India has limited laws against spamming. The Information Technology Act 2000 suggests compensation for failing to protect personal data and defines punishments for sending offensive electronic messages. However, anti-spam legislation is otherwise non-existent. The Ministry of Information Technology is discussing provisions against spammers but is yet to decide on how to determine inadvertent versus intentional spamming. Stronger laws and technical measures are still needed to effectively curb the growing spam problem in India.
