SCOPE OF SERVICES
PROJECT BACKGROUND AND DESCRIPTION
The City of Winter Springs (CITY) owns three drinking water treatment plants (WTPs) which treat
groundwater and distribute to customers: WTP No. , WTP No. , and WTP No. . The CITY’s water system,
public water supply identification number (PWSID) , includes these three WTPs as well as a single,
interconnected, distribution system. WTP No. has an ion exchange (IX) system for disinfection byproduct
(DBP) precursor removal followed by tray aeration for sulfide removal and disinfection with sodium
hypochlorite. WTP No. and add sodium hypochlorite for disinfection followed by tray aeration for sulfide
removal. Since WTPs No. and currently dose disinfectant prior to aeration, the sodium hypochlorite likely
reacts with the hydrogen sulfide in the raw groundwater, inhibiting the efficiency of the aerators.
WTP No. previously dosed sodium hypochlorite before aeration, like the other two WTPs. Carollo
Engineers, Inc. (CONSULTANT) assisted the CITY with permitting to move the WTP No. chlorine injection
point to the base of the aerators, sampled for total sulfide at various points in the treatment process. Under
a subsequent project, the CONSULTANT designed a new pipeline between the ground storage tanks and
high service pumps with sufficient volume to meet four-log disinfection requirements. This new header was
permitted with a new chlorine injection point and four-log demonstration and became operational in .
This scope of services authorizes the CONSULTANT to assist with permitting efforts to move the chlorine
injection points at WTPs No. and and to evaluate sulfide removal at the WTPs by collecting field samples.
Additional support services and testing are also included. The findings and recommendations from the
sulfide evaluation will be summarized in a project memorandum for the CITY. Additionally, Carollo will
provide coordination for the caustic squeeze process at WTP No. and assist with flow data verification. The
following presents the specific tasks that will be performed as part of this Scope of Services. Certain
assumptions have been made in preparing this Scope of Services. To the extent possible, they are stated
herein, and are reflected in the attached Project Budget.
This Scope of Work is summarized by the following tasks:
 Task – Project Management and Meetings
 Task – Permitting Assistance
 Task – Total Sulfide Sampling and Removal Evaluation
 Task – Additional Water Quality Sampling
 Task – Ion Exchange Optimization
 Task – Flow Data Verification
 Task – As-Needed Distribution/Collection System Support

The CONSULTANT will coordinate quality assurance and quality control (QA/QC) for the project, facilitated
by a Quality Manager assigned to the project.
TASK – PROJECT MANAGEMENT AND MEETINGS
The CONSULTANT will perform project management tasks including the following:
. Manage project team, activities, and budget.
. Prepare for and attend one ( ) kick-off meeting and up to two ( ) progress meetings with CITY staff
(Meetings and ). The anticipated topics of these meetings will be:
o Meeting : Project kick-off.
o Meeting : Permit applications and -log documents for WTPs No. and .
o Meeting : Task total sulfide sampling and removal evaluation results review and
discussion.
Task Deliverables:
 Monthly invoices and progress reports, to be submitted electronically in .pdf format.
 Meeting agenda and minutes, to be submitted electronically in .pdf format.
TASK – PERMITTING ASSISTANCE
Injection Relocation Permitting
The CONSULTANT will prepare a major modification permit application for submittal to the Florida
Department of Environmental Protection (FDEP) for the addition of chlorine injection points at the base of
the tray aerators at WTPs No. and . This scope assumes FDEP will require only one permit application for
both chlorine injection point relocations.
FDEP will require the following documentation:
a. Application for a Specific Permit to Construct PWS Components with project description and
drawing(s).
b. Detailed cost estimate showing the project is under , .
c. Certification of Construction Completion and Request for Clearance to Place Permitted PWS
Components into Operation with attached record drawings and photos.
d. Revision to the chlorine injection point locations description in the facility O&M manual.
e. Permit application fee ( , ), paid by City.
The CONSULTANT will complete the required forms, drawings, and documentation. It is assumed the CITY
will complete the construction of the additional injection points and pay the permit application fees.
-Log Documentation Updates
In conjunction with the work to move the injection point, the CONSULTANT will prepare updated -log
documentation for WTPs No. and based on the requirements in Ch. - . and - . , F.A.C. A
revision package will be prepared and submitted to the FDEP, which includes the design level of virus
inactivation to be achieved, the design minimum contact time (CT), and other required information to
document log treatment at WTPs No. and . Permitting fees are not anticipated or included for the -log
revision.

TASK – TOTAL SULFIDE SAMPLING AND REMOVAL EVALUATION
The CONSULTANT will take field total sulfide measurements from the raw water wells of WTPs No. , , and
and at various points in the treatment process of WTP No. to understand existing conditions. A previous
sulfide evaluation of WTP No. , by the CONSULTANT, involved temporarily moving the chlorine injection
to the bottom of the aerators. Now that sodium hypochlorite is dosed after the aerator and ground storage
tanks (GSTs) at WTP No. , this task will identify the total sulfide reduction achieved before oxidation with
sodium hypochlorite. The CONSULTANT will coordinate with the CITY and WTP staff for sampling
assistance, oversight, and access. The results of this task will be discussed during Meeting , budgeted in
Task , and summarized in a project memorandum.
This task also includes an evaluation of tray aerator sunshield equipment, aerator disinfection alternatives,
and next steps for sulfide removal. The CONSULTANT will contact vendors, research tray aerator sunshields
and disinfection alternatives, and provide recommendations in a memorandum based on findings.
The key activities during this task will include:
) The CONSULTANT will collect and analyze samples from the following locations for total sulfide. A total
of up to forty-six ( ) samples will be analyzed for total sulfide. The CONSULTANT will coordinate with
CITY and/or WTP staff to sample when wells are operational, so water quality sampling is
representative. A preliminary list of sampling locations is listed below, but the CONSULTANT will work
with the CITY and WTP staff to finalize the number of samples and sampling locations prior to beginning
the work.
a) WTP No. :
i) Wells E, E, E, E, each tested in duplicate.
ii) Pre-GSTs, tested in duplicate (three separate trips).
iii) GST No. sampling point, tested in duplicate (three separate trips).
iv) GST No. sampling point, tested in duplicate (three separate trips).
b) WTP No. :
i) Wells W and W, each tested in duplicate.
ii) GST sampling point (base of the aerator prior to sodium hypochlorite addition), tested in
duplicate ( separate trips).
c) WTP No. :
i) Wells W and W, each tested in duplicate.
ii) GST sampling point (base of the aerator prior to sodium hypochlorite addition), tested in
duplicate ( separate trips).
Samples to be collected at the base of the aerators will require additional sampling assistance from the CITY.
The results of the assessment will be compiled in a summary project memorandum to document the
findings and recommendations for next steps by the CITY.

TASK – ADDITIONAL WATER QUALITY SAMPLING
The CONSULTANT will assist the CITY with collecting additional water quality samples from the raw water
wells and points of entry from the three water treatment plants. It is assumed that two rounds of sampling
will be conducted over a -month period. Carollo will coordinate with a certified laboratory to provide
sampling kits and will return the kits to the laboratory for analysis after sample collection. Carollo will
coordinate with City operations staff to gain access to the raw water and point of entry sample locations.
Following receipt of the water quality testing results, Carollo will compile the laboratory data and present
the results to the City for review.
Task Deliverables:
 Summary of laboratory water quality testing results.
TASK – ION EXCHANGE CAUSTIC SQUEEZE
The CONSULTANT will provide coordination support for the IX caustic squeeze at WTP No. . This task
includes field support, coordination with the CITY and WTP staff, and design of the caustic feed components
for the caustic squeeze process. A one-page process schematic will be submitted as part of this task. Please
note that full design plans and bidding/construction services are not included under this task (if those
services are required, Task will be utilized). Additionally, it is assumed that the City or WTP staff will
operate the IX system and perform the caustic squeeze process.
Task Deliverables:
 Process schematic to be submitted electronically in .pdf format.
TASK – FLOW DATA VERIFICATION
This task involves the analysis of historical potable flow data to identify trends and anomalies and
recommend water use reduction strategies with a goal of meeting long-term demands with existing
supplies.
Task . Data Analysis
The CONSULTANT will compile, analyze, and present a trend analysis of historical flow data. The CITY will
provide flow data, including, but not limited to: raw water well flows, WTP finished water flows, and
customer consumption flows, in excel format. The CONSULTANT will estimate per capita consumption and
identify anomalies or gaps based on the results of the data analysis. The CONSULTANT will present a
summary of findings to the CITY in electronic format.
Task . . Identifying High Water Users
The ability to formulate meaningful strategies for future water supplies pertaining to customer consumption
flows depends on the format of the data provided. CONSULTANT will attempt to geolocate potable water
consumers in an effort to focus outreach to those areas with the highest use. For the purposes of budgeting

this task, it is assumed that customer consumption data will be provided in excel format with full or partial
customer addresses, unique identifiers (IDs) such as account numbers, water meter or parcel IDs, and
potable water usage per month for calendar months.
Geocoding Customer Consumption Data
The geocoding process will use the most recent customer billing data and follow the proposed general
methodology to achieve the highest feasible match rate:
 The CONSULTANT will geocode billing records that contain full or partial address with a suitable
geocoding service (ArcGIS Rest, Geocodio, Google Earth Pro, etc.).
 The CONSULTANT will manually match any remaining billing records with more than , gallons
of monthly usage, using internet tools and online maps.
 This process will continue until a geocode success target between and % is achieved, to be
discussed and agreed upon with the CITY such that it is commensurate with the level of effort
included in the budget for this sub-task.
This subtask is intended to provide the CITY with information related to the specific user accounts with the
highest potable water consumption. The CONSULTANT will present a summary of findings to the CITY in
electronic format. This scope does not include services required to notify customers of high-water usage.
Task . Formulating Water Supply Needs Strategies
Based on observations made during Task . Data Analysis, the CONSULTANT will identify and recommend
general conservation measures and/or other water use reduction strategies. These initial recommendations
will be subject to the level of detail provided for by the approved budget. The CONSULTANT will provide a
recommendations summary to the CITY in electronic format.
Task . Meetings
If requested, the CONSULTANT will attend up to meetings with CITY staff, St. Johns River Water
Management District staff, or other agency staff to discuss results or long-term strategies.
Task Deliverables:
 Summary of findings (electronic format).
 Meeting summaries and notes.
TASK – AS-NEEDED DISTRIBUTION/COLLECTION SYSTEM SUPPORT
This task involves any as-needed effort relating to the utility’s distribution and collection system. Effort
under this task may include, but is not limited to, the following:
 Emergency system repair coordination and support (i.e., main breaks),
 Regulatory reporting, support, and coordination,
 Attendance of in-person regulatory meetings (with FDEP and SJRWMD),
 Hydraulic model updates,
 Public outreach support,
 Water meter replacements,
 Consumer Confidence Report analysis and support, and
 Any additional effort, as requested by the CITY.

WORK ASSIGNMENT ASSUMPTIONS
Because of the nature of this project, certain assumptions apply to this Scope of Services. To the extent
possible, these assumptions are stated within this document and are reflected in the budget. If the project
task requirements are different from the assumptions presented in this Scope of Services, or if the CITY
desires additional services, the resultant change in scope will serve as a basis for amending this project
assignment or initiating the development of a new project assignment as agreed to by both the CITY and the
CONSULTANT. The following assumptions and CITY responsibilities apply to this project:
 The CONSULTANT shall be entitled to rely upon the accuracy of the data and information
supplied by the CITY without independent review or evaluation.
 The CITY shall attend all workshops and review meetings to maintain the progress of the
project according to the schedule.
 The CITY will provide the CONSULTANT with access to the treatment facility site for data
gathering and data validation.
 The CITY will assist with data collection and field testing as necessary, including accompanying
the CONSULTANT staff on site visits.
 The CITY will provide all required information within the period established in the schedule
contained in this Scope of Services. The schedule is based on timely receipt of data from the
CITY. The CITY shall review Draft deliverables and provide comments to the CONSULTANT
within a two-week period.
 The CONSULTANT has no control over the cost of labor, materials, equipment or services
furnished by others, over the incoming wastewater quality and/or quantity, or over the way the
CITY’s plant(s) and/or associated processes are operated and/or maintained. Data projections
and estimates are based on the CONSULTANT’s opinion based on experience and judgment.
The CONSULTANT cannot and does not guarantee that actual costs and/or quantities realized
will not vary from the data projections and estimates prepared by the CONSULTANT and the
CONSULTANT will not be liable to and/or indemnify the CITY and/or any third party related to
any inconsistencies between the CONSULTANT’s data projections and estimates and actual
costs and/or quantities realized by the CITY and/or any third party in the future.
 The services to be performed by the CONSULTANT are intended solely for the benefit of the
CITY. No person or entity not a signatory to this Scope of Work shall be entitled to rely on the
CONSULTANT’s performance of its services hereunder, and no right to assert a claim against
the CONSULTANT by assignment of indemnity rights or otherwise shall accrue to a third party
as a result of this Scope of Work or the performance of the CONSULTANT’s services hereunder.

As outlined in the individual tasks of this Scope of Services, the CONSULTANT will provide the CITY with the
following deliverables:

PROJECT SCHEDULE
The scope of services outlined in this task authorization will be performed for up to -months from

The CITY’s water system, public water supply identification number (PWSID) , includes these three WTPs as well as a single, interconnected, distribution system. WTP No. has an ion exchange (IX) system for disinfection byproduct (DBP) precursor removal followed by tray aeration for sulfide removal and disinfection with sodium hypochlorite. WTP No. and add sodium hypochlorite for disinfection followed by tray aeration for sulfide removal. Since WTPs No. and currently dose disinfectant prior to aeration, the sodium hypochlorite likely reacts with the hydrogen sulfide in the raw groundwater, inhibiting the efficiency of the aerators. WTP No. previously dosed sodium hypochlorite before aeration, like the other two WTPs. Carollo Engineers, Inc. (CONSULTANT) assisted the CITY with permitting to move the WTP No. chlorine injection point to the base of the aerators, sampled for total sulfide at various points in the treatment process. Under a subsequent project, the CONSULTANT designed a new pipeline between the ground storage tanks and high service pumps with sufficient volume to meet four-log disinfection requirements. This new header was permitted with a new chlorine injection point and four-log demonstration and became operational in . This scope of services authorizes the CONSULTANT to assist with permitting efforts to move the chlorine injection points at WTPs No. and and to evaluate sulfide removal at the WTPs by collecting field samples. Additional support services and testing are also included. The findings and recommendations from the sulfide evaluation will be summarized in a project memorandum for the CITY. Additionally, Carollo will provide coordination for the caustic squeeze process at WTP No. and assist with flow data verification. The following presents the specific tasks that will be performed as part of this Scope of Services. Certain assumptions have been made in preparing this Scope of Services. To the extent possible, they are stated herein, and are reflected in the attached Project Budget. CITY of Winter Springs Potable Water System Technical Support Page The CONSULTANT will coordinate quality assurance and quality control (QA/QC) for the project, facilitated by a Quality Manager assigned to the project. TASK – PROJECT MANAGEMENT AND MEETINGS The CONSULTANT will perform project management tasks including the following: . Manage project team, activities, and budget. . Prepare for and attend one ( ) kick-off meeting and up to two ( ) progress meetings with CITY staff (Meetings and ). The anticipated topics of these meetings will be: o Meeting : Project kick-off. o Meeting : Permit applications and -log documents for WTPs No. and . o Meeting : Task total sulfide sampling and removal evaluation results review and discussion. Task Deliverables:  Monthly invoices and progress reports, to be submitted electronically in .pdf format.  Meeting agenda and minutes, to be submitted electronically in .pdf format. TASK – PERMITTING ASSISTANCE Injection Relocation Permitting The CONSULTANT will prepare a major modification permit application for submittal to the Florida Department of Environmental Protection (FDEP) for the addition of chlorine injection points at the base of the tray aerators at WTPs No. and . This scope assumes FDEP will require only one permit application for both chlorine injection point relocations. FDEP will require the following documentation: a. Application for a Specific Permit to Construct PWS Components with project description and drawing(s). b. Detailed cost estimate showing the project is under , . c. Certification of Construction Completion and Request for Clearance to Place Permitted PWS Components into Operation with attached record drawings and photos. d. Revision to the chlorine injection point locations description in the facility O&M manual. e. Permit application fee ( , ), paid by City. The CONSULTANT will complete the required forms, drawings, and documentation. It is assumed the CITY will complete the construction of the additional injection points and pay the permit application fees. -Log Documentation Updates In conjunction with the work to move the injection point, the CONSULTANT will prepare updated -log documentation for WTPs No. and based on the requirements in Ch. - . and - . , F.A.C. A revision package will be prepared and submitted to the FDEP, which includes the design level of virus inactivation to be achieved, the design minimum contact time (CT), and other required information to document log treatment at WTPs No. and . Permitting fees are not anticipated or included for the -log revision.

TASK – TOTAL SULFIDE SAMPLING AND REMOVAL EVALUATION The CONSULTANT will take field total sulfide measurements from the raw water wells of WTPs No. , , and and at various points in the treatment process of WTP No. to understand existing conditions. A previous sulfide evaluation of WTP No. , by the CONSULTANT, involved temporarily moving the chlorine injection to the bottom of the aerators. Now that sodium hypochlorite is dosed after the aerator and ground storage tanks (GSTs) at WTP No. , this task will identify the total sulfide reduction achieved before oxidation with sodium hypochlorite. The CONSULTANT will coordinate with the CITY and WTP staff for sampling assistance, oversight, and access. The results of this task will be discussed during Meeting , budgeted in Task , and summarized in a project memorandum. This task also includes an evaluation of tray aerator sunshield equipment, aerator disinfection alternatives, and next steps for sulfide removal. The CONSULTANT will contact vendors, research tray aerator sunshields and disinfection alternatives, and provide recommendations in a memorandum based on findings. The key activities during this task will include: ) The CONSULTANT will collect and analyze samples from the following locations for total sulfide. A total of up to forty-six ( ) samples will be analyzed for total sulfide. The CONSULTANT will coordinate with CITY and/or WTP staff to sample when wells are operational, so water quality sampling is representative. A preliminary list of sampling locations is listed below, but the CONSULTANT will work with the CITY and WTP staff to finalize the number of samples and sampling locations prior to beginning the work. a) WTP No. : i) Wells E, E, E, E, each tested in duplicate. ii) Pre-GSTs, tested in duplicate (three separate trips). iii) GST No. sampling point, tested in duplicate (three separate trips). iv) GST No. sampling point, tested in duplicate (three separate trips). b) WTP No. : i) Wells W and W, each tested in duplicate. ii) GST sampling point (base of the aerator prior to sodium hypochlorite addition), tested in duplicate ( separate trips). c) WTP No. : i) Wells W and W, each tested in duplicate. ii) GST sampling point (base of the aerator prior to sodium hypochlorite addition), tested in duplicate ( separate trips). Samples to be collected at the base of the aerators will require additional sampling assistance from the CITY. The results of the assessment will be compiled in a summary project memorandum to document the findings and recommendations for next steps by the CITY.

TASK – ADDITIONAL WATER QUALITY SAMPLING The CONSULTANT will assist the CITY with collecting additional water quality samples from the raw water wells and points of entry from the three water treatment plants. It is assumed that two rounds of sampling will be conducted over a -month period. Carollo will coordinate with a certified laboratory to provide sampling kits and will return the kits to the laboratory for analysis after sample collection. Carollo will coordinate with City operations staff to gain access to the raw water and point of entry sample locations. Following receipt of the water quality testing results, Carollo will compile the laboratory data and present the results to the City for review. Task Deliverables:  Summary of laboratory water quality testing results. TASK – ION EXCHANGE CAUSTIC SQUEEZE The CONSULTANT will provide coordination support for the IX caustic squeeze at WTP No. . This task includes field support, coordination with the CITY and WTP staff, and design of the caustic feed components for the caustic squeeze process. A one-page process schematic will be submitted as part of this task. Please note that full design plans and bidding/construction services are not included under this task (if those services are required, Task will be utilized). Additionally, it is assumed that the City or WTP staff will operate the IX system and perform the caustic squeeze process. Task Deliverables:  Process schematic to be submitted electronically in .pdf format. TASK – FLOW DATA VERIFICATION This task involves the analysis of historical potable flow data to identify trends and anomalies and recommend water use reduction strategies with a goal of meeting long-term demands with existing supplies. Task . Data Analysis The CONSULTANT will compile, analyze, and present a trend analysis of historical flow data. The CITY will provide flow data, including, but not limited to: raw water well flows, WTP finished water flows, and customer consumption flows, in excel format. The CONSULTANT will estimate per capita consumption and identify anomalies or gaps based on the results of the data analysis. The CONSULTANT will present a summary of findings to the CITY in electronic format. Task . . Identifying High Water Users The ability to formulate meaningful strategies for future water supplies pertaining to customer consumption flows depends on the format of the data provided. CONSULTANT will attempt to geolocate potable water consumers in an effort to focus outreach to those areas with the highest use. For the purposes of budgeting

CITY of Winter Springs Potable Water System Technical Support Page this task, it is assumed that customer consumption data will be provided in excel format with full or partial customer addresses, unique identifiers (IDs) such as account numbers, water meter or parcel IDs, and potable water usage per month for calendar months. Geocoding Customer Consumption Data The geocoding process will use the most recent customer billing data and follow the proposed general methodology to achieve the highest feasible match rate:  The CONSULTANT will geocode billing records that contain full or partial address with a suitable geocoding service (ArcGIS Rest, Geocodio, Google Earth Pro, etc.).  The CONSULTANT will manually match any remaining billing records with more than , gallons of monthly usage, using internet tools and online maps.  This process will continue until a geocode success target between and % is achieved, to be discussed and agreed upon with the CITY such that it is commensurate with the level of effort included in the budget for this sub-task. This subtask is intended to provide the CITY with information related to the specific user accounts with the highest potable water consumption. The CONSULTANT will present a summary of findings to the CITY in electronic format. This scope does not include services required to notify customers of high-water usage. Task . Formulating Water Supply Needs Strategies Based on observations made during Task . Data Analysis, the CONSULTANT will identify and recommend general conservation measures and/or other water use reduction strategies. These initial recommendations will be subject to the level of detail provided for by the approved budget. The CONSULTANT will provide a recommendations summary to the CITY in electronic format. Task . Meetings If requested, the CONSULTANT will attend up to meetings with CITY staff, St. Johns River Water Management District staff, or other agency staff to discuss results or long-term strategies. Task Deliverables:  Summary of findings (electronic format).  Meeting summaries and notes. TASK – AS-NEEDED DISTRIBUTION/COLLECTION SYSTEM SUPPORT This task involves any as-needed effort relating to the utility’s distribution and collection system. Effort under this task may include, but is not limited to, the following:  Emergency system repair coordination and support (i.e., main breaks),  Regulatory reporting, support, and coordination,  Attendance of in-person regulatory meetings (with FDEP and SJRWMD),  Hydraulic model updates,  Public outreach support,  Water meter replacements,  Consumer Confidence Report analysis and support, and  Any additional effort, as requested by the CITY.
  • 6. CITY of Winter Springs Potable Water System Technical Support Page WORK ASSIGNMENT ASSUMPTIONS Because of the nature of this project, certain assumptions apply to this Scope of Services. To the extent possible, these assumptions are stated within this document and are reflected in the budget. If the project task requirements are different from the assumptions presented in this Scope of Services, or if the CITY desires additional services, the resultant change in scope will serve as a basis for amending this project assignment or initiating the development of a new project assignment as agreed to by both the CITY and the CONSULTANT. The following assumptions and CITY responsibilities apply to this project:  The CONSULTANT shall be entitled to rely upon the accuracy of the data and information supplied by the CITY without independent review or evaluation.  The CITY shall attend all workshops and review meetings to maintain the progress of the project according to the schedule.  The CITY will provide the CONSULTANT with access to the treatment facility site for data gathering and data validation.  The CITY will assist with data collection and field testing as necessary, including accompanying the CONSULTANT staff on site visits.  The CITY will provide all required information within the period established in the schedule contained in this Scope of Services. The schedule is based on timely receipt of data from the CITY. The CITY shall review Draft deliverables and provide comments to the CONSULTANT within a two-week period.  The CONSULTANT has no control over the cost of labor, materials, equipment or services furnished by others, over the incoming wastewater quality and/or quantity, or over the way the CITY’s plant(s) and/or associated processes are operated and/or maintained. Data projections and estimates are based on the CONSULTANT’s opinion based on experience and judgment. The CONSULTANT cannot and does not guarantee that actual costs and/or quantities realized will not vary from the data projections and estimates prepared by the CONSULTANT and the CONSULTANT will not be liable to and/or indemnify the CITY and/or any third party related to any inconsistencies between the CONSULTANT’s data projections and estimates and actual costs and/or quantities realized by the CITY and/or any third party in the future.  The services to be performed by the CONSULTANT are intended solely for the benefit of the CITY. No person or entity not a signatory to this Scope of Work shall be entitled to rely on the CONSULTANT’s performance of its services hereunder, and no right to assert a claim against the CONSULTANT by assignment of indemnity rights or otherwise shall accrue to a third party as a result of this Scope of Work or the performance of the CONSULTANT’s services hereunder.
