SINTESIS
Decreta el sobreseimiento de una mujer víctima de violencia de género que interrumpió su embarazo y de las dos médicas que la atendieron y le proporcionaron un medicamento para llevarlo a cabo. Señala que nuestro sistema legal prohíbe el aborto aunque el límite legal a los casos en los que puede concretarse excede la taxatividad que ofrece el art. 86 del C.P., a punto tal que la Corte Suprema entendió que los médicos, en ningún caso, deben o pueden requerir la autorización judicial para realizar esta clase de abortos, debiendo practicarlos requiriendo exclusivamente la declaración jurada de la víctima, en la que manifieste que el embarazo es la consecuencia de una violación. Considera que si bien no existió una denuncia de violación como es requerida por la normativa para justificar el aborto, al menos desde el plano formal, los elementos probatorios permiten suponer tal como también lo entendieron las médicas imputadas, que la mujer habría sido víctima de situaciones de violencia por parte del padre del no nato, que es facultad de la víctima denunciar o no el abuso y que ese pudo haber sido el fundamento del aborto, de modo que las profesionales procedieron justificadamente a hacer efectiva la voluntad de la madre.
