5. History of Law of Tort
Law and civilisation co-exist. One cannot exist without
another. If one flourishes, the other one develops too
and with the decline in one, the other suffers. So, for
offences related to day-to-day affairs, tort law was
formed.

According to Salmond
• , “It is a civil wrong for which
the remedy is common law
action for unliquidated
damages and which is not
exclusively the breach of the
contract or the breach of the
trust or other merely equitable
obligation.
According to Winfield
“Tortious liability arises
from the breach of duty
primarily fixed by the law:
this duty is towards the
persons generally and its
breach is redressable by
an action for unliquidated
damages.”

An act or an omission which constitutes an offence & which
is punishable by law
Acts which are inherently wrong
