2. The part 27 of the Constitution of Nepal 2072
deals with another constitutional organ
referred to as ‘Other Commissions’. It
includes 7 different commissions aiming to
raise the status of the people concerned. As
mentioned in the constitution, the federal
parliament shall review the commissions after
10 years. The description of the
constitutional commissions along with their
functions, duties, and powers follows the
next.

3. Part-26 of the Constitution of Nepal from Article 250
to 251 has the provision of this commission. The
main functions, duties, and powers of the
commission follows in the lines to come;
- To determine detailed basis and modality for the
distribution of revenues between the federal,
provincial and local governments,
- To make recommendation about equalization of
grants to be provided to the Provincial and local
governments,
- To conduct study and research work and prepare
parameters as to conditional grants to be provided to
the provincial and local governments,
- To determine detailed basis and modality for the
distribution of revenues between the provincial and
local governments.

4. - To recommend measures to meet expenditures
of the different levels of governments, and to
reform revenue collection,
- To analyze macro-economic indicators and
recommend ceiling of internal loans that the
different levels of governments can borrow,
- To review the bases for the distribution between
the Federal and provincial governments or
revenues and recommend for revision,
- To set bases for the determination of shares of
the different levels of government in investments
and returns,
- To do study and research work on possible
disputes that may arise among the governments.

5. The Article 252of the constitution has provision
of the National Women Commission with
following functions, duties, and powers.
- To formulate policies and programmes for
women welfare,
- To carry out research and studies regarding
gender equality and women empowerment,
- To review whether or not the laws and
programmes related to women welfare have been
implemented,
- To make recommendation to concerned authority
to file a petition (a formal written request to a
court) in a court against gender violence and
social malpractices.

6. As per the Article No 255, the following are
the functions of this Commission
- To promote Dalit’s status by forming national
policies and programmes,
- To carry out research regarding Dalit
community and identify the legal and
institutional reforms,
- To monitor whether the laws, policies
developed for Dalit welfare have been
implemented or not,
- To recommended the concerned authority to
file petitions in court against caste
discrimination or social malpractices.

7. As per Article 258, following powers and function
are as follows;
- To carry out studies for protecting rights and
welfare of backward, marginalized and minority
communities, Khas-Arya, senior citizens,
labours, peasants, people with different abilities,
people of Karnali region, economically
disadvantages groups, etc.
- To monitor about the right representation of the
people as mentioned above in the Stage
mechanisms,
- To recommend the Government of Nepal to
develop and implement policies and programmes
for the development of those groups.

8. As the Article 261 has the provision of
following powers and functions;
- To carry out the works related to the welfare
of Aadibasi (indigenous) and Janajati (ethnic),
- To empower and assure their promotion.

9. The main task of the commission is to
promote the status of the Madhesi
communities by empowering them. The
Article 262 mentions that other provisions
related to functions, duties and power of this
commission shall be according to the federal
law.

10. The Tharu commission aims to empower the
Tharu communities through assurance or
rights, fulfillment of needs and protection of
uniquely diversified way of life. Other
provisions related to functions, duties and
power of this commission shall be according
to the federal law as mentioned in Article
263.

11. As mentioned in the Article 264, the
commission shall be in accordance to the
Federal law. It shall aim to work for the right,
freedom and empowerment of the Muslim
communities by formulating and
implementing effective plans and policies.

12. All constitutional commissions discussed
above consist of a Chairperson and 4 other
members. They are appointed by the
president on the recommendation of the
Constitutional council. They remain in post
for 6 years and retire at the age of 65 years.
Their qualification would be as declared by
the federal law. The Women Commission,
Dalit Commission and Inclusion Commission
can establish their offices in different
provinces as necessity.
