1. Definition of Literal Rule of Interpretation
The Literal or Grammatical interpretation
means that the words used in an
enactment are to be given their ordinary
and natural meaning and if such
meaning is clear and unambiguous,
emphasize should be given to the
provision of statute.
2. To be continued………
However, there are two important rules Grammatical
interpretation: Such as-
a)Omission not to be inferred: It is the general rule of
Literal Interpretation that nothing is to be added or taken
from a statute unless there are adequate grounds to
justify the inference that the legislature intended
something which it omitted to express.
b)Every word in a statute to be given a meaning.
3. Literal Rule of Interpretation applied in case of Karnaphuli Rayon and Chemical Ltd.
Vs. The Govt. of Bangladesh and others, 28 DLR (AD) (1976) 116
Karnaphuli Rayon and Chemical Ltd. Vs Bangladesh and others 28
DLR(AD) in this case, Bangladesh Supreme court has stated that "It
is true that under certain circumstances, the court has the power
to modify the language used in a statutory provision or its meaning
in order to bring it in conformity to the intention of the Law-maker,
but that happens when the literal interpretation of the words used
lead to some absurdity or result in some injustice, which in the
opinion of the court could not have been the intention of the said
law maker."
