Acceptable Studies <ul><li>Study must be full-time in a course registered for international students on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) </li></ul><ul><li>Evidence of enrolment </li></ul><ul><ul><li>Confirmation of Enrolment (fee paid) </li></ul></ul><ul><ul><li>Letter of offer </li></ul></ul><ul><li>Students can apply for visa to cover several courses (“packaging”) </li></ul>

Visa Application Fee <ul><li>The DIAC visa application fee is Rs.18,500/- </li></ul><ul><li>Students can either choose to lodge student visas applications via E-visa system ( with agents) or paper lodgment at VFS office in their city </li></ul><ul><li>Forms and other procedures can be downloaded from www.ausgovindia.com </li></ul><ul><li>Medicals TB Screening and X Ray certificate requirement has to be submitted </li></ul>

Visa Requirements <ul><li>Schedule 5A of Migration Regulations requires that all students have funds from an acceptable source that are sufficient to meet the following expenses : </li></ul><ul><li> (i)    course fees; </li></ul><ul><li> (ii)     living costs ; medical insurance </li></ul><ul><li>(iii)    travel costs </li></ul><ul><li>Period for which these funds must be shown: </li></ul><ul><ul><li>Subclass 571/574 - the entire period of study </li></ul></ul><ul><ul><li>Subclasses 570, 573, 575 - the first 36 months of study </li></ul></ul><ul><ul><li>Subclass 572 - the entire course or the first 36 months of study </li></ul></ul><ul><li>The Migration Regulations require applicants to have these funds in their possession from the past 6 months. </li></ul>

Financial Capacity <ul><li>If an applicant is accompanied by spouse and/or dependents : </li></ul><ul><li>Spouse - add AUD$4200 for each 12 month period. </li></ul><ul><li>1st child - add further AUD$2400 (living costs) + AUD$8000 (schooling) for any child turning 5years of age for each 12 month period. </li></ul><ul><li>Additional children – AUD$1800 (living costs)+ AUD$8000 (schooling) for each 12 month period </li></ul><ul><li>These costs apply even if spouse/children are not accompanying the student to Australia </li></ul><ul><li>Spouse/children must be declared in the application </li></ul>AUD$12,000 per 12 month period Living Costs

Financial Capacity Acceptable Individual <ul><li>The Schedule 5A definition of ‘Acceptable source of funds’ for Assessment Level 4 states that funds must be from an ‘acceptable individual’. </li></ul><ul><li>‘ Acceptable individuals’ are limited to one or more of the following: </li></ul><ul><ul><li>the applicant; </li></ul></ul><ul><ul><li>the applicant’s spouse; </li></ul></ul><ul><ul><li>the applicant’s parents; </li></ul></ul><ul><ul><li>the applicant’s grandparents; </li></ul></ul><ul><ul><li>the applicant’s brother s and sister s . </li></ul></ul><ul><ul><li>an uncle or an aunt who is an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen and is usually resident in Australia. </li></ul></ul>

Financial Capacity Acceptable Evidence of Funds <ul><li>Evidence of funds for the entire period of study; and </li></ul><ul><li>Must be fully sanctioned; granted ‘in-principle’ letters are not acceptable. </li></ul><ul><li>Details of guarantor, collateral security and owner thereof should appear on the loan letter. These must be acceptable individuals/declared financial supporters. </li></ul><ul><li>For a loan other than an education loan, letter from the bank to be provided stating the name of the applicant and that loan can be used for his/her education purpose. </li></ul><ul><li>If loan is secured against a recently created Financial Deposit (FD)- source of FD is required. </li></ul><ul><li>If a loan is not fully disbursed then we will assess the capacity of the financial supporter(s)( should be a acceptable individual) to repay the loan. </li></ul>

Financial Capacity <ul><li>Must be fully sanctioned; granted ‘in-principle’ letters are not acceptable. </li></ul><ul><li>Details of guarantor, collateral security and owner thereof should appear on the loan letter. Financial Capacity <ul><li>Joint accounts are acceptable if account holders are ‘acceptable individuals’. </li></ul><ul><li>Each account holder must agree in writing to the use of the funds by way of affidavits </li></ul><ul><li>Family tree should be provided, including details of account holders to be shown. </li></ul><ul><li>Evidence of relationship to the applicant should be provided (eg. passport, birth, marriage or education certificates). </li></ul>Acceptable Evidence Joint Accounts

Financial Capacity Acceptable Evidence Other Sources <ul><li>Provident Funds: </li></ul><ul><li>GPF acceptable IF annual statement is provided with letter from employer stating permissible withdrawal for education purposes. </li></ul><ul><li>GPF/CPF/ PF of only applicant’s parents is acceptable </li></ul><ul><li>Withdrawal limits for Public Provident Funds: </li></ul><ul><li>Loan up to 25% of balance at the end of the first financial year from 3 rd to 6 th year. </li></ul><ul><li>If held 6+ years, 50% of balance held at the end of the 4 th year preceding the year in which the amount is withdrawn. </li></ul><ul><li>If held 15+ years, current balance amount </li></ul><ul><li>Letter from bank stating amount that can be withdrawn. </li></ul>

Unacceptable Funds <ul><li>Kisan and Krishi Credit Cards – The visa office DO NOT accept. </li></ul><ul><li>These are issued for agricultural purposes, not international education. </li></ul><ul><li>Credit cards are not an acceptable source of funds. </li></ul><ul><li>LIC / Mutual Bonds / Tax Saving Bonds not acceptable </li></ul><ul><li>Loans or Deposits from NABARD / Agricultural Sector Banks not accepted </li></ul>

Processing - Visa Office <ul><li>Applications should be lodged at the AHC at least 12 weeks prior to course commencement date </li></ul><ul><li>The commencement of the course is the date orientation starts. Applications should not be lodged after course has commenced, with extension letters from the University. </li></ul><ul><li>We require 8-12 weeks to process an application </li></ul><ul><li>Make sure the application is complete - do not rely on the visa office to advise you of missing documentation - you risk Refusal. </li></ul><ul><li>Current processing times E-visas - Adelaide 7 weeks; New Delhi 8 weeks </li></ul>
  19. 19. FRAUD <ul><li>Applicants found to have used fraudulent means to obtain or apply for a visa will NOT be treated sympathetically </li></ul><ul><li>Under the code of conduct Agents have a responsibility to report fraud when it comes to attention. </li></ul>
