exclusively distributed through market mechanisms (only through purchasing power anyone can get access to food) to food as a human right, commons and public good (where food could be accessed through universal entitlements and market mechanisms). This change of narrative is based on the multiple non-monetary values of food (specially its essentialness to every human). This narrative differs from the current one: food as a pure commodity, such as screws, cement or TVs. The alternative value-based consideration of food is a pre-requisite to unlock other food policies, to redirect public subsidies and to enact laws based on the consideration of food as a human right. The consideration of food as a commodity is hegemonic within the corporate world and many governments, but it is not commonsensical within human beings.

Se presenta una nueva narrativa y propuestas de politicas alimentarias que sustenten la tan necesaria transicion del sistema alimentario Español y Europeo. El sistema alimentario industrial fomenta malos habitos de consumo, promueve obesidad infantil, mantiene a millones de Europeos en inseguridad alimentaria, destruye la biodiversidad y agota los recursos naturales. Ademas, consume el 70% del agua potable y emite el 30% de gases de efecto invernadero. Aqui se presenta una propuesta para re-considerar los alimentos como bienes comunes (aplicando una etica diferente), como bienes publicos (concepcion politica) y como derecho humano (enfoque legal). Aceptando que esta construccion social es radicalmente diferente de la actual (alimentos como puras mercancias), se exponen justificaciones historicas, legales y politicas que sustentan esta propuesta. This presentation explores the multiple meanings of food for human societies, and the dichotomy represented by the hegemonic narrative (food as a commodity) and the emerging counter-hegemonic alternative (food as a commons). I explained the rationale for this shift in value-based narratives: the unsustainability and unfairness of the industrial food system. The dominant state-driven transition in agricultural modernisation promotes the replacement of old knowledge/varieties for modern ones as they do not fit with productive and efficient industrial agriculture. They are dubbed as "backwarded". Stringent legal frameworks (IP rights & safety regulations) and political (dis)incentives are geared to replace open local landraces by modern patent-restricted varieties. And yet, there are alternative transition pathways where citizens reclaim a different and more sustainable, open-source agriculture, meaningful landscapes and communal practices that reinforce connectedness, social and economic benefits, and pleasure in doing things with others. And heirloom seeds fit well in that narrative. Studying in detail the motivations and food and seed values of participants in four case studies or agro-biodiversity conservation (UK, Belgium, Slovenia and Germany), this research shows that non-economic motivations related to "old" are still quite relevant (heritage, tradition, ancestors, heirloom, etc). There are diverse pathways to preserve agro-biodiversity by combining economic and Non-economic policy beliefs. And different non-economic Policy Beliefs are meaningful in different contexts for the same resource. Food, law and the Commons
This presentation was delivered at the Law Seminars organised by the Carlo Alberto Collegio and the University of Turin. It explores the origins of absolute propietary regimes over natural resources, the primacy of property rights over other fundamental rights to humans (food, water, land, health, housing) and the normative social construct of food as a private good and a commodity. This social construct, so prevelent right now in the global food system, can be changed if we so considered. The alternative narrative of food as a commons, based on multiple dimensions of food, is presented and practical implications are suggested. Finally, some examples of existing food commons are presented.

This lectures proposes a different normative regard on food, not as a mono-dimensional commodity that can only be accesed through money, but as a multi-dimensional commons that shall be governed by people (all eaters, some producers), partner States and profit-restricted social enterprises to guarantee that everybody has access to food by different means. Since food systems are main drivers of Earth destruction, we need to radically transform the way we produce and eat food to keep on living in this planet without exhausting the natural resources that are vital for human life: food, water and air. This presentation analyses how do people value food, comparing two samples, one of food-related professionals working in different countries and one of members of food-buting groups in Belgium. In Belgium, the non-political transformers are compared to the political transformers to understand whether their political stance is related to their valuation of food as a commons or commodity.

This document discusses territories of commons in Europe, which make up about 5% of Europe's utilized agricultural area. Territories of commons provide climate-adapted food, steward natural resources and biodiversity, nurture communities and cultural heritage, and use participatory governing systems. However, the recent EU Common Agricultural Policy reforms made no mention of supporting territories of commons. The document proposes recognizing commons as legitimate alternatives, mapping customary commons, and directing EU funds to support territories of commons.Food is not a right in the SDGs. The EU position analysed.
The Sustainable Development Goals have neglected the consideration of food as a fully-fledged human rights and thus they treat it as a simple commodity. We analyse the consequences of that political agreement and the US and EU stances vis a vis the right to food. Finally, we recommend a re-consideration of food as a right, a commons and a public good to achieve the Zero Hunger Goal by 2030.
