2. Getting the refusal of your study permit at first instance of the
application may give frustrations and stress for a while to many,
taking into account the hopes and dreams of one person's goal is
likely to be taken away when we had received the letter from the
embassy’s decision on your study permit in which one may able to
find out the reasons as to why the case officer decline your
application. Quite often, the case officer will exercise its own
discretion in assessing the application regarding the financial
resources of the applicant in coming up with the decision based on
the information, documents, and your claims as to why you need to
study in Canada and if you are able to meet the criteria under the
IRPA’s regulations and the context of information regarding the
procedure, guidelines when assessing the applicant for study permit
application in Canada to obtain Canadian Education. In recent
report of the Canadian Bureau for the International Education
enrollment of international students are increasing, were last year
(2014) there were about 4.5 millions of international students in
Canada.
3. As we learned the points or reasons which is raised by the
case officer on his/her letter to you, try to read, analyze and
see if you are able to address one by one through facts and
as much as possible avoid making an assumption when
addressing (depending on the grounds of your refusal and
your current circumstances to be considered), before taking
into consideration of reapplication of your study permit –
because when you make a ‘fresh application’ from your
previous refusal, the case officer would always look into the
first instance of your application made, and if nothing has
changed or you failed to provide additional documents or
evidence which will strengthen your application the likelihood
that you would receive the same refusal again. We need also
to consider that when you resubmit your application, it will be
handled by a different case officer who might have a different
view and judgment in your application according to the new
information and evidence about your claim in applying for a
study permit in Canada.
4. Seek a second opinion from well experienced professionals
and experts if you have doubts whether it is worth trying to
resubmit an application again. We do not wanted to exactly
purport the reapplication of study permit to have it approved
by second time or third time of application, however with the
proper documentation (credible in level) of your own self
finances/sponsors , potential circumstances in Canada,
personal circumstances in your country of resident, your
previous travel history, your study plan (a course which
should not odd to your qualification and experience, future
plans) and to established that at the end of your study
course program you will leave Canada are amongst the case
officer will look into consideration in coming up with the
decision, alongside if the applicant meet the criteria in
granting the study permits R216 Division 3 of Issuance of
study permits - in case you deem consider reapplying again
for your study permit in Canada.
5. 1. Funds- When if this is one of the issues marked with your refusal letter,
either the funds come from yourself, parents, relatives or friends
(sponsors), ensure that you are able to establish the relationship to your
sponsor/s and enough documents from them are supplied as to support
your application on the basis of funding your education in Canada. The
Case/Visa Officer must satisfy that indeed, there’s a guarantee whereby
your sponsor would fulfill the financial obligatory as to support on your
application to study in Canada. It is patrial to submit an application, where
the applicant/sponsors cannot account the legit sources of funding to cover
the tuition fee cost, travel cost and living costs in Canada and that the
income of the sponsors/applicant is sustainable. Key notes to prepare for
the funding must at least over 15% from the figures’ required by the
Canadian Immigration, not exactly the amount to present on- at least by
doing this, an adjustment of the currency exchange would protect the
amount details by that time you lodge in your application if the fluctuation of
Canadian dollars occurs. Possible evidence of documents to present by the
sponsors/applicant could be:
6. Employment letter, or Business registration with Income tax or Business
Tax
Bank statements in the last 6 months prior to submission of the application
with a bank certificate from the bank- stating the remaining balance
available for disposal of your study permit application for the applicant
Time deposit if available
Letter/affidavit of support from the sponsors to ascertain the financial
responsibility and to establish the relationship with the sponsored applicant
and how your role would be, say for example if the sponsor will provide for
the tuition fee cost only or for the entire expenses occurring while the
applicant currently studying in Canada
Any tangible assets (if any) you hold which underway the capability of the
applicant or sponsor/s to get funding the propose study in Canada apart
from the available readily cash in the bank
Expect that they will be very skeptical when it comes to the financial
resources as they need to ensure that the applicant can maintain his/her
studies in Canada without the recourse of working part-time or be a burden
to the taxpayers in Canada.
7. 2.Travel history – If you see this marked on your refusal letter it
may possible that either the case/visa officer considers that you
may have these:
a.) You are unable to disclose your previous travel abroad,
assuming you submit a new passport as to regards to your
application and you withhold that information and later they found
out you have had travel abroad of course this could lead to the
refusal or
b.) You have not travelled at all, but this should not deter you to
apply to study in Canada and apply for study permit – but if you will
be honest and very clear that indeed in case your application will be
approved, you will lawfully follow the conditions as to put on your
study permit to travel and study in Canada
c.) You have traveled abroad and you have the record of
‘overstaying’ yet, you unable to provide the concrete facts as if why
it has happened to you
8. 3.Employment prospects – If this is one of the reasons, perhaps the
case/visa officer is not satisfied that your propose study course program in
Canada will not be beneficial to your career or future plans, they should be
convinced upon the submission of your ‘study plan’ and supporting
documents, on how it gives the value to increase your employment/income
prospects from your country of origin or elsewhere after completing on your
studies in Canada. Though, this part could have been more complex to
tackle on your application, but a very precise on your future plans and
convincing argument to claim on the concurrency of your surrounding
circumstances by that time you’ve submitted your application for such is
recommended, to increase and enhance your application.
4.Ties in your country of residence - This would need also to seek the
case officer in reassessing your application in case you resubmit another
application for the same category of study permit. Family, friend, social ties,
employment/economic ties, property (if applicable) and any other means as
to verify that the applicant/student is well established/connected to his/her
country of residence, or how strong the motivation for the applicant to
return to his original country of residence without doubt of abandoning it, as
they would again rely on the information, documents you have provided
with them.
9. 5.Potential circumstances in Canada - it is an axiomatic when applying for a
study permit wherein most of the family member or relatives of the applicant
are already in Canada this will give a presumption of the fact that the
applicant may stay longer as prescribed on his allowed duration of stay to
study, given that the applicant may eligible to apply for PGWP or other
pathways for PR when deemed qualified. Others may look into the
presumptive belief that when you disclosed information about your relatives
in Canada or family member, it may or may not have a negative/positive
impact on your application, but our personal stand is, the application will be
assessed according to the criteria of study permit and it will be assessed on
an individual basis.
However, if the refusal is due to the tenable grounds of inadmissible in
Canada A 34-37, 38 Division 4 Inadmissibility with complexity of your
previous and current circumstances, such as, having been the record of
adverse immigration history or a record of criminal history or medical
problems, get an advice from an experienced immigration lawyer of Canada
to assist with your reapplication. Or better yet, consider other options to
study in Ireland, Australia or New Zealand if the chances of reapplication for
study permit in Canada sought slim chances of reaching the approval at the
Canadian Embassy.
