OBITUARY REFERENCE
HON. SPEAKER: Hon’ble Members, as we meet today, it is my sad duty to inform the House of
the demise of 39 Indian nationals in the city of Mosul.
We are all aware of the ongoing gruesome war in Iraq against the terror of IS. 39 of our countrymen
were abducted last year, whose dead bodies were recently exhumed. It deeply saddens our heart to
accept the harsh truth that we lost 39 of our able nationals to the war. They were shot over a year
ago, and were confirmed dead on 22nd March 2018. It is a moment of deep sorrow, and we pray
for their souls.
PRIME MINISTER: Madam, I rise to pay my tribute to the 39 Indian nationals who lost their
lives to the cruel war. The Centre has announced a compensation of Rs. 10 lakhs to the bereaved
families of the deceased. It is a pain which cannnot be expressed in words, my condolences are
with the grieving family members and the entire nation mourns with them, for the loss of our
brethren, and their families.
At the same time, we stand united against terrorism. There should be no distinction between good
and bad terrorism. Terrorism is a crime against humanity at large. India stands with each and every
nation who has suffered due to the inhumane acts of terrorism.
India strongly condemns terrorism in all forms and manifestations and stands in solidarity with the
government and the people of Iraq in their fight against terrorism.
LEADER OF OPPOSITION: Madam, I associate myself with the tributes paid by you and the
Leader of the House. 39 of our nationals lost their lives in the war-torn Iraq. We mourn the loss
and stand along with the people fighting against all forms of terrorism. I would like to associate
myself and the Opposition in sending our condolences to the bereaved family.

HON. SPEAKER: The next item in the list of businesses is introduction of new ministers. Prime
Minister to introduce new Ministers.
PRIME MINISTER: Madam Speaker, I have the pleasure in introducing to you and through you,
to the House, my colleagues, the new Ministers.

QUESTION HOUR
HON. SPEAKER: Members, let us move on to the next item in our list of business today, the
Question Hour. Question No. 101, Shri Manmeet Singh Monga.
MANMEET SINGH MONGA: Madam Speaker, Question No. 101, Will the Minister of Home
Affairs be pleased to state that, how is the Government planning to integrate Kashmir which has
become the bedrock of insurgency leading to cross-border terrorism, with the mainland?
HON. SPEAKER: Minister of Home Affairs, Mr. Pratap.
MINISTER OF HOME AFFAIRS: Madam Speaker, the minister will now answer the question
raised by Shri Manmeet Singh on the floor of the House. Madam Speaker, Article 370 of the Indian
Constitution which grants special autonomous status to the state of Jammu and Kashmir is often
in controversy for the wrong reasons. Now, the general question that always arises surrounding
the autonomy granted to J & K is the query that will this particular Article not violate the secular
integrity of the Nation. In practical reality, that question is simply multi-faceted. More
appropriately, it is better to ask what is necessary.
The situation in J & K is delicate – with over 43,000 deaths. Laws such as the DAA and the AFSPA
are necessary pre-conditions. Ever since the last 20 years, the annual civilian and soldier deaths
have reduced substantially to the point where 2017 reported 331 deaths as compared to over 3,000
during the turn of this century.
Article 370 of the Constitution is the current bedrock of the federal relationship between Jammu
and Kashmir and the rest of India. To sum up, while the centre has avowed to one day effectively
abrogate this Article, it is imperative to understand that each situation merits a unique response.
This is simply one of them.

HON. SPEAKER: Any supplementary questions, Mr. Monga. (Mr. Monga answers in the
negative.) The floor is now open for supplementary questions. Next question, Question No. 102,
Ms. Saloni Agnihotri.
SALONI AGNIHOTRI: Madam Speaker, my question to the Home Minister, in light of recent
shameful episodes of Kathua, Unnao and Sasaram, there has been a rise in heinous crimes against

children. What all steps has the government taken and willing to take to protect the future of the
nation?
HON. SPEAKER: Minister of Home Affairs, Shri Pratap ji.
MINISTER OF HOME AFFAIRS: Madam Speaker, in the wake of the outrage over the
kidnapping, rape and murder of minor girls across the various parts of India, the Union Cabinet on
20th April, 2018 has approved the promulgation of the Criminal Law (Amendment) Ordinance,
2018 which will allow courts to award death penalty to those convicted of raping children below
12 years of age. Along with it, we have set a time-bound disposal of cases within 2 months and
disposal of appeals within 6 months. All these measures will have a detrimental effect on the
perpetrators.
(The government side thumps the table.)
HON. SPEAKER: Any supplementary questions, Ms. Agnihotri. (Ms. Agnihotri answers in the
negative.) The floor is now open for supplementary questions. Next question, Question No. 103,
Mr. Shantanu Sharma.
MR. SHANTANU SHARMA: Madam Speaker, through you I would like to ask the Minister of
Consumer Affairs, Food and Public Distribution System:
A) What measures are being taken by the government to provide thrust to the grave matter
of food security?
B) Secondly, what is the status of implementation of the TPDS scheme and what measures
are being undertaken under the scheme to deal efficaciously with the problem at hand?
HON. SPEAKER: Minister of Consumer Affairs, Food and Public Distribution System, Shri
Pandey Ji.
MINISTER OF CONSUMER AFFAIRS, FOOD AND PUBLIC DISTRIBUTION
SYSTEM: Hon’ble Speaker, through you, the minister will now answer the first question posed
by Shri Shantanu on the floor of the House. During the Planning Commission Era, the allocation
of food grains to States and UT’s was done on the basis of consumption. In the course of previous
10 yrs, it was the average annual off-take of food grains that was taken into consideration at the
time of introduction of TPDS. The earlier allocation was 10 kg per month, which was doubled to

20 kg per family per month at 50 percent of the economic cost in April 2000. This was further
substantially increased to 25 kg in 2001. Currently, the allocation is done as per the National Food
Security Act, 2013 (NFSA), which provides for a pan India coverage of up to 75 percent of the
rural population and up to 50 percent of the urban population. Under this very Act, the beneficiaries
of the Public Distribution System are entitled to 5 kg per person per month of subsidized cereals
at the following prices:
 Rice at Rs. 3 per Kg.
 Wheat at Rs. 2 per Kg.
 Coarse Grains (Millet) at Rs. 1 per Kg.
Moreover, under the Antyodaya Anna Yojana, each household has been allotted 35 kg of
foodgrains per month at the same subsidized price.

Hon’ble Speaker, through you the minister will now answer the second question posed by Shri
Shantanu on the floor of the house. What a farcical scenario it is to see people who eat in cutleries
made of Gold manifest fake apprehension for the poor.

Nonetheless, to solve the grave problem of food security, the Department of Food and Civil
Supplies has implemented a scheme namely ‘End-to-end Computerization of TPDS Operations’.
Due to vigorous efforts and constant monitoring of the project through meetings, video
conferences and visits, with States and UTs the aforementioned problems have been eradicated to
a great extent. Nonetheless, there has been substantial progress in implementation of the project.
Not only the ration cards have been completely digitized, but also the transparency portal and
online grievance redressal facility have been implemented in all States/UTs. Further, the validity
of the scheme has also been extended by a year i.e. up to 31.03.2019, surprisingly without any
escalation in the project cost.

Ms. NYAMAT SEKHON: Madam Speaker, the country has witnessed a sudden surge in the
suicide rates of farmers due to indebtedness, what are the steps the government has taken to curb
this menace? Why does the government not pool out resources for the welfare of indebted farmers
by giving loan waivers?
In the words of President Eishenhower: “Farming looks mighty easy when your plough is a pencil
and you’re a thousand miles away from the corn field.”
HON. SPEAKER: Minister of Finance, Shri Chaitanya ji.
MINISTER OF FINANCE: Madam Speaker, I would thank the hon’ble member for bringing
such a critical issue to the floor of the House. The suicide of farmers is indeed a grave concern for
the country and the Government of India is taking sincere steps to ensure the wellbeing of farmers.
It is very necessary to understand that loan waiver will never help the farmer, instead of that, it
will ensure the perpetuation of the vicious poverty cycle. The incessant demand of opposition is
superficial and they are raising this just to further their own political agendas. There are several
reasons for the death of farmers like inclement of weather, family issues, impotency, etc. and these
reasons are backed by the report of NCRB, 2017. It cannot be abruptly put to halt; it is very
necessary to chalk out a well-researched policy to counteract this.
To help farmers, government has introduced social welfare schemes like crop insurance, interest-
free loans, so that we can ensure the development of farmers and we are striving to achieve the
goal of double fold increase in farmer’s income by 2022. We are also focusing on technology
intensive farming and we have collaborated with technologically advanced countries, in order to
tackle the problems of our food provider. Today on the floor of the House, I pledge to end the
woeful plight which are creating hell for our food provider.

SAMBHAV JAIN: Madam Speaker, NPAs, which were as low as 3.4% in 2012, during the
previous regime, have escalated to 10.8% in 2017. Now, I would like the Hon’ble Finance
Minister, how did the problem aggravate to such a great magnitude?

हुई और उन्होंने जो आांकड़े ्रतस्तुत वकये, उससे उनके सरकार के ज़माने में क्या क्या पाप हुए है और समस्या क्या है दोनों ही स््ट हो
जाएगा| यहााँ वजतनी भी लोन की बातें हो रही हैवो पुराने समय में वदएगये है औरउस समय उनको लगता होगा वक२००३–२००८ तक
ववश्वमावकिट में इकनोवमक बूम था | इसवलए बैंक अपना पैसा हर एक उद्योग एवां उद्योगपवतयों को लगातार दे रहा था | यहसोच कर वक
उद्योग फै लेगा, फू लेगा और देै का लाभ होगा तो ैायद अच्छी नीयत से वदया होगा | Madam Speaker, लेवकनदेै का लाभ तो
हुआ नहीं, उद्योगपवत ज़रूर फल-फू लगए| वबना वकसी वसक्यूररटी के लोन पर लोन बाांटे जाना...तबतो साहब नीयत पर भी ्रतश्न वचन्ह
लग जाता है|

MINISTER OF RAILWAYS: माननीय सभापवत महोदया, बवेजा जी द्वारा पूछे गए्रतश्न के उत्तर में सदन के सम्षण मैं कुछ
आांकड़े ्रतस्तुत करना चाहाँगा। विि 2001- 2004के बीच में कुल1090रेल दुघिटनाएाँ हुई ां : यावन ्रतवतविि औसतन 363दुघिटनाएाँ।2014
तक आते-आते यहआांकड़ा और भी बढ़ गया था। चुनावके बाद जब हमारी सरकार आई, तब हमने देखा वक रेलवे की सुर्षणा ्रतणाली
की तो धवजजयााँ उड़ी पड़ी हैं। सभापवत महोदया, हमारा सबसे पहला लक्ष्य यही था वक रेलवे की सुर्षणा ्रतणाली को सुधारा जाए क्योंवक
रेल में सफर कर रहेव्यवि की भी तो कोईराहदेख रहा है। हमने उसी वि SpeedyTrackRenewal हेतु, UnmannedCrossings
को हटाने हेतु रेल बजट में Safety fundकी रावै बढ़ाकर1लाख करोड़ कर दी जो वक Non-Lapsable हैएवां यह सुवनवित वकया
वक इस सब कायों का सांपादन एक वनस्चुत समय -सीमा में हो। सरकार के इन अथक ्रतयासों का पररणाम यह रहा वक विि2017तक
आते -आते कुल वमलाकर केवल347रेलदुघिटनाएाँ हुई यावनलगभग116दुघिटनाएाँ ्रतवत विि। तो इस आांकड़ों से यह तो स्पट हैवकरेल
दुघिटनाओांमें वृवद्ध नहीं हुई है।
इसके अलावा मैं सदन को यह भी सूवचत करना चाहाँगा वक विि 2017में हमने Advance Warning ्रतणाली, Train Collision
Avoidance ्रतणाली, TrainProtectionand Warning ्रतणाली, Ultrasonic BrokenRail Detection्रतणाली एवां ऐसी कई
अन्य ्रतणावलयााँ ववकवसत कर ली हैं। इन सब्रतणावलयों का अभी परी्षणणचल रहा है और परी्षणण समाप्त होते -ही इन्हें लागू कर वदया
जाएगा।गौरतलब है वक इस विि रेल बजट में हमने 4, 267Unmanned Crossings को हटाने पर ज़ोर वदया है। मैं आप सभी को
सुवनवित करना करना चाहाँगा वकयावत्रयों की सुर्षणा पर सरकार खास ध्यानदे रही है और इसके साथ -साथ रेलवे के सवािंगीणववकास
पर ज़ोर दे रही है। बस ्रताथिना आपसभी से यही है वकआप भारतीय रेलपर भरोसा रखें और इसके ववकास में अपनी योग्यता के अनुसार
योगदान दें।

MINSTER OF RAILWAYS: माननीय सभापवत महोदया, रेलवकराएमें बढ़ोतरी की आलोचना करने से पूवि यहजानना बहुत
आवश्यक है वक इसके पीछे कारण क्या है। लगभग वपछले 10सालों में रेल वकराए में वृवद्ध न के बराबर हुई थी। जब हमारी सरकार ने

वकराया वृवद्ध का वनणिय वलया, तबहमें पता था वकहमारी टाांग अवश्य खींची जाएगी। ैायद आप इस बात से वावकफ़ नहीं हों, पर विि
2017में भारतीय रेल को30 ,000 करोड़ का नुकसान सांभाववत था। वपछली सरकारों ने राजनैवतक कारणों से रेल वकराए में वृवद्ध नहीं
होने दी। तो जैसे -जैसे साल बीतते गएवैसे-वैसे Deficit का घड़ा भरता चला गया। मैं आपसभी को यह स्पट रूपसे बता दूाँ वक हमने ये
नयी वकराया ्रतणाली वसफि राजधानी ैताब्दी वदुरांतो ट्रेनों पर लागू की है। रेल में सफर करने वाली 95% जनता अनारव्षणत सामान्य वगि
में सफर करती है और सामान्य वगि के वकराए मैं हमने कोई बढ़ोतरी नहीं की है। सभापवत महोदया, मैं आपको बता दूाँ वकभारतीय रेलको
्रताप्त हुएहर 1रूपय में से66पैसा हमें freight में से ्रताप्त होता हैवकेवल 28पैसा हमें यात्री वकराएसे ्रताप्त होता है। बचे6पैसे हमारी
अन्य आय होती है। अब इसमें से हमारा96पैसा तो maintenance वलोनचुकाने में चला जाता है। तो हम औसतनवसफि 4पैसा ही
्रतवतविि ही रेलवे के आधुवनकरण व ढाांचागत ववकास में लगा पाते हैं। इसवलए यह हमारे वलए आवश्यक था वक हम वकराया में वृवद्ध
करें। आपको जानकर आियि होगा वक वजतने रूपय में आपका140आता है उतने रूपय में आप वदल्ली से चांडीग्राम का टूथपेस्ट गढ़
रेल के माध्यम से पहुाँच सकते हैं। लखनऊ से कानपुर तक का रेल का वकराया मात्रबीस रूपय है। अब इससे सस्ता और क्या हो सकता
है? सभापवत महोदया, रेल का वकराया बढ़ाना एक बहुत ही आवश्यक कदम था। मेरी आप सभी से ्रताथिना यही है वक आप सरकार के
इस कदम का स्वागत करें और व्यविगत लाभ के बजाय देै के लाभ के बारे में सोचे।

MINISTER OF COMMUNICATIONS: Speaker madam, I would like to answer through you
the qustion raised before the House regarding the teledensity especially in semi-rural and rural
areas.
The following steps are already taken by Government to increase the tele-density in the country:
1. Various schemes are being implemented with financial support from Universal Service
Obligation Fund (USOF) for providing access to telecom services to people in the rural and
remote areas at affordable and reasonable prices.

2. As on 31.01.2017, 5,80,124 villages i.e. 97.73% (thumping by the government) of the Census
2011 inhabited revenue villages have been covered with Village Public Telephones (VPTs).
3. A scheme was launched by USO Fund to provide subsidy support for setting up and managing
7353 number of infrastructure sites/ towers in 500 districts spread over 27 states.

करेंगे|” इसी के साथ मैं ववप्षण को कुछ ववद्या दान करना चाहता हाँ । In India, a person aged 7 years and above who
can both read and write with understanding in any language has been taken as literate. The Adult
Literacy rate (15+ Age Group) is the percentage of population 15-24 years’ old who can both read
and write with understanding a short simple statement in everyday life. The adult literacy rate has
shown an upward trend for females as well as males. It has increased from 61% to 69.3% during
the period 2001-2011. This indicator, being a statement about the stock of human capital, is slow
to change. As per NSSO, 73rd round findings, Adult Literacy Rate stands 70.5% for year 2017.

also narrowing down. With improvement in the number of schools, facilities in schools and
enrolment, the annual dropout Rate at primary level has come down by 1.28 percentage point (from
5.62% in 201 to 4.34% in 2013-14) for all category students. At this level, the Dropout rate for
boys and girls decreased by 1.36 (from 5.89% to 4.53%) and 1.2% (from 5.34% to 4.14%)
percentage point respectively during this period.

Over 14,000 teachers were holding a state-level rally against the State Government of Punjab at
Sidhuwal village on Patiala-Bhadson Road, in Patiala on Sunday with their list of demands. Mr.
Mohit Pratap Singh, M.P. while on his way to the Parliament via the same road stopped by to
understand the concerns raised by the protesting group. The police detained Mohit ji, who was
thereby restrained from attending the Parliament on 25th April, 2018.

दायरे में रहकर देै को चलाने का ्रतयत्न कर रही है । सबको जोड़कर... सबका ववकास करनें की पद्धवत पर काम कर रही है । हमारे जो

सभापवत महोदया, आज हमारे देै में, धमिं के नाम पर, जावत के नाम पर, सम्प््रतदाय के नाम पर, भोजन के नाम पर, लोगों को बाांटने का
काम वकया जा रहा है । और ये आज से नहीं चला आ रहा है... लम्प्बे अरसे से चला आ रहा है... जावतवाद का ज़हर , साम्प््रतदायवाद का
ज़हर... घुलता चला आ रहा है । और इसी बीच कुछ असामावजक तत्व धमि का चोगा ओढ़कर... ववचारधारा की आड़ में समाज में
अैाांवत फै लाने का काम कर रहे हैं। यह जो ध्रुवीकरण की राजनीवत की जा रही है... जो लोग... अपनी राजनीवतकरोवटयाां सेंकते हैं यह
ैमिनाक है भत्सिनीय है ।
देै को सांववधानके दायरे में रहकर के चलना होगा । वकसी को भी क़ानून हाथ में लेने का अवधकार नहीं है । वकसी के साथ भेद-भाव
करनें का कोई अवधकार नहीं है । क़ानून कठोरता से काम करता है और इन घटनाओांमें अवधक सख्ती बरतेगा । हमने वववभन्न राजय
सरकारों को ऐसी अवाांछनीय घटनाओांके उन्मूलन के वलए DOSSIER तैयार करने का वनदेै वदया है ।
वपछले कुछ वदनों से... इनमुद्दों को एक ववैेि रांग वदया जा रहा है... एकववैेि COMMUNITY को TARGET वकया जा रहा है।
यह जो रांगीकरणहै, यह जो SELECTIVE TARGETIVISMसरासरगलत है। देै की एकता, अखांडता और अ्षणुण्णता से कोई
समझौता नहीं वकया जा सकता । यह देै आतांकवाद के मुद्दे पर... अलगाववाद के मुद्दे पर... नक्सलवाद के मुद्दे पर सांगवठत हैऔर होना
चावहए ।
मैं ये कहना चाहता, पूछना चाहता हाँ, क्या हमारी ARMY का वो जवान, जो कड़ाके की ठण्डमें, भीिणगमी में, वदन-रात देै की र्षणा
में खड़ा है, जो लोग....
“ मन समवपित, तन समवपित, देह का कण-कण समवपित,
चाहता हाँ देै की धरती, तुझे कुछ और भी दूां ”...
के ववचार से ओत-्रतोत हैं … वे क्या वकसी धमिं के वलए खड़े हैं... वकसी सम्प््रतदाय के वलए खड़े हैं...? वे १२८ करोड़ देैवावसयों की
र्षणा के वलएखड़े हैं । इसी ्रतकार हम साांसदों का क्या धमि होना चावहए? … क्या वहन्दू होना चावहएक्या मुसलमानहोना चावहए, क्या
वसख होना चावहए या ईसाइ होना चावहए?
हम साांसदों का और हमारी सरकार का एक ही धमि है – इांवडया फस्टि

LEGISLATIVE BILL FOR CONSIDERATION
HON. SPEAKER: Now the House will take up consideration of the Criminal law (Amendment)
Bill, 2018. Minister of State, Ministry of Home Affairs, please.
MINISTER OF STATE, HOME AFFAIRS: Madam, I beg to move for the leave to introduce a
Bill to Repeal Section 499 & 500 of Indian Penal Code which relates with Criminal Defamation.
I beg to move: “That the Bill provide for the decriminalization of defamation both libel and
slander.”
Madam, the House is aware of the issue that the law on Criminal Defamation is often misused as
a tool of harassment. Criminal sanctions are the most severe sanctions that the society can impose
on a person. There must be proportionality between the effects of the measures responsible for
limiting the right or freedom & the objective which has been identified as of “sufficient
importance”.
In light of the recent judgments of the Hon’ble Supreme Court in Ramesh v. Union of India and
Pravasi Bhalai Sangathan v. Union of India, the provisions for the criminal defamation are too
broad. The Sections 499 & 500 IPC makes a person liable for publishing any statement that is
likely to be understood by some members of the public as a statement dismantling reputation.
The Government has brought this Bill before this august House with an intent to do away with its
prevalent misuse. Some of the important provisions of the Bill are as follows:
1. The Bill defines “defamation” comprehensively to include not only traditional methods
of defamation but also mentions Cyber defamation.
2. The Bill repeals sections 499 & 500 of IPC.
3. The Bill provides for non-reciprocal effect of repealing sections 499 & 500 of IPC.
Madam speaker, I am confident that the all Hon’ble Members of this House irrespective of party
affiliation will welcome the Bill wholeheartedly and through it help to make Indian law on
defamation in line with the international standards. With these words, I now move the Criminal
Law (Amendment) Bill, 2018.

PAWAN MUDOTIYA: Hon’ble Speaker, Madam, there is no need to repeal this Act as it has
been existing since the formation of Indian Penal Code and have not yet been challenged in court
of law.
MoS, MHA: Respected member, this government represents the will of the people. The need of
the hour, pertains not to criminalise defamation but to acknowledge that the freedom to speak
without fear is ensured. Even though the law makers did not de-criminalise defamation, they
created provision for amendment, recognising that the needs of an evergrowing society may also
change.
वि रहता नहीं कहीं रूककर, इसकी आदत भी आदमी सी है |
The present Amendment is in response to Supreme Court’s guidelines and the demands of the
society.
LEADER OF OPPOSITION: I would like to bring to the notice of Honorable Speaker Madam,
that the backlog of cases in the High Courts and Supreme Court regarding criminal defamation has
already piled up and bringing this amendment now would have adverse effect on the people who
have filed thses case and are seeking recourse from our legal system.
KUSHAGRA: Hon’ble Speaker, Madam, I rise to support this bill. The present law on criminal
defamation is not formulated with sufficient precision to enable the citizen to regulate his conduct.
In fact, the restrictions must impair the right as little as possible. Law must be subjected to effective
control. The sections 499 and 500 of IPC were enacted to put a check on the abuse of free speech,
for the restriction to pursuit legitimate aim, it must satisfy the conditions of national security and
public order. With these words, stating the law does not pursue legitimate aim I strongly support
the bill.
MoS, MHA: I hope I have answered most of the points, raised by the members in the course of
my speech. I once again thank you for your support and seek your cooperation in implementing
this measure. I request the House to pass the Bill.

PRIVATE MEMBERS RESOLUTION
HON. SPEAKER: Now the House will take up Private Members Resolution, Ms. Aarvi SIngh to
move the Resolution.
AARVI: Madam Speaker, I move the following Resolution.
This House recommends that the government should
1. Take steps to protect women from sexual abuse by their husbands; and
2. Also make institutional arrangement for rehabilitation of such victims.
आज हमारे देै में मवहलाओांकी हालत को बयाां करते हुए कुछ पांवियााँ अजि करती हाँ, “नारी, तेरी यही कहानी, आांचलमें छाव, आाँखों
में पानी|” कुछ ऐसी ही हालत है हमारे देै की नाररयों का|
Madam Speaker, कौन कहता है नारी का अवस्तत्व उसके पवत की ख्वावहैों में बसता है? Marriage, indeed, is a bond
of trust and affection, but if a husband imposes his sexual will and use her as a tool for sexual
gratification, it is no more a sacrament and, this is what is happening in a number of cases in India
at present.
According to a survey conducted by United Nations Population Fund in 2017, 75% of married
women are raped by their husbands at some point of time in their marital life. Even, Justice Verma
Committee Report suggested that the marital rape should be criminalised. Our society is changing
and sanctity of marriage is severed and ceases to exist if the relationship is based on violence.
I move the Resolution for the following reasons: Firstly, existing laws do not address this issue
directly. The definition of rape does not cover those acts that a husband commits with the body of
wife without her consent. It seems to be the case where consent once given cannot be revoked.
Let’s look at this issue through the prism of law. Article 21 of the Constitution as re-interpreted
by the constitutional bench which delivered the K S Puttaswamy judgment recently, entitles every
citizen of India – the right to privacy as a fundamental right, and privacy can be interpreted as
sexual privacy. So, when a husband forces his wife without her consent, it is violation of her sexual
privacy. Secondly, there should be coordinated action by various ministries of the government.
The issue should be combated by Ministry of Home Affairs, Ministry of Law and Justice, and
Ministry of Women and Child Development.

ANAMIKA: Madam Speaker, through you I would like to direct a question towards the respected
M.P. who just introduced the Bill on marital rape. Even though marital rape has been criminalized
in various countries, the Indian scenario needs to be uniquely addressed. Rape and use of force in
a sexual relationship is already difficult to prove even in a non-marital relationship. Hence, the
question arises: how do you prove use of force and distinguish it from a normal sexual activity?
HON. SPEAKER: Ms. Aarvi Singh.
AARVI SINGH: Hon’ble Speaker Madam, answer to the Hon’ble M.P.’s question is that, in case
of a rape unlike a consensual sexual intercourse., there are certain marks on the body of victim
such as physical injuries to vaginal and anal areas, lacerations and bruising. Additionally, signs of
anxiety, shock, depression and suicidal tendencies along with various gynecological effects
including miscarriage, stillbirths, bladder infection, STDs and infertility are evident. These signs
can well be observed in case of a victim of marital rape.
HON. SPEAKER: Ms. Rumella Jain.
RUMELLA: Madam Speaker, through you, I would like to raise a question to the Minister of
Home Affairs. In light of recent developments and repeated opposition from various fora, why is
there delay in the criminalization of marital rape? The defense always taken is of securing the so-
called structure of the family system. However, how come a woman’s dignity in the modern era
be sacrificed for the sanctity of customary practices and family system?
HON. SPEAKER: Hon’ble Minister of State, Home Affairs.
MoS,MHA: Madam Speaker, I congratulate the mover of the Resolution, Ms. Aarvi Singh as well
as the other members who have spoken for focusing on a matter of public importance.
Madam Speaker, I would like to address the query raised by the Opposition on the Ministry's stance
on marital rape. The Centre maintains its stand that the criminalisation of marital rape will lead to
the destabilisation of the family structure. This stand is supported by the following points:
Firstly, there is no set definition of marital rape. A sexual act which constitutes marital rape for
one woman, may not constitute the same for another.
Secondly, this stand has been reiterated by the Law Commission on Review of Rape Laws. The
Commission has examined the issue and has not recommended the criminalisation of marital rape.

Lastly, the government is considering various legal measures to uplift their status and to prevent
further damage to the dignity of women.
The government has taken measures like launching safety apps, establishing Crisis Management
Centres and introducing schemes to spread awareness about women’s equality and safety. In light
of the issues raised by the Hon’ble M.P., I reiterate the commitment of the government to ensure
the safety and protect the dignity of women. I, thus, request the M.P. to withdraw the resolution.

AARVI: Madam Speaker, I am grateful to the honorable members for lending support to my
resolution. In view of the assurance given by the honorable Minister of State, Home Affairs and
since government is already taking matter and to support all my fellow sisters caught in this
cobweb, I would like to say:

I hope that the government will enact a proper law to strengthen the existing legal system to make

We are all aware of the ongoing gruesome war in Iraq against the terror of IS. 39 of our countrymen were abducted last year, whose dead bodies were recently exhumed. It deeply saddens our heart to accept the harsh truth that we lost 39 of our able nationals to the war. They were shot over a year ago, and were confirmed dead on 22nd March 2018. It is a moment of deep sorrow, and we pray for their souls. PRIME MINISTER: Madam, I rise to pay my tribute to the 39 Indian nationals who lost their lives to the cruel war. The Centre has announced a compensation of Rs. 10 lakhs to the bereaved families of the deceased. It is a pain which cannnot be expressed in words, my condolences are with the grieving family members and the entire nation mourns with them, for the loss of our brethren, and their families. At the same time, we stand united against terrorism. There should be no distinction between good and bad terrorism. Terrorism is a crime against humanity at large. India stands with each and every nation who has suffered due to the inhumane acts of terrorism. India strongly condemns terrorism in all forms and manifestations and stands in solidarity with the government and the people of Iraq in their fight against terrorism. Madam Speaker, Article 370 of the Indian Constitution which grants special autonomous status to the state of Jammu and Kashmir is often in controversy for the wrong reasons. Now, the general question that always arises surrounding the autonomy granted to J & K is the query that will this particular Article not violate the secular integrity of the Nation. In practical reality, that question is simply multi-faceted. More appropriately, it is better to ask what is necessary. The situation in J & K is delicate – with over 43,000 deaths. Laws such as the DAA and the AFSPA are necessary pre-conditions. Ever since the last 20 years, the annual civilian and soldier deaths have reduced substantially to the point where 2017 reported 331 deaths as compared to over 3,000 during the turn of this century. Article 370 of the Constitution is the current bedrock of the federal relationship between Jammu and Kashmir and the rest of India. To sum up, while the centre has avowed to one day effectively abrogate this Article, it is imperative to understand that each situation merits a unique response. This is simply one of them. MINISTER OF HOME AFFAIRS: Madam Speaker, in the wake of the outrage over the kidnapping, rape and murder of minor girls across the various parts of India, the Union Cabinet on 20th April, 2018 has approved the promulgation of the Criminal Law (Amendment) Ordinance, 2018 which will allow courts to award death penalty to those convicted of raping children below 12 years of age. Along with it, we have set a time-bound disposal of cases within 2 months and disposal of appeals within 6 months. All these measures will have a detrimental effect on the perpetrators. SHANTANU SHARMA: Madam Speaker, through you I would like to ask the Minister of Consumer Affairs, Food and Public Distribution System: A) What measures are being taken by the government to provide thrust to the grave matter of food security? B) Secondly, what is the status of implementation of the TPDS scheme and what measures are being undertaken under the scheme to deal efficaciously with the problem at hand? HON. SPEAKER: Minister of Consumer Affairs, Food and Public Distribution System, Shri Pandey Ji. MINISTER OF CONSUMER AFFAIRS, FOOD AND PUBLIC DISTRIBUTION SYSTEM: Hon’ble Speaker, through you, the minister will now answer the first question posed by Shri Shantanu on the floor of the House. During the Planning Commission Era, the allocation of food grains to States and UT’s was done on the basis of consumption. In the course of previous 10 yrs, it was the average annual off-take of food grains that was taken into consideration at the time of introduction of TPDS. The earlier allocation was 10 kg per month, which was doubled to
  • 13. ~ Page 13 of 35 ~ 20 kg per family per month at 50 percent of the economic cost in April 2000. This was further substantially increased to 25 kg in 2001. Currently, the allocation is done as per the National Food Security Act, 2013 (NFSA), which provides for a pan India coverage of up to 75 percent of the rural population and up to 50 percent of the urban population. Under this very Act, the beneficiaries of the Public Distribution System are entitled to 5 kg per person per month of subsidized cereals at the following prices:  Rice at Rs. 3 per Kg.  Wheat at Rs. 2 per Kg.  Coarse Grains (Millet) at Rs. 1 per Kg. Moreover, under the Antyodaya Anna Yojana, each household has been allotted 35 kg of foodgrains per month at the same subsidized price. (Table thumping from government side.) Hon’ble Speaker, through you the minister will now answer the second question posed by Shri Shantanu on the floor of the house. What a farcical scenario it is to see people who eat in cutleries made of Gold manifest fake apprehension for the poor. (PUSHKIN: “toh aap kis thaali mein khaate hain”) Nonetheless, to solve the grave problem of food security, the Department of Food and Civil Supplies has implemented a scheme namely ‘End-to-end Computerization of TPDS Operations’. Due to vigorous efforts and constant monitoring of the project through meetings, video conferences and visits, with States and UTs the aforementioned problems have been eradicated to a great extent. Nonetheless, there has been substantial progress in implementation of the project. Not only the ration cards have been completely digitized, but also the transparency portal and online grievance redressal facility have been implemented in all States/UTs. Further, the validity of the scheme has also been extended by a year i.e. up to 31.03.2019, surprisingly without any escalation in the project cost. (Table thumping from the government side.) HON. Why does the government not pool out resources for the welfare of indebted farmers by giving loan waivers? In the words of President Eishenhower: “Farming looks mighty easy when your plough is a pencil and you’re a thousand miles away from the corn field.” HON. SPEAKER: Minister of Finance, Shri Chaitanya ji. MINISTER OF FINANCE: Madam Speaker, I would thank the hon’ble member for bringing such a critical issue to the floor of the House. The suicide of farmers is indeed a grave concern for the country and the Government of India is taking sincere steps to ensure the wellbeing of farmers. It is very necessary to understand that loan waiver will never help the farmer, instead of that, it will ensure the perpetuation of the vicious poverty cycle. The incessant demand of opposition is superficial and they are raising this just to further their own political agendas. There are several reasons for the death of farmers like inclement of weather, family issues, impotency, etc. and these reasons are backed by the report of NCRB, 2017. It cannot be abruptly put to halt; it is very necessary to chalk out a well-researched policy to counteract this. To help farmers, government has introduced social welfare schemes like crop insurance, interest- free loans, so that we can ensure the development of farmers and we are striving to achieve the goal of double fold increase in farmer’s income by 2022. We are also focusing on technology intensive farming and we have collaborated with technologically advanced countries, in order to tackle the problems of our food provider. SPEAKER: Mukhraiya Ji, इनका जवाब दीवजये| MINISTER OF RAILWAYS: माननीय सभापवत महोदया, बवेजा जी द्वारा पूछे गए्रतश्न के उत्तर में सदन के सम्षण मैं कुछ आांकड़े ्रतस्तुत करना चाहाँगा। विि 2001- 2004के बीच में कुल1090रेल दुघिटनाएाँ हुई ां : यावन ्रतवतविि औसतन 363दुघिटनाएाँ।2014 तक आते-आते यहआांकड़ा और भी बढ़ गया था। चुनावके बाद जब हमारी सरकार आई, तब हमने देखा वक रेलवे की सुर्षणा ्रतणाली की तो धवजजयााँ उड़ी पड़ी हैं। सभापवत महोदया, हमारा सबसे पहला लक्ष्य यही था वक रेलवे की सुर्षणा ्रतणाली को सुधारा जाए क्योंवक रेल में सफर कर रहेव्यवि की भी तो कोईराहदेख रहा है। हमने उसी वि SpeedyTrackRenewal हेतु, UnmannedCrossings को हटाने हेतु रेल बजट में Safety fundकी रावै बढ़ाकर1लाख करोड़ कर दी जो वक Non-Lapsable हैएवां यह सुवनवित वकया वक इस सब कायों का सांपादन एक वनस्चुत समय -सीमा में हो। सरकार के इन अथक ्रतयासों का पररणाम यह रहा वक विि2017तक आते -आते कुल वमलाकर केवल347रेलदुघिटनाएाँ हुई यावनलगभग116दुघिटनाएाँ ्रतवत विि। तो इस आांकड़ों से यह तो स्पट हैवकरेल दुघिटनाओांमें वृवद्ध नहीं हुई है। इसके अलावा मैं सदन को यह भी सूवचत करना चाहाँगा वक विि 2017में हमने Advance Warning ्रतणाली, Train Collision Avoidance ्रतणाली, TrainProtectionand Warning ्रतणाली, Ultrasonic BrokenRail Detection्रतणाली एवां ऐसी कई अन्य ्रतणावलयााँ ववकवसत कर ली हैं। इन सब्रतणावलयों का अभी परी्षणणचल रहा है और परी्षणण समाप्त होते -ही इन्हें लागू कर वदया जाएगा।गौरतलब है वक इस विि रेल बजट में हमने 4, 267Unmanned Crossings को हटाने पर ज़ोर वदया है। मैं आप सभी को सुवनवित करना करना चाहाँगा वकयावत्रयों की सुर्षणा पर सरकार खास ध्यानदे रही है और इसके साथ -साथ रेलवे के सवािंगीणववकास पर ज़ोर दे रही है। बस ्रताथिना आपसभी से यही है वकआप भारतीय रेलपर भरोसा रखें और इसके ववकास में अपनी योग्यता के अनुसार योगदान दें। HON.SPEAKER: Anysupplementary questions, Mr. Baweja.(Mr.Bawejaanswersin the negative).   • 17. ~ Page 17 of 35 ~ वकराया वृवद्ध का वनणिय वलया, तबहमें पता था वकहमारी टाांग अवश्य खींची जाएगी। ैायद आप इस बात से वावकफ़ नहीं हों, पर विि 2017में भारतीय रेल को30 ,000 करोड़ का नुकसान सांभाववत था। वपछली सरकारों ने राजनैवतक कारणों से रेल वकराए में वृवद्ध नहीं होने दी। तो जैसे -जैसे साल बीतते गएवैसे-वैसे Deficit का घड़ा भरता चला गया। मैं आपसभी को यह स्पट रूपसे बता दूाँ वक हमने ये नयी वकराया ्रतणाली वसफि राजधानी ैताब्दी वदुरांतो ट्रेनों पर लागू की है। रेल में सफर करने वाली 95% जनता अनारव्षणत सामान्य वगि में सफर करती है और सामान्य वगि के वकराए मैं हमने कोई बढ़ोतरी नहीं की है। सभापवत महोदया, मैं आपको बता दूाँ वकभारतीय रेलको ्रताप्त हुएहर 1रूपय में से66पैसा हमें freight में से ्रताप्त होता हैवकेवल 28पैसा हमें यात्री वकराएसे ्रताप्त होता है। बचे6पैसे हमारी अन्य आय होती है। अब इसमें से हमारा96पैसा तो maintenance वलोनचुकाने में चला जाता है। तो हम औसतनवसफि 4पैसा ही ्रतवतविि ही रेलवे के आधुवनकरण व ढाांचागत ववकास में लगा पाते हैं। इसवलए यह हमारे वलए आवश्यक था वक हम वकराया में वृवद्ध करें। आपको जानकर आियि होगा वक वजतने रूपय में आपका140आता है उतने रूपय में आप वदल्ली से चांडीग्राम का टूथपेस्ट गढ़ रेल के माध्यम से पहुाँच सकते हैं। लखनऊ से कानपुर तक का रेल का वकराया मात्रबीस रूपय है। अब इससे सस्ता और क्या हो सकता है? सभापवत महोदया, रेल का वकराया बढ़ाना एक बहुत ही आवश्यक कदम था। मेरी आप सभी से ्रताथिना यही है वक आप सरकार के इस कदम का स्वागत करें और व्यविगत लाभ के बजाय देै के लाभ के बारे में सोचे। HON. MINISTER OF COMMUNICATIONS: Speaker madam, I would like to answer through you the qustion raised before the House regarding the teledensity especially in semi-rural and rural areas. The following steps are already taken by Government to increase the tele-density in the country: 1. Various schemes are being implemented with financial support from Universal Service Obligation Fund (USOF) for providing access to telecom services to people in the rural and remote areas at affordable and reasonable prices.

As on 31.01.2017, 5,80,124 villages i.e. 97.73% (thumping by the government) of the Census 2011 inhabited revenue villages have been covered with Village Public Telephones (VPTs). 3. A scheme was launched by USO Fund to provide subsidy support for setting up and managing 7353 number of infrastructure sites/ towers in 500 districts spread over 27 states. HON. The Adult Literacy rate (15+ Age Group) is the percentage of population 15-24 years’ old who can both read and write with understanding a short simple statement in everyday life. The adult literacy rate has shown an upward trend for females as well as males. It has increased from 61% to 69.3% during the period 2001-2011. This indicator, being a statement about the stock of human capital, is slow to change. As per NSSO, 73rd round findings, Adult Literacy Rate stands 70.5% for year 2017.

With improvement in the number of schools, facilities in schools and enrolment, the annual dropout Rate at primary level has come down by 1.28 percentage point (from 5.62% in 201 to 4.34% in 2013-14) for all category students. At this level, the Dropout rate for boys and girls decreased by 1.36 (from 5.89% to 4.53%) and 1.2% (from 5.34% to 4.14%) percentage point respectively during this period. HON. Mr. Mohit Pratap Singh, M.P. while on his way to the Parliament via the same road stopped by to understand the concerns raised by the protesting group.   • 30. ~ Page 30 of 35 ~ LEGISLATIVE BILL FOR CONSIDERATION HON. SPEAKER: Now the House will take up consideration of the Criminal law (Amendment) Bill, 2018. Minister of State, Ministry of Home Affairs, please. MINISTER OF STATE, HOME AFFAIRS: Madam, I beg to move for the leave to introduce a Bill to Repeal Section 499 & 500 of Indian Penal Code which relates with Criminal Defamation. I beg to move: “That the Bill provide for the decriminalization of defamation both libel and slander.” Madam, the House is aware of the issue that the law on Criminal Defamation is often misused as a tool of harassment. Criminal sanctions are the most severe sanctions that the society can impose on a person. There must be proportionality between the effects of the measures responsible for limiting the right or freedom & the objective which has been identified as of “sufficient importance”. In light of the recent judgments of the Hon’ble Supreme Court in Ramesh v. Union of India and Pravasi Bhalai Sangathan v. Union of India, the provisions for the criminal defamation are too broad. The Sections 499 & 500 IPC makes a person liable for publishing any statement that is likely to be understood by some members of the public as a statement dismantling reputation. The Government has brought this Bill before this august House with an intent to do away with its prevalent misuse. Some of the important provisions of the Bill are as follows: 1. The Bill defines “defamation” comprehensively to include not only traditional methods of defamation but also mentions Cyber defamation. 2. The Bill repeals sections 499 & 500 of IPC. 3. The Bill provides for non-reciprocal effect of repealing sections 499 & 500 of IPC. Madam speaker, I am confident that the all Hon’ble Members of this House irrespective of party affiliation will welcome the Bill wholeheartedly and through it help to make Indian law on defamation in line with the international standards. With these words, I now move the Criminal Law (Amendment) Bill, 2018.
  • 31. ~ Page 31 of 35 ~ PAWAN MUDOTIYA: Hon’ble Speaker, Madam, there is no need to repeal this Act as it has been existing since the formation of Indian Penal Code and have not yet been challenged in court of law. MoS, MHA: Respected member, this government represents the will of the people. The need of the hour, pertains not to criminalise defamation but to acknowledge that the freedom to speak without fear is ensured. Even though the law makers did not de-criminalise defamation, they created provision for amendment, recognising that the needs of an evergrowing society may also change. वि रहता नहीं कहीं रूककर, इसकी आदत भी आदमी सी है | The present Amendment is in response to Supreme Court’s guidelines and the demands of the society. LEADER OF OPPOSITION: I would like to bring to the notice of Honorable Speaker Madam, that the backlog of cases in the High Courts and Supreme Court regarding criminal defamation has already piled up and bringing this amendment now would have adverse effect on the people who have filed thses case and are seeking recourse from our legal system. KUSHAGRA: Hon’ble Speaker, Madam, I rise to support this bill. The present law on criminal defamation is not formulated with sufficient precision to enable the citizen to regulate his conduct. In fact, the restrictions must impair the right as little as possible. Law must be subjected to effective control. The sections 499 and 500 of IPC were enacted to put a check on the abuse of free speech, for the restriction to pursuit legitimate aim, it must satisfy the conditions of national security and public order. With these words, stating the law does not pursue legitimate aim I strongly support the bill. MoS, MHA: I hope I have answered most of the points, raised by the members in the course of my speech. I once again thank you for your support and seek your cooperation in implementing this measure. I request the House to pass the Bill. HON.   • 33. ~ Page 33 of 35 ~ PRIVATE MEMBERS RESOLUTION HON. SPEAKER: Now the House will take up Private Members Resolution, Ms. Aarvi SIngh to move the Resolution. AARVI: Madam Speaker, I move the following Resolution. This House recommends that the government should 1. Take steps to protect women from sexual abuse by their husbands; and 2. Also make institutional arrangement for rehabilitation of such victims. आज हमारे देै में मवहलाओांकी हालत को बयाां करते हुए कुछ पांवियााँ अजि करती हाँ, “नारी, तेरी यही कहानी, आांचलमें छाव, आाँखों में पानी|” कुछ ऐसी ही हालत है हमारे देै की नाररयों का| Madam Speaker, कौन कहता है नारी का अवस्तत्व उसके पवत की ख्वावहैों में बसता है? Marriage, indeed, is a bond of trust and affection, but if a husband imposes his sexual will and use her as a tool for sexual gratification, it is no more a sacrament and, this is what is happening in a number of cases in India at present. According to a survey conducted by United Nations Population Fund in 2017, 75% of married women are raped by their husbands at some point of time in their marital life. Even, Justice Verma Committee Report suggested that the marital rape should be criminalised. Our society is changing and sanctity of marriage is severed and ceases to exist if the relationship is based on violence. I move the Resolution for the following reasons: Firstly, existing laws do not address this issue directly. The definition of rape does not cover those acts that a husband commits with the body of wife without her consent. It seems to be the case where consent once given cannot be revoked. Let’s look at this issue through the prism of law. Article 21 of the Constitution as re-interpreted by the constitutional bench which delivered the K S Puttaswamy judgment recently, entitles every citizen of India – the right to privacy as a fundamental right, and privacy can be interpreted as sexual privacy. So, when a husband forces his wife without her consent, it is violation of her sexual privacy. Secondly, there should be coordinated action by various ministries of the government. The issue should be combated by Ministry of Home Affairs, Ministry of Law and Justice, and Ministry of Women and Child Development. HON. SPEAKER: Ms. Anamika.
  • 34. ~ Page 34 of 35 ~ ANAMIKA: Madam Speaker, through you I would like to direct a question towards the respected M.P. who just introduced the Bill on marital rape. Even though marital rape has been criminalized in various countries, the Indian scenario needs to be uniquely addressed. Rape and use of force in a sexual relationship is already difficult to prove even in a non-marital relationship. Hence, the question arises: how do you prove use of force and distinguish it from a normal sexual activity? HON. SPEAKER: Ms. Aarvi Singh. AARVI SINGH: Hon’ble Speaker Madam, answer to the Hon’ble M.P.’s question is that, in case of a rape unlike a consensual sexual intercourse., there are certain marks on the body of victim such as physical injuries to vaginal and anal areas, lacerations and bruising. Additionally, signs of anxiety, shock, depression and suicidal tendencies along with various gynecological effects including miscarriage, stillbirths, bladder infection, STDs and infertility are evident. These signs can well be observed in case of a victim of marital rape. HON. SPEAKER: Ms. Rumella Jain. RUMELLA: Madam Speaker, through you, I would like to raise a question to the Minister of Home Affairs. In light of recent developments and repeated opposition from various fora, why is there delay in the criminalization of marital rape? The defense always taken is of securing the so- called structure of the family system. However, how come a woman’s dignity in the modern era be sacrificed for the sanctity of customary practices and family system? HON. SPEAKER: Hon’ble Minister of State, Home Affairs. MoS,MHA: Madam Speaker, I congratulate the mover of the Resolution, Ms. Aarvi Singh as well as the other members who have spoken for focusing on a matter of public importance. Madam Speaker, I would like to address the query raised by the Opposition on the Ministry's stance on marital rape. The Centre maintains its stand that the criminalisation of marital rape will lead to the destabilisation of the family structure. This stand is supported by the following points: Firstly, there is no set definition of marital rape. A sexual act which constitutes marital rape for one woman, may not constitute the same for another. Secondly, this stand has been reiterated by the Law Commission on Review of Rape Laws. The Commission has examined the issue and has not recommended the criminalisation of marital rape.
  • 35. ~ Page 35 of 35 ~ Lastly, the government is considering various legal measures to uplift their status and to prevent further damage to the dignity of women. The government has taken measures like launching safety apps, establishing Crisis Management Centres and introducing schemes to spread awareness about women’s equality and safety. In light of the issues raised by the Hon’ble M.P., I reiterate the commitment of the government to ensure the safety and protect the dignity of women. I, thus, request the M.P. to withdraw the resolution. HON. SPEAKER: Ms. Aarvi Singh. AARVI: Madam Speaker, I am grateful to the honorable members for lending support to my resolution. In view of the assurance given by the honorable Minister of State, Home Affairs and since government is already taking matter and to support all my fellow sisters caught in this cobweb, I would like to say: मत रो मत रो ए रावधका सुन लो बात हमारी, जो कवठनाई से घबरा जाये वो नहीं वहन्द की नारी | I hope that the government will enact a proper law to strengthen the existing legal system to make it more gender centric.
