Here are three key points about privacy from the passage:
1. Privacy is important for democracy, a thriving economy, and personal well-being as it allows individuals choice over what parts of their lives they keep private. However, technology is overwhelming privacy protections and companies have a responsibility to protect privacy beyond just compliance.
2. Companies extensively collect and use customer data for profit and competitive advantage through practices like cyber tracking, but should draw clear limits on data use to meet customer expectations of privacy protection.
3. While governments have been slow to update privacy laws for the digital age, setting clear internal privacy limits and breaking down silos between security, risk, and compliance functions can help companies protect privacy without waiting for new regulations.

Information Governance, Managing Data To Lower Risk and Costs, and E-Discover...David Kearney
Information governance, records and information management, and data disposition policies are ways to help lower costs and mitigate risks for organizations. Policies and procedures to actively manage data are not just an IT "problem," they're a collaborative business initiative that is a must in today's "big data" environment. With electronic discovery rules, government regulations and the Sarbanes-Oxley Act, all organizations must proactively take steps to manage their data with well-governed processes and controls, or be willing to face the risks and costs that come along with keeping everything. Organizations must know what information they have, where it is located, the duration data must be retained and what information would be needed when responding to an event.
There have been numerous instances of severe legal penalties for organizations that did not have an electronic data strategy, tools, processes and controls to locate and understand their own data. In addition, the risks of unmanaged data include skyrocketing infrastructure and personnel costs and an increase in attorney time to manage massive amounts of data when a litigation event occurs.
Information governance is needed much like any business continuity and disaster recovery plans, but with an understanding of data: where data are located, how data are managed, event response, and regular testing of processes and procedures for preparedness.
This document discusses records management and eDiscovery. It begins with defining key terms like records, certifications, standards, and laws/acts. It then discusses challenges around managing increasing volumes of information and how records management systems can help with eDiscovery processes. Four use cases are presented that show how EMC solutions like Documentum and SourceOne can help with challenges involving paper records, electronic records, distributed electronic data, and responding to eDiscovery requests. The document encourages asking questions about goals, ownership, funding, and stakeholders for records management projects.

Defining a Legal Strategy ... The Value in Early Case AssessmentAubrey Owens
Early Case Assessment provides the framework for litigators to identify and analyze electronically stored information in response to a litigation hold and.or discovery request.
Every lawyer needs eDiscovery. Do you do it right?
Learn how to navigate dramatically increasing amounts of electronic data in this free Clio webinar.
How does your firm handle eDiscovery? In litigation and government investigations, eDiscovery is the process by which information is exchanged electronically—and it’s becoming more and more common.
Unlike traditional information stored in paper form, electronic information is much more pervasive, long-lasting, and transient. During a discovery disclosure, you will get mountains of data that needs to be sorted and analyzed. In this webinar, we’ll talk about the principles of eDiscovery and how your can ensure that your practice can properly preserve and sort information efficiently.
Join Nextpoint CEO Rakesh Madhava and Clio’s own Joshua Lenon as we walk you through:
- the basics of eDiscovery
- which tools your firm should use to acquire and preserve information
- how to quickly find the nuggets of data your case needs
- how to integrate eDiscovery better into your practice
Even with the growing importance of eDiscovery, most law firms still aren’t prepared to handle large amounts of digital information. Make sure that yours isn’t one of them.

3) The document analyzes these perspectives across four types of "landscapes": invisible (does not recognize the digital landscape), simple (only applies RIM to paper), rugged (recognizes challenges but uses siloed approaches), and dancing (integrates information, uses risk-based approaches, and measures success based on
Information Governance (IG) is truly a strategic initiative of any organization. As such, the connection to organizational strategy must be made concretely. The starting point for any IG initiative must be the organization’s corporate mandate, policies and strategic directives, mission and goals. The resulting tactical elements must be aligned with the organizational plans, objectives, and the operational targets of management.
The document outlines three keys to achieving sustainability in information governance programs:
1. Having a single authoritative source for all evidence-based records and information to ensure trust in the information.
2. Managing only one copy of each record to simplify retention, disposition, and transparency.
3. Applying the "first point of contact" principle where the person first receiving information is accountable for filing and managing it to build trust in the process over time.
Keith Atteck presented on developing an effective information governance strategy at the ARMA Canada Conference in 2016. He emphasized that strategy connects the present to the future. Atteck has over 20 years of experience in information governance, records management, and project management. He discussed how to articulate a clear IG strategy by connecting to stakeholders' needs, demonstrating value, and linking initiatives to organizational objectives. Atteck also stressed the importance of change management, defining metrics and success measures, and establishing controls to manage and verify success of the strategy.

16. RIM: Vision
Ecosystem of Information
Working in one environment where all records are;
Created or Captured – once,
Collaborated Globally – version controlled, and
Managed – as records.
Being Confident that;
You can find the original record – every time,
You know who worked on it – who used it, and
You know what it was used for – related to activity.
Know that:
One never has to search any other system,
One can leverage the collective wisdom and knowledge of the organization, and
Everyone’s efforts will not be lost or misplaced.
16
17. RIM: Guiding Principles
SINGLE authoritative source of information
All documents will be filed electronically
Into one system as a normal course of business
Everyone depends on the system
Manage only ONE COPY
File once – use many times - in many ways
All transacted records made from the document management system
FIRST point of contact principle
The person who is first point of contact with documentation is
responsible for determining and ensuring that documentation is
appropriately filed

Technology agnostic
Conforms to Laws, Regulations
All must be developed and in
place to implement ECM
RIM is the core – the foundation
Everything else is an output of RIM
Including eDiscovery
Etc.
18
21. RIM: Compliance Auditing
General - Benefits of Auditing
Test the degree of integrity of systems and procedures
Understanding degree and extent of compliance
Identifying gaps in procedures and training
Local - Due Diligence Reviews
Conduct regular reviews of all record classifications & metadata
Identify change issues of employees and management
Identifies changes in the business environment and gaps in training
Global - Quality Assurance Reviews
Critical for demonstrating integrity of systems, tools and procedures
Management knows if the systems, tools and procedures are working
Important for Litigation support – Safe Harbour
21
22. Risk Vs. Rewards for Business
Risk – The Blind
Lack of Governance - ad hoc
IT is in charge??????
Don’t know what are records
Don’t know the custodians
Inability to audit
Number of uncontrolled information
types and sources
Volume of duplication
Lack of information category structure
Too much technology
Can’t find anything easily
Poor basis for business decisions
No idea what is really happening
ECM deployments tend to fail
Etc.
Which version
do you want
to present in
court?
Rewards – Clear Vision
Good governance & transparency
RIM Manager is in charge
Can identify a record and a copy
Can identify record authors, custodians and users
Auditable - demonstrates due diligence
Controlled record types and sources
Avoids uncontrolled repositories
Reduced volume – original records
Global search categories – relevancy
Integration of Knowledge Management
Can find everything quickly and efficiently – better decisions
Controlled technology evolution
Reduced stress to the organization and its personnel
ECM has a solid foundation and can succeed
Etc.
ROI – Risk of Incarceration (reduced)
23
23. RIM Professionals
“RIM professionals can offer a safe harbor of sorts….
This requires that RIM professionals understand the key legal and IT
issues and for them to collaborate effectively with staff in those
departments to ensure the implementation and management of a solid,
documented, and explainable records management program.
When a RIM program is in effect and adhered to as it is written – and the
organization can show proof of compliance with the program – the
organization’s attorneys are in a much better position to defend its
ediscovery processes and the information it did – or didn’t produce.”
