Workers injured on the job can sometimes sue their employer outside of the typical workers' compensation claims process. This may occur if the employer committed an intentional wrong, such as knowingly ordering an employee to perform an unsafe task. It can also apply if the employer does not have a valid workers' compensation insurance policy in place. In those situations, the injured worker can file a personal injury lawsuit against the company.
