INTRODUCTION
 To resolve the issues of unskilled laborers who work in intensive pitiful conditions, the
Government of India has introduced the “Building and Other Construction Workers
Act in 1996 the act is called “BOCW ACT”.
 It is an act regulate the employment and conditions of service of building and other
construction workers for their safety, health and welfare measures.
 It extends to whole of India, it come into force on 1st day of March,1996.
 It applies to every establishment which employs, or had employed on any day of
preceding 12 months, ten or more building workers in any building or other
construction work.
• In India more than 80 cr. Workers (skilled or unskilled) are
engaged in construction sector and work inhuman and miserable
conditions.
• To address the inhuman working conditions, ill-treatment, poor
health and facilities and necessary safety measures.
NEED
• The BOCW Act ensures that a safety environment is
provided to them.
• Providing quick help to workers in case of any accident,
providing pensions, issuing loans, etc.
• To regulate the conditions of service and provide welfare
measures and for pother matters associated there with.
OBJECTIVE

BOCW AND BUILDING WORKER
Building and Other Construction Work- It means the construction, alternation, repairs,
maintenance in relation to buildings, street, roads, railways, irrigation, drainage, flood
control works, water works, oil and gas installation, electric lines, etc. specified by
appropriate government by notification.
Building Worker- It means a person who is employed to do any skilled, semiskilled or
unskilled manual, supervisory, technical or clerical work for hire or reward, in connection
with any building or construction work but does not include any such person who is
employed mainly in a managerial or administrative capacity.
 Every building worker who is between the age of eighteen and sixty and who has been
engaged in any building or other construction work for not less than ninety days during
the last 12 months is eligible for registration of as beneficiary of the Building and
Other Construction Worker ‘s welfare fund.
 Application for registration is to be accompanied with prescribed documents and a fee
not more than fifty rupees.
REGISTRATIONS OF BUILDING
WORKER AS BENEFICIARY
 Every State Government shall constitute a board to be known as Building and Other
Construction Worker Welfare Board to exercise the powers under this Act.
 The Board shall consist a chairperson , nominated by the Central Government and number
of other members not exceeding fifteen , as may be appointed by State Government.
 The Board shall prepare its budget, annual report and maintain proper accounts and
other relevant records.

The employer shall provide in every place where building
or other construction work is in progress-
Sufficient supply of wholesome drinking
water
Accommodation
Crèches (50 women
workers)
Latrines and urinals
canteens
First – aid
facilities
1. The employer shall constitute a safety committee if there are 500 or more workers
, and also appoint a safety officer.
2. The employer shall give notice to authority, any accident occurs which causes death
or any bodily injury is prevented from working period of 48 hours.
3. The appropriate government has power to make rules and framing of model rules
for safety measures in course of their employment and appliances provided to
them for their safety , health and protection.

 Whoever contravenes the provision shall be punishable with imprisonment for a term

 In case of continuing contravention , an additional fine which may extend to 100 rupees
for every day during such contravention.
 There is also penalty for failure to give notice of commencement , penalty for
obstruction , penalty for other offences.
PENALTIES AND PROCEDURES
CONCLUSION
 It is commendable that Indian government has made social welfare arrangements for
the long- neglected construction workers and efforts are appreciable.
 The BOCW Act makes sure that workers are not being exploited and a healthy and safe
working environment is provided to them. Government of India has made it mandatory
for every State government to constitute their own Building and Other Construction
Workers Welfare Boards.
 This act includes advisory committee , welfare boards for building and other construction
workers, hours of work, safety and health measures , etc.

INTRODUCTION  To resolve the issues of unskilled laborers who work in intensive pitiful conditions, the Government of India has introduced the “Building and Other Construction Workers Act in 1996 the act is called “BOCW ACT”.  It is an act regulate the employment and conditions of service of building and other construction workers for their safety, health and welfare measures.  It extends to whole of India, it come into force on 1st day of March,1996.  It applies to every establishment which employs, or had employed on any day of preceding 12 months, ten or more building workers in any building or other construction work.
  • 4. • In India more than 80 cr. Workers (skilled or unskilled) are engaged in construction sector and work inhuman and miserable conditions. • To address the inhuman working conditions, ill-treatment, poor health and facilities and necessary safety measures. NEED • The BOCW Act ensures that a safety environment is provided to them. • Providing quick help to workers in case of any accident, providing pensions, issuing loans, etc. • To regulate the conditions of service and provide welfare measures and for pother matters associated there with. OBJECTIVE
  • 5. Pension Rs1500/month after completing 60 years BENEFITS OF BOCW ACT,1996 Disability pension Rs3000/month Payment of death benefit up to 4,00,000 Grant for the purchase of tools 10,000/month Education and Marriage assistance for their childrens, Loans ,Funeral assistance Medical assistance, Maternity benefits ,Accident cover
  • 6. BOCW AND BUILDING WORKER Building and Other Construction Work- It means the construction, alternation, repairs, maintenance in relation to buildings, street, roads, railways, irrigation, drainage, flood control works, water works, oil and gas installation, electric lines, etc. specified by appropriate government by notification. Building Worker- It means a person who is employed to do any skilled, semiskilled or unskilled manual, supervisory, technical or clerical work for hire or reward, in connection with any building or construction work but does not include any such person who is employed mainly in a managerial or administrative capacity.
  • 7.  Every building worker who is between the age of eighteen and sixty and who has been engaged in any building or other construction work for not less than ninety days during the last 12 months is eligible for registration of as beneficiary of the Building and Other Construction Worker ‘s welfare fund.  Application for registration is to be accompanied with prescribed documents and a fee not more than fifty rupees.   • 8.  Every State Government shall constitute a board to be known as Building and Other Construction Worker Welfare Board to exercise the powers under this Act.  The Board shall consist a chairperson , nominated by the Central Government and number of other members not exceeding fifteen , as may be appointed by State Government.  The Board shall prepare its budget, annual report and maintain proper accounts and other relevant records.   • 9. HOURS OF WORK The appropriate government may- Fix the number of hours and Provide a one day rest in a week Wages for overtime work Maintenance of registers and records No deaf or defective vision person shall required or allowed to work
  • 10. WELFARE AND OTHER CONDITIONS OF SERVICE The employer shall provide in every place where building or other construction work is in progress- Sufficient supply of wholesome drinking water Accommodation Crèches (50 women workers) Latrines and urinals canteens First – aid facilities
  • 11. 1. The employer shall constitute a safety committee if there are 500 or more workers , and also appoint a safety officer. 2. The employer shall give notice to authority, any accident occurs which causes death or any bodily injury is prevented from working period of 48 hours. 3. The appropriate government has power to make rules and framing of model rules for safety measures in course of their employment and appliances provided to them for their safety , health and protection. SAFETY AND HEALTH MEASURES
  • 12. 1. An Inspector may enter in premises and examine any record or register. 2. Seize or take copies of register, record of wages , etc. Inspecting staff INSPECTING STAFF AND SPECIAL PROVISIONS 1. An employer shall be responsible for providing constant and adequate supervision Special Provisions 2.He shall be responsible for payment of wages and compensation and he shall sent notice of commencement at least before 30 days
  • 13.  Whoever contravenes the provision shall be punishable with imprisonment for a term 1.Which may extend to 3 months OR 2.Which may extend to 2000 rupees or both  In case of continuing contravention , an additional fine which may extend to 100 rupees for every day during such contravention.  There is also penalty for failure to give notice of commencement , penalty for obstruction , penalty for other offences.   • 14. CONCLUSION  It is commendable that Indian government has made social welfare arrangements for the long- neglected construction workers and efforts are appreciable.  The BOCW Act makes sure that workers are not being exploited and a healthy and safe working environment is provided to them. Government of India has made it mandatory for every State government to constitute their own Building and Other Construction Workers Welfare Boards.  This act includes advisory committee , welfare boards for building and other construction workers, hours of work, safety and health measures , etc.
