Claims Administration
What is it?
Claims are contested items in a project.
Contested changes and potential constructive
changes are requested changes where the buyer and
seller cannot reach an agreement on compensation
for the change or cannot agree that a change has
occurred.
Claims Administration
Proactive claim management involves:
1. Claim Prevention
During initial concept or design phases, before a contract is signed
2. Claim Mitigation
During contract preparation and pre-contract negotiation
3. Pursuing Claims
During project execution.
4. Claim Resolution
Settlement of outstanding issues after completion
and finalisation of accounts.
Claims Administration
If the parties themselves do not resolve a claim, it may have to
be handled in accordance with alternative dispute resolution
(ADR) typically following procedures established in the
contract.
