1. MSME Registration Process
• The following are the documents required for the registration process
• Aadhar number of the applicant
• Name, gender, PAN number, email id and mobile number of the applicant.
• PAN, location, and address of the organization.
• A number of employees and the date, you are planning to start your business.
• Bank account number and IFSC code
• The basic business activity of the enterprise
• NIC 2 digit code
• Investment in plant and machinery/equipment
• MoA and AoA
• Copies of Sales Bill and Purchase Bill
2. Memorandum of Association (MOA)
• The Memorandum of Association or MOA of a company defines
the constitution and the scope of powers of the company. In simple
words, the MOA is the foundation on which the company is built.
• The MOA of a company contains the object for which the company is
formed. It identifies the scope of its operations and determines the
boundaries it cannot cross.
• It contains details about the powers and rights of the company.
• Under no circumstance can the company depart from the provisions
specified in the memorandum. If it does so, then it would be ultra
vires the company and void.
3. Articles of Association (AOA)
• Articles of association are a document that specifies the regulations for a
company's operations and defines the company's purpose. The document
lays out how tasks are to be accomplished within the organization,
including the process for appointing directors and the handling of financial
records.
• Articles of association can be thought of as a user's manual for a company,
defining its purpose and outlining the methodology for accomplishing
necessary day-to-day tasks.
• While the content and terms may vary according to jurisdiction, articles of
association generally include provisions on the company name, its purpose,
the share capital, the company's organization, and provisions concerning
shareholder meetings.
4. National Industrial Classification Code (“NIC
Code”)
• The National Industrial Classification Code (“NIC Code”) is a statistical
standard for developing and maintaining a comparable data base for
various economic activities. This code has been developed with an
intent to ascertain and analyse as to how each economic activity is
contributing towards national wealth.
5. Step by step registration process for MSME
• Start Registration Process
• Go to https://www.msmeregistration.org/ to start the MSME Registration
Process.
• Fill Application Form
• At the first step, you have to fill basic details in MSME Registration form that will
include all the necessary details of your business such as company name, registration
number, GST number and so on.
• Enter Personal Details
• At this stage, you are required to fill in all your personal details such as name,
address, PAN Card, bank account details and some common information that is
mandatory during the MSME registration process. Also, a photo needs to be
uploaded. Ensure that the size of the photo is within the permissible limits for it to
be uploaded on the sire.
6. • Executive Will Process Application
• At this process, an MSME executive will review your application. In case of any
discrepancy, you will be notified about the process and make the relevant changes.
• Receive Certificate of Mail
• After filling the complete form you will get the certificate for MSME Registration. To
know how it would be, you can download a copy of the Sample MSME Certificate.
The Ministry will not issue you any hardcopy for it. You will get a virtual certificate for
MSME Registration.
• This is the process for the MSME registration for companies. Note that the entire
registration process is free of cost. However, there are many online portals that do
the registration process on behalf of the companies at a certain fee.
• Registering a business under the MSME can have certain benefits such as better loan
structure, subsidise rates, government help and a lot more.
7. No-Objection Certificate from Pollution
Control Board
• Central Pollution Control Board (CPCB) that comes under The Ministry
of Environment, Forest and Climate in India works for checking the air,
water, and noise pollution by ensuring the quality is maintained. It
also issues guidelines for the purpose. Additionally, every state has its
own Pollution Control Boards.
• Any and every industry, operation or process which may result in the
discharge of sewerage into the environment and if is likely to emit any
substance into the environment that may cause any form of pollution
mandatorily has to obtain a consent from the State Pollution Consent
Board. This consent is as per the Water (Pollution & Control of
Pollution) Act, 1974 and Air (Pollution & Control of Pollution) Act,
1981.
8. • In a similar manner, the industries or processes which generates,
stores, dispose of, transports, or handles any hazardous waste as per
the Hazardous waste (Handing and Management) Rules must obtain
authorization from the State Pollution Control Board.
• According to Biomedical Waste (M & H) Rules, any medical
institutions generating biomedical waste should also obtain
appropriate Authorization.
• Such consents are collectively known as No-Objection Certificate
(NOC)
9. What are the types of consents or NOC?
• Mainly three types of consent are applied:
• Consent to Establish
• Consent to Operate
• Renewal of Consent to operate
10. What are the Permissions/ Clearances
required?
• Every industry/ operation/ process should obtain several Environment
and Pollution Related clearances and permissions according to the
nature of the unit and the products manufactured.
• A No Objection Certificate (NOC) must be obtained from the State Pollution
Control Board before the commencement of any activity. For some industries
which fall in the categories of highly polluting industries, an Environmental
Impact Assessment (EIA) study is carried out and submitted to the State
Pollution Control Board for approval.
• For the Industries that require a system of Water and Affecting Effluent
Disposal, a No Objection Certificate (NOC) from the State Pollution Control
Board should be obtained.
11. • For the industrial units that function outside the designated Industrial
Area, appropriate permissions have to be taken from the Municipal
Corporation, Municipality or the Panchayat. When required, a
permission to convert agricultural land into the industrial area has to
be taken from the appropriate authority.
• An appropriate registration and licensing of the Boiler by the Chief
Inspector of Boiler is required as a safety clearance before
commencing the operations.
• Special clearances of the Development Commissioner of the Export
Processing Zone (EPZ) is required for registering as a 100% Export
Oriented Unit (EOU) which enjoy several additional concessions.
