ADMINISTRATIVE DECISION
Terms of reference forthe Chairand Vice-Chair ofthe Kimberley Process
A. General provisions
1. Pursuantto SectionVI"AdministrativeMatters" oftheKPCScoredocument each year
theKPParticipantcountrypreviously servingasViceChairistobecometheChairofthe
Kimberley Process inaccordancewiththeestablished procedure.
2. The functions of the Chair and Vice-Chair are performed by representatives officially
designated by the corresponding Participant countries holding office from the first day of
January following the year ofselection.
3. In the execution of their functions of the Chair and Vice-Chair, Participant countries may
replace their corresponding representatives but should endeavor to notify Participants and
Observers of such a change not laterthan amonth in advance.
4. The Chair represents the collective will of the Participants, as reflected in corresponding
KP decisions, organizes the work for implementation of the adopted decisions and
coordinates the official activity of the KP with other international organizations and mass
media.
5. The Chair and Vice-Chair should closely interact with the Chairs of the various KP
workingbodiesintheperformance oftheirwork,includingbymeans ofholdingspecial
meetingsoftheChairsoftheKPworkingbodiesand,whenrequired,participatinginthe
deliberations therein.
6. The Chair and Vice-Chair should comply with the decisions as well as rules and
procedures ofthe KP.
B. Rights and responsibilities ofthe Chair
WithintheframeworkoftheKPtheChairisto,interalia:
coordinate the current functioning ofthe KP and the activity ofthe working bodies;
organize, host and preside over all KP meetings, including Intercessional meetings ofthe
working bodies andPlenary sessions;
makeprovisionsforreaching consensusintheKPdecisionmakingbymeansofholding
meetings and consultations with the Chairs of the working bodies, Participants and
Observers;
provide current information (updates) to Participants and Observers onthe activities of
the KP;
pursuant to established procedures and current practice, invite Guests to the
Intercessional and Plenary meetings, and maintain the lists of the Participants and
Observers;
hold regular consultations with the Chairs ofthe working bodies;
pursuant to established procedures and current practice, take decisions on review
visits/missions andexpertmissions and conferupon them the corresponding powers;
operate and be responsible (including appropriate security) for the KP website, including
updating information inatimely manner;
accept reports of the Chairs of the working bodies on the performance thereof at the
Plenary sessions;
preside over and facilitate the deliberations of the Selection Committee for the selection
ofthe Vice-Chair;
represent the KP in the United Nations and other international organizations;
coordinateexternalcommunicationsasneeded;

prepareadraftUNGAresolution"Theroleofdiamondsinfuellingconflict:breakingthe
link between the illicit transaction of rougb diamonds and armed conflict as a
contribution to prevention and settlement of conflicts'', for as long as this remains an
item onthe UNGA agenda;
accept the applications ofthe candidates toparticipate inthe activity ofthe KP working
bodies and make recommendations onthem to the Plenary;
form a technical Secretariat to assist the Chair in the performance of his/her duties and
supportthecurrentworkintheKP;
perform other functions as delegated by the Plenary or by the request of the working
bodies.
C. Rigbts andResponsibilities oftheVice-Chair
AttherequestoftheChairtheVice-Chairisto,interalia:
takepartintheorganizationoftheworkoftheIntercessionalmeetingsofworkingbodies
and Plenary sessions ofthe KP;
preside overtheKPforums and otherwise perform the duties oftheKP Chair, including
organizing meetings of the Chairs of the working bodies, ad hoc inquiries regarding
infringements, prepare and deliver reports atthe request ofthe Chair;
execute other functions within the purview ofthe Chair.
D. Joint Responsibilities
I.The Chair and the Vice-Chair are to report to the regular session of the Plenary on the
execution oftheir mandates.
2. The Chair and Vice-Chair are encouraged to observe the activities of the KP working
bodies of which they are not already members, to facilitate their awareness of the work of
these bodies.
3. TheChairandVice-Chair aretoworktogethertoensureasmoothtransition ofthecarried
out functions and continuity in the KP work.
4. The official representatives designated as the Chair and Vice-Chair, pursuant to
paragraph A.2 above, are not to participate inreview visits/missions.
