2. Definition of terms:
Juvenile Delinquency
Any offense that is considered a crime in the
legal codes of a community or and that is
committed by a juvenile under the age of
majority (usually under eighteen), and;
Any offense that is in the juvenile codes and is
committed by one under the age of majority
3. Juvenile Delinquent
Refers to a child in conflict with the law, who is
alleged as, accused of, or adjudged as having
committed an offense under the Philippine laws.
As a child, for purposes of this definition, refers
to a person under the age of eighteen (18)
years.
4. Child at risk
Refers to a child who is vulnerable to and at the
risk of committing criminal offenses because of
personal, family and social circumstances, such
as, but not limited to the following:
- being abused sexually, physically,
psychologically, mentally, economically or by any
other means.
- being exploited
- being abandoned or neglected
5. - Being out of school
- Being a member of a gang
- Living in a community with a high level of
criminality or drug abuse
- Living in situations of armed conflict
6. Best Interest of the Child
refers to the totality of the circumstances which
and conditions which are most congenial to
survival, protection, and feelings of security of a
child and most encouraging to the child’s physical,
psychological and emotional development.
Deprivation of Liberty
Refers to any form of detention, or imprisonment
or the placement of a child in conflict with the
law in a public, or private custodial setting
7. Recognizance
Refers to an undertaking in lieu of a bond
assumed by a parent or a guardian or custodian
who shall be responsible for the appearance in
court of the child in conflict with the law, when
required
Status Offenses
Refers to any conduct which discriminates only
against a child and not considered an offense or
not penalized when committed by an adult
8. Victimless Crimes
Refers to crimes where there is no private
offended party
Parens Patriae Doctrine
Refers to the inherent power and authority of the
state to provide protection of the person
