1. Protecting Girls who are not of a consenting age!
THE LAW:
The age of consent in Malta is 18. Sexual activity - typically by people over 18 - with people
between 12 and 18 can be considered defilement of minors by lewd acts or corruption of a
minor, which, at the discretion of prosecutors and the courts, depending on the circumstances,
may result in a conviction.
Art 201 of Chapter 9 of the Laws of Malta (Presumption of violence in cases of carnal
knowledge and indecent assault) states:
201. Unlawful carnal knowledge and any other indecent assault, shall be presumed to be
accompanied with violence -
(a) when it is committed on any person under twelve years of age;
(b) when the person abused was unable to offer resistance owing to physical or mental
infirmity, or for any other cause independent of the act of the offender, or in
consequence of any fraudulent device used by the offender.[65]
The punishment is imprisonment from three to nine years, with or without solitary
confinement, as described in Art. 198 (Rape or carnal knowledge with violence). The
punishment can be increased in certain cases described in Art. 202, such as when the
person has not attained the age of nine years.
THE BRIEF:
This is an important issue because we all have children that come out of mothers; we all know
by now that abuse is about control and dating a girl who is not of a consenting age, gives an
older man an enormous level of control over her, which is unfair considering she is still a child in
need of protection.
There is a good reason why there are laws in place to protect girls who are not of a consenting
age; (a) their lack of experience makes them easy targets to predators (b) at that age they
confuse love with lust and believe they love everyone who touches them; they are easily lied to
(c) they often lack sexual information and aren’t mentally mature enough to make an informed
decision with regards to their sexual safety, making them very vulnerable (d) and are highly
irresponsible in accordance with their age.
The lack of experience makes younger girls vulnerable and very easy targets to the calculations
of grown men. At 15 (even at 16), girls are still children, despite how well developed they are
physically, who need to grow up at their own pace and their childhood should not be
compromised and/or stolen by older men who may only have one thing on their minds, or two –
sex and control. We insist on Child Protection to intervene when a mother is abusing her child
but when an older man is taking the innocence of another we accept it.
Those who start having sex too early may not be prepared to deal with the potential
emotional, social and behavioral consequences of their actions.
Relaxed attitudes toward sexuality are damaging girls in their formative years and ultimately
harming society by increasing social ills. Once upon a time, 'slut' was one of the greatest insults,
but now, being a 'prude or a virgin' is deemed to be even worse and un-cool.
That’s not to say we should downplay the physical consequences of uncommitted sex.
Pregnancy is a life changing event. Sexually transmitted infections (STI’s) can rob you of your
2. health and even your life. Condoms can reduce but do not eliminate these physical risks.
Consistent condom use reduces by only 50% the risk of Chlamydia – the cause of a substantial
proportion of female infertility; and a few people achieve consistent/correct use. Although there
is some evidence that 100% condom use may reduce the risk for human papillomavirus – the
cause of virtually all cervical cancer in women – a significant risk remains. Some STI’s can be
passed on by the skin-to-skin contact in the entire genital area, only a small part of which is
covered by a condom.
With regards to my husband here is a man who has a wife that he’s abused (me), personally
gaining at the expense of another; money, status with key ministries and the power to behave
like he’s above the law, as a result of colluding with a corrupt detective. Sadly enough, he has
the support of his community at large but that does not mean everyone. He is responsible for a
child that was conceived in betrayal to a mother who he used like a prostitute, who doesn’t
seem to mind, as she keeps going back to him; ‘she was just sex’ he said. After she forces him
into fatherhood against his will manipulating and controlling her way into his life, my husband
breaks out and starts sleeping with foreign students by numbers from the ESE School in
Paceville – it’s a different one each week – after the Maltese girls have decided that they are not
his trash. His penis is unfortunately too small for condoms and the risk of spreading Sexually
Transmitted Diseases and unwanted pregnancies is quite high, so to solve this problem without
having to take responsibility for his actions, he targets girls who are not of a consenting age,
and his efforts seem to be well supported, as no one is asking any questions and his social
circle of friends increasing… and there are parents who are willing to feed their daughters to him
until he can find one that suits his selfish nature – one that he can control!
…and the social workers have the cheek to suggest that I am the one who needs counseling???
What’s wrong with this picture Malta and why is he still being protected when he is posing a risk
to the females race and some, too young to know better. Is this a case of inequality, I mean
could you imagine the reputation a Maltese girl would get for doing the same thing? Or is this
accepted Violence Against Women raring it’s ugly head again?
In Australia, religious groups tried to encourage the Government (some time ago) to raise the
consenting age to 21, as too many children, especially girls are falling victims (they call them) at
the hands of older men, catching Sexually Transmitted Diseases and running to abortion clinics
trying to fix unwanted pregnancies at only 16. A Child should be with other children; I’m not
denying that they don’t have hormones and want to experiment but what I am insisting on for
the sake of protecting their youth, is that if they are not of a consenting age, they should be
doing what they are going to do with other kids their age group, so that they are not growing up
before their time and losing a childhood that once taken, they cannot get back. Men who target
and take advantage of younger girls in Australia who are not of a consenting age are charged
with Statutory Rape and often Jailed and that’s how we protect our girls in Australia, because to
Violence Against Women, Australia Say’s NO!
