Introduction
When Denise Fleury left the private sector to become head of the Minnesota Office of
State Claims in June 1984, she knew the job would be challenging. Recent changes in
Minnesota’s worker’s compensation law had broadened the mission of State Claims,
which administered worker’s compensation benefits for allstate employees. As the
incoming manager of the office, Fleury was expected to re-orient State Claims to meet
these new responsibilities and to make sure that supervisors throughout state government
complied with the new law, as well.
When she took the job, however, Fleury did not realize how badly State Claims was
handling its old responsibilities. She soon found scrambling to cope with day-to-day
crises while trying to assume a host of new tasks. By the end of her first year, Fleury had
made real headway, but office operations continued to suffer from misunderstandings,
mistakes, and missed deadlines, which exasperated her staff as well as the employees and
agencies they served. Fleury was anxious to resolve these problems, but felt that she did
not understand the details of the office paper flow well enough to sort them out herself—
nor did she have the time to tackle such a job.
Background
In Minnesota, both public and private sector employers are required by law to pay for the
medical treatment of any employee who suffers a work-related injury and to pay lump-
sum awards for permanent injuries, such as the loss of a limb. In addition, employers
must provide “lost time” compensation (two-thirds the worker’s salary) to any employee
who misses more than three days of work due to a work-related injury.

S the country lay entrenched in a prolonged economic downturn
and claims for unemployment insurance grew exponentially, the
subsequent need for expanded employment related services
was clear. With an unemployment rate flirting with double dig-
its and a food stamp caseload that had approximately doubled since 2008,
New York state was faced with a multifaceted challenge of engaging a vast
increase in the number of recipients needing service, training and reintro-
ducing them to a labor market that requires skills that may be vastly differ-
ent from the one they just left, and ultimately, finding a way to pay for it all.
In an effort to confront this chal-
lenge and continue to implement new
and innovative social programs, the
New York State Office of Temporary
and Disability Assistance created the
Food Stamp Employment and Training
Venture Initiative, taking advantage
of the availability of federal matching
funds to expand services. Designed
to support job training and education
to improve the economic prospects of
those receiving benefits from the Food
Stamp Program—the name still used
in New York for the Supplemental
Nutrition Assistance Program—the pro-
gram engages the services of nonprofit
agencies to target work registrants,
including those deemed "hard-to-
place" who may need more specialized
services to enter, re-enter or advance in
the workforce.
"Traditionally, designing a social pro-
gram is the easy part," stated Russell
Sykes, deputy commissioner of the
Center for Emplojonent and Economic

of Temporary and Disability Assistance.
"Funding it, particularly in this eco-
nomic environment, is another story.
States facing multi-billion dollar defi-
cits are often unable to allocate lim-
ited dollars to new social programs.
However, this is where the federal
SNAP Employment and Training pro-
gram's attractive funding design comes

Scenario 2—LLC Liability
Plaintiffs Karl and Ginny Drake were injured by lead paint while living in a house owned by Riverwood Homes, LLC. The plaintiffs sued Bill Ding, a member of the LLC at the time it owned the property, alleging that he was liable for their injuries. Ding had limited involvement with the property. He has never visited the property, and neither he nor the LLC was aware that the plaintiffs were occupying the property until after the LLC acquired it. Once they realized this fact, they took legal action to have the plaintiffs removed. The applicable housing code imposes liability on any individual who "owns, holds, or controls" the title to the property.

A written presentation in a legal case and a legal concept is more often beneficial regardless of the case may be or whether a court has directed one to file any. Judges barely complain about written presentation so long as the opposing party is given a copy. Written submission entails the identity of the case plus the party which a barrister is writing the presentation for. It should be brief and not repetitive, be rightfully structured according to the nature of a case, e.g., use of appropriate headings and sub-heading, provide tables of content in complex cases. Headings should not be generic but rather useful, be in a logical order for easy decision making. A written presentation should be written early and often. A problem may arise when drafting the presentation and the earlier they are identified, the easier it will be to fix them.
The written presentation should at least be submitted to a judge a day before the hearing. It is better for one to email the presentation to the chamber then file them at the registry. Written submission should contain an opening, legal issues, and closing submissions. After one is done with writing the presentation, he/she should proofread it to collect grammatical errors, spelling mistakes, and poor formatting.

In oral presentations, the first golden rule is for barristers to know that their first duty is not to their clients but rather to the court. A lawyer must never mislead a court because the court looks upon them for assistance (Mlphurs, 2013). If a court asks a question, the lawyer should answer it; if he or she is unable to answer, he should seek for assistance or take the question on notice. During the hearing, a lawyer should announce his or/her name and the party he appears for transparently. He/she should be prepared with short written notes discussed with any other side beforehand. State matters that are contentious and those that are not, have documents needed ready and copies for the opposing party, bring copies to the court as well and be aware of the power that the court posses to grant the orders your seeking. increase in the number of recipients needing service, training and reintro-
ducing them to a labor market that requires skills that may be vastly differ-
ent from the one they just left, and ultimately, finding a way to pay for it all.
In an effort to confront this chal-
lenge and continue to implement new
and innovative social programs, the
New York State Office of Temporary
and Disability Assistance created the
Food Stamp Employment and Training
Venture Initiative, taking advantage
of the availability of federal matching
funds to expand services. Designed
to support job training and education
to improve the economic prospects of
those receiving benefits from the Food
Stamp Program—the name still used
in New York for the Supplemental
Nutrition Assistance Program—the pro-
gram engages the services of nonprofit
agencies to target work registrants,
including those deemed "hard-to-
place" who may need more specialized
services to enter, re-enter or advance in
the workforce.
"Traditionally, designing a social pro-
gram is the easy part," stated Russell
Sykes, deputy commissioner of the
Center for Emplojonent and Economic
Supports at the New York State Office
of Temporary and Disability Assistance.
"Funding it, particularly in this eco-
nomic environment, is another story.
States facing multi-billion dollar defi-
cits are often unable to allocate lim-
ited dollars to new social programs.

gram's attractive funding design comes

A written presentation in a legal case and a legal concept is more often beneficial regardless of the case may be or whether a court has directed one to file any. Judges barely complain about written presentation so long as the opposing party is given a copy. Written submission entails the identity of the case plus the party which a barrister is writing the presentation for. It should be brief and not repetitive, be rightfully structured according to the nature of a case, e.g., use of appropriate headings and sub-heading, provide tables of content in complex cases. Headings should not be generic but rather useful, be in a logical order for easy decision making. A written presentation should be written early and often. Many of the technical controls put into place can be circumvented with a simple phone call. Recently, famed hacker Kevin Mitnick demonstrated this, by breaking into Sprint's backbone network. Rather than mounting a buffer overrun or denial-of-service (DoS) attack, Mitnick simply placed a call posing as a Nortel service engineer and persuaded the staff at Sprint to provide log-in names and passwords to the company's switches, under the guise that he needed them to perform remote maintenance on the system. Once the password information had been obtained, Mitnick was able to dial in and manipulate Sprint's networks at will.
Many people believe this was an isolated incident, and they would not fall for a similar act of social engineering, but Mitnick gained notoriety during the 1980s and 1990s, by performing similar techniques on computer networks around the world. Mitnick's more notorious crimes included accessing computer systems at the Pentagon and the North American Defense Command (NORAD), and stealing software and source code from major computer manufacturers. Kevin Mitnick was arrested six times. He has been working as a consultant, specializing in social engineering techniques, having gone straight after serving a five-year sentence for his most recent crime. harassment and intimidation at the Massachusetts Institute of Technology (MIT). Failing to act decisively to ensure a safe learning environment for all students would be a grave dereliction of your responsibilities as President of MIT and Chair of the MIT Corporation.
This Congress will not stand idly by and allow an environment hostile to Jewish students to persist. The House believes that your institution is in violation of Title VI of the Civil Rights Act, and the inability or

Postsecondary education is a unique opportunity for students to learn and have their ideas and beliefs challenged. However, universities receiving hundreds of millions of federal funds annually have denied

Overview
Famous Subs and Pizza Company (FSPC) is a publicly traded
corporation headquartered in Tallahassee, Florida, operating
restaurants in ten states. The company also owns a food
processing and distribution facility in Jackson, Mississippi.
Approximately 20% of the employees work full time; however,
FSPC primarily hires part-time employees as delivery drivers,
cooks, and sandwich makers. FSPC leases space for most of its
restaurants in shopping centers, but the company owns a few of
the properties, as well as its headquarters office and the
distribution facility. The company has experienced explosive
growth over the last three years, but the growth has been
accompanied by an increase in legal issues. The CEO, Chip
Stone, seeks your advice on the following legal and ethical
issues.
S1: Jurisdiction, Torts, and Agency
Faye Kennett, 4'5" tall, visited an FSPC outlet in Birmingham,
Alabama. She was four months pregnant and craved a pizza with
anchovies. She took the receipt after ordering her food and was
reading it while walking to a table. She noticed that the words
"Fat Midget" were printed on the receipt. Before she could get
to her table, Faye stepped in some water, slipped, and fell,
sustaining injuries to her back and left leg. She suffered a
miscarriage forty-eight hours after falling at FSPC. Kennett
3. filed a negligence suit in an Alabama state court against FSPC,
the store manager, and the employee at the register who had
printed the receipt.
Explain whether the Alabama state court is the proper court for
the lawsuit. Determine whether Kennett could have filed the
lawsuit in Florida.
Provide arguments for Kennett, FSPC, the manager, and the
employee at the register. Determine which party should win and
provide support for your selection.
S2: Contracts, Agency, and Torts
FSPC hired Pete Zahutt as a delivery driver for one of its stores
in Jackson, Mississippi. After five years, FSPC promoted Pete
to District Manager and let him drive the company car that was
wrapped with the company logo. Once or twice a week, Pete
also picked up supplies at the warehouse on his way to work.
With his boss's knowledge, Pete also used the FSPC car during
working hours to run some personal errands, like pick up his
daughter after school. The company viewed the arrangement as
an opportunity for free advertising. One Friday night, after Pete
left work in the company car, he delivered two pizzas to some
friends, who invited Pete in for a beer. Pete ate some pizza with
his friends, drank a few beers, and left for home. On the way
home, Pete was texting his girlfriend and hit another car,
severely injuring himself and the driver of the other car, Al K.
Seltzer. Seltzer sued Pete and FSPC; however, FSPC's insurance
company refused to cover Pete or to defend or indemnify him in
the lawsuit. Pete then sued the insurance company and FSPC.
The insurance company argued that Pete was not an "insured"
under its policy with FSPC because he did not have permission
to use the company car when the accident occurred.
The insurance policy defines an insured as "[a]nyone else while
using with your permission a covered auto you own, hire, or
borrow . . ."
"Permission" is "consent to use the vehicle at the time and place
in question and in a manner authorized by the owner, either
4. express or implied."
Did Pete have implied permission to use the car?
Ignoring the issue of insurance, is FSPC (and, therefore, the
insurance company) liable for the injuries sustained by Seltzer
under respondeat superior? If so, on what basis?
S3: ADR, Contracts, and Employment
FSPC requires its employees to sign a confidentiality and
noncompete agreement. The confidentiality portion explains
that employees will be given access to critical information
related to recipes, suppliers, and other similar data during their
employment. Employees must agree that the information is a
valuable asset and that they will not disclose the information
during or after their employment. Employees must also agree to
not make copies of any such information. The noncompete
portion of the agreement states that during employment and for
a period of two years after termination for any reason, an
individual will not work for any business that derives more than
10% of its revenue from selling sub or pizza products and is
located within 3 miles of any FSPC facility. Finally, the
agreement provides that any dispute arising from the
confidentiality and noncompete agreement shall be resolved
exclusively through arbitration.

Dee signed a document titled "Acknowledgment of Receipt of
Employee Handbook," which states that the handbook contains
important information about the employer's general personnel
policies and Dee's privileges and obligations as an employee.
The document also states, "I understand that I am governed by
the content of the Handbook and that [Employer] may change,
rescind, or add to any policies, benefits, or practices described
in the Handbook from time to time in its sole and absolute
discretion, with or without prior notice." Dee was not presented

As part of his final project in the capstone class, Pepe
developed a computer program that created the fastest and most
economical routes for delivery drivers. The program also
tracked the locations of drivers. Pepe called the program
Deliver Fast. The program was designed to be used by any food
delivery service. FSPC believes it owns the invention since
Pepe was employed by the company when he developed the
program. Pepe believes he owns the rights to the invention since
it was created for a school project and could be used for any
food delivery company.

S6: Employment and the Constitution
Cal Kulate worked in the accounting department at the FSPC
headquarters in Florida. He started out as a cashier in one of the
stores, was promoted to store manager, and was eventually
promoted to the accounting department at headquarters in
Florida. Cal received numerous outstanding-job evaluations
over the years with the company. Cal and his partner, Jim,
married recently. Jim now received medical, dental, and other
benefits as part of Cal's employment package with FSPC.
Cal reported to the director of accounting, Faith Christianson.
Cal did not receive a raise for the first time in ten years, after
receiving an unflattering performance review from Faith. Other
employees heard Faith say, "Same-sex marriages are wrong. The
Bible states that marriage should be between a man and a
woman." Faith posted Bible verses in the breakroom and at the
bottom of her e-mails. Cal reported Faith's behavior to Human
Resources, but her behavior only worsened after the report.
Cal posted some comments about Faith's behavior on his
Facebook page. He asked if other employees had experienced
7. any discriminatory actions by Faith or other managers. Cal
commented that the company did not discipline Faith after he
reported her behavior; therefore, he believed the company
supported sexual orientation discrimination. Cal also posted an
unflattering caricature of Faith on his Facebook page. One
commenter suggested that Cal report the company to the EEOC.
After another employee showed the posts to Faith, she
demanded that Cal remove the posts. When Cal refused, he was
terminated.
One of the employees who worked for Cal, Cybil Wrights,
reported Faith's treatment of Cal to the EEOC. Cybil was an at-
will employee who had been with FSPC for two years. In
response to the EEOC report, Faith terminated Cybil.
