PROPERTY REGIMES
Absolute Community of Property Conjugal Partnership of Gains Property Regime of Unions Without
Marriage
Concept
The spouses are co-owners of all
covered properties.
The spouses are the co-owners of the
net profits.
The parties are co-owners of properties
subject to rules laid down under Arts. 147-
148 of the FC.
Coverage
All the property owned by the spouses:
1. At the time of the celebration of the
marriage; and
2. Those acquired thereafter
1. Those acquired during the marriage
with conjugal funds
2. Those obtained from labor, industry,
work or profession of either or both
spouse
3. Fruits of conjugal property due or
received during the marriage
4. Net fruits of separate property
5. Share in the hidden treasure
6. Those acquired through occupation
7. Livestock in excess of what was
brought to the marriage
8. Those acquired by chance
Properties acquired by the parties during
the period of co-habitation
ART. 147

Effort, work or
industry is JOINT;
hence, the shares
are EQUAL.
 Contribution
may consist of
care and
maintenance of
the family and
the household

Exclusions
1. Property acquired during the
marriage by gratuitous title and its
fruits except if its expressly provided
by the donor, testator or grantor
that they shall form part of the
community property
2. Property for personal and exclusive
use of either spouse (excluding
jewelry, which form part of the ACP)
3. Property acquired before the
marriage by one with legitimate
descendants by former marriage
and its fruits and income
1. Property brought into the marriage
as his/her own
2. Property acquired during the
marriage gratuitously
3. Property acquired by redemption,
barter or exchange with exclusive
property
4. Property purchased with exclusive
money of spouse
Property owned by
another validly existing
property regime (i.e.
ACP/CPG of legal
spouses)
Charges and Obligations
1. Support of spouses, their common
children and legitimate children of
either spouse
2. Debts and obligations contracted
during the marriage by designated
administrator-spouse, or both
spouses, or by one with the consent
of the other
3. Debts and obligations contracted
by either spouse without the
consent of the other to the extent
that it benefited the family
4. Taxes, liens, charges and expenses
upon community property
5. Taxes and expenses for mere
preservation made during the
marriage upon the separate
property of either spouse used by
the family
6. Expenses for professional or
vocational course
7. Ante nuptial debts which
redounded to the benefit of the
family
8. Donated or promised to common
legit children for profession,
vocational course or self
improvement
9. Other ante-nuptial debts1

Procedure for Dissolution
1. Inventory of all properties
2. Payment of debts and obligation of
ACP
3. Remainder of the separate
properties are returned to the owner
4. Net remainder of the ACP is divided
equally between husband and wife
1. Inventory of all property
2. Amounts advanced by CP as
payment for personal debts and
obligations of either spouse are
credited
3. Reimbursement for use of exclusive
funds
The liquidation and partition of the property
should be governed by the provisions on
co-ownership under the Civil Code, not
Articles 50, 51 and 52 in relation to Articles
102 and 129, of the Family Code. (Valdes
vs. RTC of Quezon City [GRN 122749 July
31, 1996])

Except for this item, if the community property is insufficient to cover all these liabilities, the spouses shall be solidarily liable for the unpaid
balance with their separate properties.

Ateneo de Davao University—College of Law Appendix “B” Persons and Family Relations (MANRESA 2008) FOR PROOF-READING PROPERTY REGIMES Absolute Community of Property Conjugal Partnership of Gains Property Regime of Unions Without Marriage Concept The spouses are co-owners of all covered properties. The spouses are the co-owners of the net profits. The parties are co-owners of properties subject to rules laid down under Arts. 147- 148 of the FC. Coverage All the property owned by the spouses: 1. At the time of the celebration of the marriage; and 2. Those acquired thereafter 1. Those acquired during the marriage with conjugal funds 2. Those obtained from labor, industry, work or profession of either or both spouse 3. Fruits of conjugal property due or received during the marriage 4. Net fruits of separate property 5. Share in the hidden treasure 6. Those acquired through occupation 7. Livestock in excess of what was brought to the marriage 8. Those acquired by chance Properties acquired by the parties during the period of co-habitation ART. 147  Rebuttable presumption: Effort, work or industry is JOINT; hence, the shares are EQUAL.  Contribution may consist of care and maintenance of the family and the household ART. 148  Rebuttable presumption: The contributions and corresponding shares are EQUAL.  Contribution must be ACTUAL. Exclusions 1. Property acquired during the marriage by gratuitous title and its fruits except if its expressly provided by the donor, testator or grantor that they shall form part of the community property 2. Property for personal and exclusive use of either spouse (excluding jewelry, which form part of the ACP) 3. Property acquired before the marriage by one with legitimate descendants by former marriage and its fruits and income 1. Property brought into the marriage as his/her own 2. Property acquired during the marriage gratuitously 3. Property acquired by redemption, barter or exchange with exclusive property 4. Property purchased with exclusive money of spouse Property owned by another validly existing property regime (i.e. ACP/CPG of legal spouses) Charges and Obligations 1. Support of spouses, their common children and legitimate children of either spouse 2. Debts and obligations contracted during the marriage by designated administrator-spouse, or both spouses, or by one with the consent of the other 3. Debts and obligations contracted by either spouse without the consent of the other to the extent that it benefited the family 4. Taxes, liens, charges and expenses upon community property 5. Taxes and expenses for mere preservation made during the marriage upon the separate property of either spouse used by the family 6. Expenses for professional or vocational course 7. Ante nuptial debts which redounded to the benefit of the family 8. Donated or promised to common legit children for profession, vocational course or self improvement 9. Other ante-nuptial debts1 , support of illegitimate child and liabilities for crime, quasi-delicts in absence of separate property 10. Expenses of litigation between spouses unless the suit is found to be groundless 1. Support of the spouses, their common children and legit children of either spouse 2. Debts and obligations contracted by one without the consent of the other to the extent that the family benefited 3. Debts and obligations contracted during the marriage by administrator- spouse, both spouses or one with the consent of the other 4. Taxes, liens, charges, expenses upon conjugal property 5. Taxes and expenses for mere preservation of separate property 6. Expenses for professional, vocational or self-improvement courses of either spouse 7. Ante nuptial debts to extent family benefited 8. Value of what is donated or promised to common legit children for professional, vocation or self improvement courses 9. Expenses of litigation Procedure for Dissolution 1. Inventory of all properties 2. Payment of debts and obligation of ACP 3. Remainder of the separate properties are returned to the owner 4. Net remainder of the ACP is divided equally between husband and wife 1. Inventory of all property 2. Amounts advanced by CP as payment for personal debts and obligations of either spouse are credited 3. Reimbursement for use of exclusive funds The liquidation and partition of the property should be governed by the provisions on co-ownership under the Civil Code, not Articles 50, 51 and 52 in relation to Articles 102 and 129, of the Family Code. (Valdes vs. RTC of Quezon City [GRN 122749 July 31, 1996]) 1 Except for this item, if the community property is insufficient to cover all these liabilities, the spouses shall be solidarily liable for the unpaid balance with their separate properties.
