This week’s agenda reviewed the topics of how our judicial system works hand in hand with philosophy and legal interpretation. First and foremost, the podcast that reviews Judicial Philosophy in Legal Interpretation at the Supreme Court, talks about how those who work with and for the law make the choices and decisions they make and why. They have addressed how police officers, supreme court justices, and even judges evaluate the law and interpret the written law and reprimand or investigate certain situations based not only on mandated law, but they also use personal beliefs and experiences to make legal choices. It distinguishes how these justices may vote for and with the written law and the court system rather than their own beliefs and philosophy. There are many supreme court justices that are acting on behalf of the supreme court for 30 years, or what is considered a lifetime. When this occurs the law and supreme court views and dispositions do not change, the influences on the court hardly differ. The only way to change the beliefs of this supreme court committee is to enact a law, which could be constitutional, only allowing these justices to be involved for a max of 18 years. This then suggests that every other year a justice will retire thus changing the ideals, beliefs, and philosophical ideologies of those who are making choices on behalf of the law. Professor Ward Farnsworth had commented on a particular situation that I found very interesting; the situation was about a young man who was in an area known for illegal activity, the young man then began running as soon as he noticed the police officers. The police officers then had to determine, based off of previous experiences if the young man was running because he was hiding something, had done something illegal, or was in fact scared. Host Dan Rae had then mentioned that maybe the young man had grown up in an environment that led him to fear law enforcement, and he began running whether or not he had in fact done anything wrong. As Professor Ward then stated that the police officers experience may have been that individuals who run from law enforcement typically have done something they shouldn’t. You now have two very different perspectives and only life experience combined with the law can determine what actions to take.
In the case of George W. Bush vs Al Gore, the same principles have applied. When the state court systems approved the recount of the votes in various counties the supreme court then reviewed the case and decided that under the fourteenth amendment, the Equal Protection Clause, back down to the state level and the state of Florida felt as though they had no choice but to dismiss the case for a recount of the votes. It was determined that the actions that took place during this election in the state of Florida left many individuals feeling as though there were politics invo.

This paradox is founded on the underlying principle that public law is trying to balance three elements: the needs of employers, the needs of employees, and the interests of government in pursuing public policy. The entire chapter looks at how these three elements—employees, employers, and policy dictates—are balanced in a wide variety of areas. On one hand, the balancing that is achieved is a magnificent monument to rationality at its best, because the legal system does an extraordinary job of ensuring fairness for employees, employers, and the implementation of policy. It also allows for varying the balance to suit different issues, to evolve over time, and to consider fact-specific situations. Yet on the other hand, public law can be frustrating too, because the balancing act does vary from area to area, does vary constantly over time, and predictability in fact-specific situations is sometimes in doubt until situations are legally challenged and litigated. Thus, public law can be very challenging and frustrating for public managers. As the book points out, managers must embrace the law to avoid the law. This chapter is the primary means that the MPA program uses to ensure that managers are both informed and relatively comfortable dealing with this challenging aspect of management.

An interesting note is that much of what constrains employers is not in the law itself, but in civil service rules and tenure systems. Such rules are considered to be freely adopted by governments or individual agencies, and in most cases either have the weight of law, or at least a very strong legal weight in litigation and provide a weapon that can be used when individuals and unions seek protection of employee rights. Thus many of the generalizations in the chapter are based on common practices articulated in rules, rather than specific laws themselves. A prime example of this is in discipline, where civil service systems constrain agencies to act through specific procedures which must be followed scrupulously. The Second Chance Law in Indiana allows certain criminal records to be sealed to prevent them from appearing on background checks and potentially affecting employment opportunities. Individuals can only have one offense expunged, with waiting periods of one year for arrests without convictions, five years for misdemeanors, and 10-15 years for felonies depending on the type. The General Counsel, appoinfed by the President to a 4-year term, is independent from the Board and is responsible for the investigation and prosecution of unfair labor practice cases and for the general supervision of the NLRB field offices in the processing of cases. In class so far, we have discussed in general terms what the Act says, and the Board decides what the Act means. For example, the Act says it is unlawful for an employer to discriminate against an employee for engaging in Union activity, and the Board's job is to review specific facts to determine whether the General Counsel can prove that what happened in a particular case violated the law. The Board reviews the facts in a specific case and writes a decision in which it sets out the facts and its decision on whether in those circumstances the Act was violated. As I noted above, the members of the Board are appointed based on their political party. The decisions issued by the Board tend to favor the political party of the majority of the members on the Board. This means that when there is a shift in the party in power, there is then a shift in the leanings of the Board's decisions. As a result, the Board has been known to frequently overrule the decisions of a previous Board that was dominated by the other political party - what used to be legal suddenly becomes illegal and vice versa. Some issues have gone back and forth multiple times over the years. This can be very confusing for employers, unions, and employees. When a new General Counsel is sworn in, they usually set forth priorities for their term in office. I am not a scholar of English or literature. I cannot give you much more than personal
opinions on the English language and its variations in this country or others. I am a writer. And
by that definition, I am someone who has always loved language. I am fascinated by
language in daily life. I spend a great deal of my time thinking about the power of language—the
way it can evoke an emotion, a visual image, a complex idea, or a simple truth. Language is the
tool of my trade. And I use them all—all the Englishes I grew up with.
Recently, I was made keenly aware of the different Englishes I do use. I was giving a talk
to a large group of people, the same talk I had already given to half a dozen other groups. The
nature of the talk was about my writing, my life, and my book, The Joy Luck Club. The talk was
going along well enough, until I remembered one major difference that made the whole talk
sound wrong. My mother was in the room. And it was perhaps the first time she had heard me
give a lengthy speech, using the kind of English I have never used with her. I was saying things
like, “The intersection of memory upon imagination” and “There is an aspect of my fiction that
relates to thus-and-thus”—a speech filled with carefully wrought grammatical phrases, burdened,
it suddenly seemed to me, with nominalized forms, past perfect tenses, conditional phrases, all
the forms of standard English that I had learned in school and through books, the forms of
English I did not use at home with my mother.
Just last week, I was walking down the street with my mother, and I again found myself
conscious of the English I was using, the English I do use with her. We were talking about the
price of new and used furniture and I heard myself saying this: “Not waste money that way.” My
husband was with us as well, and he didn't notice any switch in my English. And then I realized
why. It’s because over the twenty years we’ve been together, I’ve often used that same kind of
English with him, and sometimes he even uses it with me. It has become our language of
intimacy, a different sort of English that relates to family talk, the language I grew up with.

as this ever happened to you? You are embroiled in an argument
about a matter that is important to you and also to an employ-
ee. After several back-and-forth exchanges, you finally say,
“Okay, then, we’ll do it your way.” You do what you can to give that

On the other hand, you may have had another experience as well. An
employee storms into your office, upset about a policy that, as far as she
is concerned, just isn’t working. You listen. She continues talking; you
continue to listen. In the back of your mind, though, you are thinking, “I
don’t know what we can do to fix that. It is what it is … nobody else has
complained.” She keeps talking and you keep listening. Finally she looks

solution, we focus on the substance of the outcome. Everyone wants

something. The conventional wisdom tells us that getting that something
means that the conflict is dissolved. Did you get what you asked for?
If so, then you are happy. If you did not get what you wanted, then
you are not happy. In the first scenario, your expectation is that, when
you finally decide on a solution, the employee will be satisfied. In the
second scenario, you do not expect the employee to leave your office
satisfied unless you take some action that is acceptable to her. But the
reality is often more complex than that. Just as important—sometimes
more important—are the other two sides of the satisfaction triangle,
shown in Figure 3-1: process satisfaction and emotional satisfaction.
Understanding all three sides of the satisfaction triangle can provide
managers with a more extensive set of tools for resolving conflicts.

Until the 1980s, judges generally had wide discretion in handing down sentences. The system’s shift toward punishment brought with it changes in sentencing procedures. State legislatures began adopting sentencing guidelines that legally limited the judges’ discretion. In the past, some judges imposed sentences that were too lenient. Therefore, sentencing guidelines were developed in an effort to bring uniformity and rationality to sentencing and to curb what was perceived to be the excessive power of judges in matters of sentencing.

Paradoxes about working for the public sector and legal rights

In this chapter on Legal Rights and Responsibilities, we are essentially covering laws governing the workplace, of course focusing on the public sector arena. The introduction points out the particularly important paradoxes of living in a democracy in which we value our personal rights, and yet we must yield up or narrow many of those rights in employment situations. This paradox is founded on the underlying principle that public law is trying to balance three elements: the needs of employers, the needs of employees, and the interests of government in pursuing public policy. The entire chapter looks at how these three elements—employees, employers, and policy dictates—are balanced in a wide variety of areas. On one hand, the balancing that is achieved is a magnificent monument to rationality at its best, because the legal system does an extraordinary job of ensuring fairness for employees, employers, and the implementation of policy. It also allows for varying the balance to suit different issues, to evolve over time, and to consider fact-specific situations. Yet on the other hand, public law can be frustrating too, because the balancing act does vary from area to area, does vary constantly over time, and predictability in fact-specific situations is sometimes in doubt until situations are legally challenged and litigated. Thus, public law can be very challenging and frustrating for public managers. As the book points out, managers must embrace the law to avoid the law. This chapter is the primary means that the MPA program uses to ensure that managers are both informed and relatively comfortable dealing with this challenging aspect of management.

Such rules are considered to be freely adopted by governments or individual agencies, and in most cases either have the weight of law, or at least a very strong legal weight in litigation and provide a weapon that can be used when individuals and unions seek protection of employee rights. Thus many of the generalizations in the chapter are based on common practices articulated in rules, rather than specific laws themselves. A prime example of this is in discipline, where civil service systems constrain agencies to act through specific procedures which must be followed scrupulously. The Second Chance Law in Indiana allows certain criminal records to be sealed to prevent them from appearing on background checks and potentially affecting employment opportunities. There are restrictions on what types of offenses can be expunged. Records for violent crimes, sex offenses, or crimes committed by elected officials cannot be removed. Individuals can only have one offense expunged, with waiting periods of one year for arrests without convictions, five years for misdemeanors, and 10-15 years for felonies depending on the type. While the law aims to give people a second chance, critics argue the fees of $550 per expungement and limited opportunities to have records removed make it difficult for some to benefit. The General Counsel, appoinfed by the President to a 4-year term, is independent from the Board and is responsible for the investigation and prosecution of unfair labor practice cases and for the general supervision of the NLRB field offices in the processing of cases. The Board has five Members and primarily acts as a quasi-judicial body in deciding cases on the basis of formal records in administrative proceedings. The party in power (meaning the party of the current president) gets to have the majority of the seats on the Board. Currently, there are 3 Democratic members and 2 Republican members. Think of the General Counsel as the prosecutor and the Board as the judge(s). The Board's job is to determine whether there is a violation of the National Labor Relations Act (Act). In class so far, we have discussed in general terms what the Act says, and the Board decides what the Act means. For example, the Act says it is unlawful for an employer to discriminate against an employee for engaging in Union activity, and the Board's job is to review specific facts to determine whether the General Counsel can prove that what happened in a particular case violated the law. The Board reviews the facts in a specific case and writes a decision in which it sets out the facts and its decision on whether in those circumstances the Act was violated. As I noted above, the members of the Board are appointed based on their political party. The decisions issued by the Board tend to favor the political party of the majority of the members on the Board. This means that when there is a shift in the party in power, there is then a shift in the leanings of the Board's decisions. As a result, the Board has been known to frequently overrule the decisions of a previous Board that was dominated by the other political party - what used to be legal suddenly becomes illegal and vice versa. Some issues have gone back and forth multiple times over the years. This can be very confusing for employers, unions, and employees. When a new General Counsel is sworn in, they usually set forth priorities for their term in office. I am not a scholar of English or literature. I cannot give you much more than personal
opinions on the English language and its variations in this country or others. I am a writer. And
by that definition, I am someone who has always loved language. I am fascinated by
language in daily life. I spend a great deal of my time thinking about the power of language—the
way it can evoke an emotion, a visual image, a complex idea, or a simple truth. Language is the
tool of my trade. And I use them all—all the Englishes I grew up with.
Recently, I was made keenly aware of the different Englishes I do use. I was giving a talk
to a large group of people, the same talk I had already given to half a dozen other groups. The
nature of the talk was about my writing, my life, and my book, The Joy Luck Club. The talk was
going along well enough, until I remembered one major difference that made the whole talk
sound wrong. My mother was in the room. And it was perhaps the first time she had heard me
give a lengthy speech, using the kind of English I have never used with her. I was saying things
like, “The intersection of memory upon imagination” and “There is an aspect of my fiction that
relates to thus-and-thus”—a speech filled with carefully wrought grammatical phrases, burdened,
it suddenly seemed to me, with nominalized forms, past perfect tenses, conditional phrases, all
the forms of standard English that I had learned in school and through books, the forms of
English I did not use at home with my mother.
Just last week, I was walking down the street with my mother, and I again found myself
conscious of the English I was using, the English I do use with her. We were talking about the
price of new and used furniture and I heard myself saying this: “Not waste money that way.” My
husband was with us as well, and he didn't notice any switch in my English. And then I realized
why. It’s because over the twenty years we’ve been together, I’ve often used that same kind of
English with him, and sometimes he even uses it with me. It has become our language of
intimacy, a different sort of English that relates to family talk, the language I grew up with.

as this ever happened to you? You are embroiled in an argument
about a matter that is important to you and also to an employ-
ee. After several back-and-forth exchanges, you finally say,
“Okay, then, we’ll do it your way.” You do what you can to give that
employee exactly what he is asking for, only to find out later that he is
still ticked off. You are left wondering, “What is his problem? Isn’t he
ever satisfied?”
On the other hand, you may have had another experience as well. An
employee storms into your office, upset about a policy that, as far as she
is concerned, just isn’t working. You listen. She continues talking; you
continue to listen. In the back of your mind, though, you are thinking, “I
don’t know what we can do to fix that. It is what it is … nobody else has
complained.” She keeps talking and you keep listening. Finally she looks
at you with relief and says, “Thanks for listening. I feel better. I’ll talk to
you later.” You didn’t do anything, and somehow the situation is now
okay. You are left wondering what happened.

something. The conventional wisdom tells us that getting that something
means that the conflict is dissolved. Did you get what you asked for?
If so, then you are happy. If you did not get what you wanted, then
you are not happy. In the first scenario, your expectation is that, when
you finally decide on a solution, the employee will be satisfied. In the
second scenario, you do not expect the employee to leave your office
satisfied unless you take some action that is acceptable to her. But the
reality is often more complex than that. Just as important—sometimes
more important—are the other two sides of the satisfaction triangle,
shown in Figure 3-1: process satisfaction and emotional satisfaction.
Understanding all three sides of the satisfaction triangle can provide
managers with a more extensive set of tools for resolving conflicts.

In 1955, when Robert Guthrie, PhD, enrolled in a master's program at the University of Kentucky, he was a singular dark face against a backdrop of white.
"I remember one of my white professors eyeing me as if I were an anthropological specimen and remarking, 'You are from one of our Negro schools,'" Guthrie recalls.
His fellow white students didn't offer much support, either, he says, though he once attended a football game after a white student begged him. But when the band played "My Ol' Kentucky Home," a song that at the time included favorable portrayals of slavery, Guthrie knew he had to "get my education, then get the hell off campus."
Despite the discomfort and frustration he felt, however, Guthrie always knew he had a right to be there. That sense of confidence is what propelled him to pursue a degree in psychology when few blacks could, to go on to teach at the University of Pittsburgh, to study multicultural issues as a senior research psychologist in Washington, D.C., and to pen the now-classic tome, "Even the Rat Was White: A Historical View of Psychology."
Last spring, the National Archives of American Psychology honored Guthrie as the first African-American psychologist to deposit his papers there. Asking Guthrie to contribute was a natural choice for the archives because he has worn almost every one of psychology's hats, from research to teaching to government service, says director David Baker, PhD.
"We know almost nothing about the development of psychology at historically black colleges and universities, and only Bob Guthrie's work examines this in detail," Baker explains. "African Americans have much to be proud about their struggle against adversity, like the fact that in my lifetime they were not allowed to attend many grad schools simply because of their race. There are stories of inspiration, courage and strength, and also of anger, frustration and hurt."

Guthrie and his twin brother were born in Chicago on Feb. 14, 1932. Weeks later, his father, a school principal, picked up the family and moved to Richmond, Ky., then to Lexington, Ky., towns in great need of teachers for African-American schools.
Growing up in the segregated South left an indelible mark on Guthrie's career outlook. "I did not think I would have an outstanding career," he says. "I was simply growing up in segregated Kentucky, and as at that time black colleges were training teachers to operate primarily in the Southern schools, I figured I might be a public school teacher. Most gunshot victims do not die. In some estimates, 80
percent live to see another day. Yet social scientists
continue to focus on gun homicide. What happens to
individuals who get shot and survive? How do they
experience life after the shooting? This article examines
how gunshot injuries transform the lives of victims. In
practical ways, gunshot injuries complicate sleeping,
eating, working, and other previously taken-for-granted
activities. These disruptions also have much larger exis
tential significance to victims. Indeed, daily experiences
with a wounded body become subjective reminders that
individuals are no longer who they used to be. Ironically,
in some interactions, being wounded becomes attrac
tive and advantageous to victims. Together, these
themes illustrate the need for more sustained ethno
graphic work on the foreground of violent crime vic
timization.

The technological factors are one of the external factors that are increasingly affecting the business organization. The business changes relate to the presence and the development of technology.
The technology increases the supply of the products. The increase in the supply enables the company to keep up with the demand for the soft drinks. The technology enables the company to increase the productivity and the communication between the suppliers and the consumers. The company can cut down the waste as well as keep up with the demands due to technological advancement. The technology also increased the accuracy in production due to the machinery that was more accurate than the human labour and the company was able to cut down the waste again. The company reduced its expenditure in terms of the losses incurred due to poor production.
It is important to consider the environment while thinking about the strategy change. The supply and demand within the business affect organizational ability. The demand and the supply stimulate each other impacting the prices of the goods and services in the budget. The customer's interest in specific products exhausts the supply available and increases demand. The demand and supply of goods and services have a high influence in determining the prices of goods and services. The prices of the product are likely to fall if the supply keeps on growing and if the supply keeps on decreasing the prices are likely to keep on growing (Becker, 2017). However, with the market economy, the interest consumers, as well as the companies, produce limits product that matches the demand and the supply and it is used in determining the product development and production.

A wound is a break in the integrity of the skin or tissues, which may be associated with disruption of the structure and function.
Healing is the body’s response to injury in an attempt to restore normal structure and functions.
Healing can occur in two ways: Regeneration and Repair
There are 4 phases of wound healing: hemostasis, inflammation, proliferation, and remodeling. This document also describes the mechanism of wound healing. Factors that affect healing include infection, uncontrolled diabetes, poor nutrition, age, anemia, the presence of foreign bodies, etc.
Complications of wound healing like infection, hyperpigmentation of scar, contractures, and keloid formation.
