( 4) Suppose you are the judge responsible for sentencing Jason Miller, a 20 year-old man convicted of robbing a convenience store. At trial, the prosecution showed that Jason was the getaway driver for his older brother and another man (both of whom had lengthy criminal histories). Jason was not armed and did not have any interaction with anyone inside the store. The other two men brandished firearms and struck the clerk, causing severe head trauma. Jason’s attorney presented evidence at his sentencing hearing that Jason had only been arrested once before for stealing a cell phone from another student in high school; Jason had successfully completed diversion for that offense. His attorney also presented evidence that Jason had maintained a job for two years after high school graduation as a construction worker. In your jurisdiction, you have the option of sentencing Jason to prison (for 1-25 years) or to probation (for up to five years). How would you determine an appropriate sentence for Jason? Question 7 Becky Williams works on a road crew for the City of Palm Springs. She often works early in the morning to repair potholes on the busy streets. One day, a vehicle sped through the construction zone and veered off the road, pinning Becky between the vehicle and a work truck. Becky was trapped for an hour while emergency crews freed her. As a result of the incident, Becky suffered tremendous physical damages, including the amputation of both of her legs. Becky filed a civil suit; her attorney asked for damages to compensate Becky for her physical injuries as well as for the trauma caused by the accident. At the trial, evidence was presented as to the medical costs, lost wages, and loss of future earning capacities. While actus rea is pretty much always required for there to have been a crime committed, in cases involving drugs, alcohol, or traffic crimes, mens rea is not necessary. The best example I can think of for this would be manslaughter due to reckless driving. When operating a motor vehicle, you accept the terms of strict liability, which is the main purpose of medications having a waring against operating vehicles and heavy machinery. When a drunk driver accidentally kills someone, they are likely to be found guilty of manslaughter. On the other hand, mens rea is required in cases not involving vehicles and/or mind altering substances. The only example that comes to mind for this is accepting stolen property. If you were to buy a bicycle from someone on craigslist, there is a good chance that you would not suspect the bike to be stolen property, in which case you would not be guilty. I feel like this concept would be most useful for the defense, as it allows you to maintain your innocence in the case of a crime you did not knowingly commit.
Subject matter jurisdiction is more interesting to me, as personal jurisdiction mainly just relates to a person being in a place. Subject matter jurisdiction, on.

In the United States, the adolescent court framework was established more than ten years before the main court establishment in 1899 in Illinois. Prior to the creation of juvenile courts, the common law's infancy defense provided the only special protections for young offenders charged with crimes. Recently, while waiting in the local community court i with a student from
the Howard University School of Law Criminal Justice Clinic, 2 1 witnessed a
defendant requesting that a new lawyer be appointed to her case. The
defendant complained to the judge that her court-appointed lawyer did not tell
her what was going on in her case, and that he had been working against her.
The judge asked us to take over the case, and we interviewed this new client.
With tears streaming down her face, our new client explained that she felt that

Jed, Herman, and Jane live in Washington, D.C. Jed and Jane entered the local bank and took $65,000. Jed and Herman both used shotguns during the robbery, though no one was hurt. Jane drove the getaway vehicle. Two hours later, as they headed toward the Canadian border, they were stopped by the police for speeding and taken into custody. The police determined that Jed and Jane matched the eyewitness descriptions of the robbers. Jane confessed their bank robbery scheme. Jed and Herman denied their involvement. The police only recovered $25,000 in cash, but were unable to determine if the recovered money was taken from the bank. The police determined that Jed was a convicted felon at the time of the armed bank robbery. The local police and FBI were involved in the investigation. The defense attorneys for each defendant (Jed, Herman, Jane) request a continuance for four months to sift through the evidence. The prosecution objects and argues that the delay would significantly clog the court’s already heavy workload. In the alternative, the prosecution argues that if the court grants a continuance, then the prosecution should be allowed to prolong turning over the remaining discovery. The defense attorneys object and argue that this hinders their effective representation of their clients and would hinder a prompt resolution. The defense attorneys further argue that their clients deserve a well prepared and thorough defense. The judge currently has trials blocked over the next 10 months and wants to try the case now.

In most criminal justice systems, a felony is a crime that may be punished by 1 year or more of incarceration (Wright, 2013). In most cases individuals convicted of a felony are incarcerated in prison (Wright, 2013). Felony is a serious crime, characterized under federal law and many state statues as any offense punishable by death or imprisonment (West’s Encyclopedia of American Law Edition 2, 2008).
A misdemeanor is a crime that may be punished by no more than 1 year of incarceration (Wright, 2013). The individuals convicted of misdemeanors usually serve their time in jails (Wright, 2013). Misdemeanor is offenses lower than felonies and generally those punishable by fine, penalty, forfeiture, or imprisonment other than in a penitentiary (West’s Encyclopedia of American Law Edition 2, 2008).
The differences between a felony and misdemeanor charge is that a person is punished for the offenses committed one serves time in a prison for more than one year and the other serves time in a jail for no more than a year. These charges are used to classify where the criminal is punished and where the sentence will take them.

The prosecution objects and argues that the delay would significantly clog the court’s already heavy work load. In the alternative, the prosecution argues that if the court grants a continuance, then the prosecution should be allowed to prolong turning over the remaining discovery. Background and Facts
Kevin was adjudicated for habitual truancy and filed a motion to terminate jurisdiction based on the fact that his mother signed a release authorizing his withdrawal from school. The separate Juvenile court of Lancaster county terminated its jurisdiction, and the state appealed when the Juvenile and Department of Health and Human Serviced petitioned the case for further review. In Knoxville Tennessee, FBI Emergency Response agents train how to excavate a body at the Body Farm. The agents pair up in teams with forensic anthropologists to learn how to best identify and excavate human remains to preserve the clues and pieces of evidence that decaying bodies may leave behind. The weeklong training gives agents step by step instructions while surprising the agents with twists and surprises during their excavations. This was very interesting to me because it helps put things into perspective. Teaches them to put the victim first, which will motivate them to slow down, be methodical with their techniques and be very thorough because it only can be done once.

Recently, while waiting in the local community court i with a student from
the Howard University School of Law Criminal Justice Clinic, 2 1 witnessed a
defendant requesting that a new lawyer be appointed to her case. The
defendant complained to the judge that her court-appointed lawyer did not tell
her what was going on in her case, and that he had been working against her.
The judge asked us to take over the case, and we interviewed this new client.
With tears streaming down her face, our new client explained that she felt that

In most criminal justice systems, a felony is a crime that may be punished by 1 year or more of incarceration (Wright, 2013). In most cases individuals convicted of a felony are incarcerated in prison (Wright, 2013). Felony is a serious crime, characterized under federal law and many state statues as any offense punishable by death or imprisonment (West’s Encyclopedia of American Law Edition 2, 2008).
A misdemeanor is a crime that may be punished by no more than 1 year of incarceration (Wright, 2013). The individuals convicted of misdemeanors usually serve their time in jails (Wright, 2013). Misdemeanor is offenses lower than felonies and generally those punishable by fine, penalty, forfeiture, or imprisonment other than in a penitentiary (West’s Encyclopedia of American Law Edition 2, 2008).
The differences between a felony and misdemeanor charge is that a person is punished for the offenses committed one serves time in a prison for more than one year and the other serves time in a jail for no more than a year. These charges are used to classify where the criminal is punished and where the sentence will take them.

In Knoxville Tennessee, FBI Emergency Response agents train how to excavate a body at the Body Farm. The agents pair up in teams with forensic anthropologists to learn how to best identify and excavate human remains to preserve the clues and pieces of evidence that decaying bodies may leave behind. The weeklong training gives agents step by step instructions while surprising the agents with twists and surprises during their excavations. This was very interesting to me because it helps put things into perspective. - 1. ( 4) Suppose you are the judge responsible for sentencing Jason Miller, a 20 year-old man convicted of robbing a convenience store. At trial, the prosecution showed that Jason was the getaway driver for his older brother and another man (both of whom had lengthy criminal histories). Jason was not armed and did not have any interaction with anyone inside the store. The other two men brandished firearms and struck the clerk, causing severe head trauma. Jason’s attorney presented evidence at his sentencing hearing that Jason had only been arrested once before for stealing a cell phone from another student in high school; Jason had successfully completed diversion for that offense. His attorney also presented evidence that Jason had maintained a job for two years after high school graduation as a construction worker. In your jurisdiction, you have the option of sentencing Jason to prison (for 1-25 years) or to probation (for up to five years). How would you determine an appropriate sentence for Jason? Question 7 Becky Williams works on a road crew for the City of Palm Springs. She often works early in the morning to repair potholes on the busy streets. One day, a vehicle sped through the construction zone and veered off the road, pinning Becky between the vehicle and a work truck. Becky was trapped for an hour while emergency crews freed her. As a result of the incident, Becky suffered tremendous physical damages, including the amputation of both of her legs. Becky filed a civil suit; her attorney asked for damages to compensate Becky for her physical injuries as well as for the trauma caused by the accident. At the trial, evidence was presented as to the medical
- 2. costs, lost wages, and loss of future earning capacities. Discuss any issues Becky’s attorney may have in presenting her case for psychological injuries. Question 12 Plea bargaining is encouraged in the criminal system for many reasons. It can help reduce the caseload, eliminate the need for victims to testify, result in charges being dropped for a defendant, and can secure a defendant’s testimony against co- defendants. Plea bargaining does not occur in every case. Those defendants who instead request a trial are sentenced to prison at a higher rate than those who accept a plea bargain. Consider the role of the judge in sentencing. Explain why a judge may sentence a defendant who is convicted of a crime after trial more harshly than one who accepted a plea bargain for the same charge. Question 14 The largest discrepancy between verdicts reached by judges as opposed to jurors occurs when jury _____ are involved; even though a defendant may be guilty, the jury finds them not guilty because they view the charge as trivial or the act as justified.
