The United States is considered to have the safest drug supply chain in the world. However, 19 million Americans purchase pharmaceuticals from outside of this supply chain, from online pharmacies and unlicensed sources. This presentation details some of the devastating patient cases of counterfeit medicine, as well as the legislation and organizations fighting to keep pharmaceuticals safe.
What have been the major crimes and policy developments in the space of counterfeit medicines? PSM reviews major prosecutions and legislation from the first half of 2021.
For 20 years, United States politicians have been interested in fighting their high drug prices by bulk importing prescription drugs from Canada.
Recently, the politically-appointed head of the US Health Department has said they are proposing new rules to make allowances for this practice. The State of Florida, with a population of 25 million, has also passed new legislature and published a 40-page plan, and the Florida Governor has met with the President and the Health Secretary to move forward. This creates a clear and present risk to the supply of medicines for Canadians.

practices in 49 states that they have done business
with unlicensed distributors.

Black market oncology medication
The unlicensed wholesalers that
trafficked in Betty Hunter’s fake oncology
medication were finally sentenced in
2014, three years after her death in 2011.
The problem is far from solved. Since
2012, the FDA has warned 1,205 medical
practices in 47 states and the District of
Columbia that they had done business
with unlicensed distributors who had
been found selling counterfeit oncology
medication.

medications not approved by the FDA to
Americans, including oncology drugs.
• The FDA intercepted some of their medications

operating their fake internet pharmacy site selling
to Americans.

Also, Marcia Bergeron of Canada died in 2007 after taking fake anti-anxiety pills she bought online that contained heavy metals.
PSM’s Marv Shepherd has studied the size of the Canadian drug supply and the impact of US patients drawing upon it. The Canadian drug supply would be depleted in 38 days.
In 2014 Maine professor Mac McCall ordered three prescription drugs from an online pharmacy that fit the new Maine state importation law. The medicines were shipped from an illegal country.
When he tested them in his university lab, they were found to be counterfeit. He filed a complaint with the Maine Board of Pharmacy for their illegal actions. The criminals remain at large today.
