encouraged to promote early exchange of information about future acquisitions." Exchanges are
beneficial to all parties involved in the acquisition process, and there are a number of reasons why
such exchanges are beneficial. As the regulations explain at FAR 15.201(b), some of these benefits
include an improved understanding of the Government's requirements for the potential suppliers,
and also an improved understanding of a potential supplier's capabilities by the Government.
Additionally, exchanges between Government and potential suppliers can help the Government firm
up or finalize their acquisition plan and source selection strategy for a particular procurement by
enabling them to determine things such as, "proposed contract type, terms and conditions, and

and disadvantages of the fixed–price, cost–reimbursement, and labor–hour contracts in light of both

Once we got the system user friendly and developed a training program, I was able to defer the cost
of the tools over several agencies. Once we deployed and the agencies began using it, and cut their
incidents to almost none, I was able to partner with them to secure more funding. My cost model,
after startup cost, was cheaper to deploy and maintain than commercial off the shelf software, due to

long time debates and discussions among practitioners and law commentators. This paper will focus
on improving one of the undefined and broadly interpreted terms – "instrumentality" in the anti–
bribery provisions of FCPA which essentially serves as the catch–all legislative device to prevent
gaming, however, on the other hand, leaving problems in terms of ambiguity in interpretation. This
paper will first provide an overview of the FCPA. Second, this paper will explain the global
