MOBOCRACY IN INDIA
1. MOBOCRACY IN INDIA : A
RISING CHALLENGE FOR
DEMOCRACY
DEPARTMENT OF EDUCATION
GROUP NO:4
2. DEMOCRACY VS MOBOCRACY
DEMOCRACY:
Derived from the Greek words
Demos- People
Kratos- Power or rule
“Democracy is a government of the
people, by the people and for the
people” - Abraham Lincoln
3. RULE OF LAW
DICEY’S IDEA
The government as well as private
actors are accountable under the law.
The laws are clear, publicized,
stable, and just; are applied evenly;
and protect fundamental rights,
including the security of persons and
property and certain core human
rights.
4. MOBOCRACY
Rule or domination by masses
An informal usage of the term
“ochlocracy”
Absence of Rule of Law
Unstable Government
Total chaos, mob rule
Survival of the fittest
Attempting to overthrow the
authority of government
5. Infiltrated and prejudiced
Judgments have been passed
in accordance with the
“collective” conscience of
the society.
Becoming the new
“normal.”
provoke instant punishment
outside
the established law
6. Let’s know the Facts
Mobocracy can't be the new
normal, get a law to punish
lynching : SC to Govt(
Evidence)
The National Crime Records
Bureau (NCRB)
The NCRB was planning to
collect data on mob lynching's
across the country
7. Between 2014 and March 3,
2017, 45 persons were killed
in 40 cases of mob lynching
across nine states, and at least
217 persons had been arrested,
data compiled by the home
ministry show. Details on the
motive–whether cow
vigilantism, communal or
caste hatred, or rumors of
child-lifting, etc., location of
the attack, identity of the
attacker, and victim, were not
available.
Fourteen states still not
provided the data.

8. Democracy slide down to majoritism
and it leads to mobocracy
• Majoritism is the genesis of
mobocracy,
• For majoristsm
constitutionalism is
bloackage
• Govt is bound by constitution
but a govt based majoritism
indirectly support the
mobocracy.

11. MOBOCRACY EMERGES…
The impulse for lynching is driven by two factors:
I. cultivated prejudice
II. collective sense of insecurity
POLITICAL
petition to crackdown on cow vigilantes(29th Jan
2018)
12. RELIGIOUS (2015,Dadri
.Muhammed Akhlaq)
At least 33 persons were killed
in these attacks–29 or 88% of
whom were Muslim.
Over 56% of all attacks
occurred in states run by BJP
governments.
The India Spend database of
bovine-related hate crime was
quoted by senior advocate
Indira Jaisingh in her
written submission to the
Supreme Court for the
13. CAST (2006 Dalit massacre in Khairlanji in
Maharashtra) stronger the caste and communal
consciousness, the weaker and more fragile legal
consciousness and belief in the law.
COMMUNITY
ORGANIZATION
“defenders of the law” as happened in the case of the
rape and murder of an eight-year-old girl in Kathua,
Jammu and Kashmir, earlier this year.
14. MISSREPRESENTATION
(MEDIA,SOCIAL MEDIA)
On July 19, 2017, home
minister Rajnath Singh made a
statement to the Lok Sabha
indicting misinformation and
fake news for the spate of mob
violence. Adding that it is the
state governments’ responsibility
to maintain public order, Singh
said social media operators have
been requested to be vigilant of
the spread of fake news on their
platforms.
15. LAWLESSNESS IS REPLACING
THE RULE OF LAW
Reasons behind:
Lack of zeal to implement rule of
law
Social media: Quite a handful of
incidents have occurred due to false
messages/pictures circulation on social
media platforms. Not to mention such
message surely do infuse hate pulse
without even thought of originality of
such content and people circulating such
content may be held responsible but
social media sites which provide
platform to breed hate must be held
responsible too
16. Hate mongering: Hating people is like burning down your
own house to get rid of a rat. People need to understand this
simple and straight fact.
Intolerance: Some of us are adamantly unwilling to accept
others beliefs contrary to his own.
Lack of Public confidence in judiciary: Unfortunately public
confidence in judiciary is all time low. With fast track courts
and timely justice delivery by punishing the offenders will
regain public confidence in judiciary and will result in more
cases being handed over to courts to deal for particular cases
of child abductions or abuses.
17. ROLE OF THE INSTITUTIONS
MOBOCRACY
CONSTITUTION AND ITS
EXECUTION
EDUCATIONAL
INSTITUTIONS
SOCIETY (FAMILY,
RELIGION, COMMUNITY)
CIVIL SOCIETY
Setup of the fast track court
18.
19. Mobocracy sometimes
becomes more dangerous than
a dictatorship. That is why;
Mahatma Gandhi also said,
"They [who are in a mob]
have no mind, no
premeditation. They act in
frenzy."
20. Solutions
Implementation of SC order
Separate and stringent
law: separate and stringent laws
must be formulated to deal with
such cases. Preventive, remedial
and punitive measures are to be
ensured enacted to mitigate such
incidents.
Setup of fast track courts
21. Rule of law
Strong IT Act(IT Act2000,2008)
To develop sense of
constitutionalism (rule of law)
To fix the responsibility of
various kinds of media(ethical
values, legal )
Political parties should not
communal politics(role of
Election Commission)

22. Lets us develop positive
interactions with other
communities. Let’s start with
small steps, Let’s all take a
pledge to be less prejudiced. The
change will definitely happen
over time, Let us move out of our
comfort zone. Let us make our
country literally secular rather
than only on the constitution.
You can change How people Act
But Not how people think.
23. We must create an environment may
be in schools or through local
community wherein where all the
people interact together. We have
several festivals for different
religions, however now there is a
need for a new festival of oneness
wherein everyone can interact an
celebrate together.
There is No shortcut to this issue,
we took several decades to eradicate
Polio but we have succeeded in the
mission. Why can’t we break the
rule of Prejudice in our country?
24. “The highest education
is that which does not
merely give us
information but makes
our life in harmony
with all existence”
- Tagore
