assistance on the completion of my assignment.

3. Introduction

There could be Legal rules and moral rules. Legal rules are calle lows and non legal rules
are called moral rules/customs/ethics. Legal rules cannot be breached and it is punishable.
E.g Cheating, robbery, etc. Non legal rules are not punishable. E.g Drinking alcohol on
poya day, unmarried couple living together
4. Task 01
1.1 Introduction of Low on the Trademark
A trademark is a word, phrase, symbol and design that identifies and distinguishes the
source of goods of one party from those of others. Some example incude : Brand names ,
slogans, and logos.
Function of a Mark
1. A mark serves to distinguish goods or services of different enterprises.
2. A mark individualizes the goods or services of their owners enabiling them to
reach the consumer efficiently and promote their trade
3. A mark requires it’s owner to maintain the quality of goods or service and
therefore a mark players a vital role in the protection of consumer
rationalization of trade and commercialization of product
Exclusive Right to a trademark
- It may be acquired through registration. Thus low protect only registered
mark.
5. 1.2 Introduction of Slogan
Slogan is a powerful think to the company. It is a catchphrase or small group of words
that are combined in a special way to identify a product or company.
“Jay Jay “ marketing manager Mr. Priyantha has launched marketing campaing by
using slogans as follow,
Taste the supper feeling
Open the happiness
That two slogans are very similar to “FEETUP” slogans. FEETUP slogans are follow,
Taste the feelin
Open Happiness
After the launch new campaign can be come some issues for Mr. Priyantha
6. 1.2.1 Taste the Superior feeling
In this situation FEETUP cannot file a case against JAY JAY regarding this slogan
because “Taste” and “Feeling” words are more generic team used by the business in
beverage industry.
1.2.2Open the Happiness
In this situation FEETUP can file a case against JAY JAY. Because it is not a generic.
Open the happiness is very similar to open happiness. I think FEETUP open happiness
slogan what they mean for when consumers open a drink bottle it’s like they are opening
happiness. So, open happiness is originally invented by FEETUP.
Eg: Mister Softee versus Master Softee
Mister Softee ice cream truck is a larget ice cream truck franchise in the United States.
In this period started their own chain of ice cream truck and named it non other than
Master Softee. It is very similar to Mister softee. After judge ruled Master Softee owner
and he is revamping now as an attempt to stay in the market
7. 1.3 Colour Change
A combination or arrangement of colours can constitute a lawful mark. A single colour
cannot form a mark. The use of colour may make the distinguishing quality of a mark
strong.
In this situation FEETUP cannot file a case against JAY JAY because Coca cola red
color is a generic color. Many soft drink companies used Coca cola red for their drinks.
Such as,
- My cola
- Kik cola
- Pepsi
1.4 Brand Ambassador Danuka Randeniya’s case
Social media is the strongest mode that any company can use to promote it’s brand to
the consumer.
In this situation Jay Lay did not engaged in any activities which will damage the brand
image of FEETUP’s. JAY JAY promote their product by using picture of Dhanuka
Randeniya. So, FEEDUP cannot file against JAY JAY but they can file against Danuka
Randeniya.
8. Task 02
2.1 Introduction of contract low
A contract is a voluntary arrangement between two or more parties that is enforceable
by low as a binding legal agreement.
Most contact do not require any form of writing (No signatures/ No stamp) . But few
contact such as contact of property, contact for insurance and high purchase contact under
consumer credit act would require documentary evidence.
Essential elements in a contract
Every contract shall have following elements
- That shall be agreement between the party
- Party shall be have intention to create legal relation
- That shall be consideration in the contact
- Party shall have capacity the contact
- Contact has be valid
9. 2.2 For whom JJ offer the Car
In this situation JJ will offer brand new Nizzan Leaf car to anyone who collect 5000
stickers pasted on the bottles issued by JJ for their promotional purpose.
This promotional campaign is very useful to sell their products. It’s just only
competition campaign. So, If Supun collected 5000 sticker, JJ can offer the car to Supun
or It can stay out rejecting Supun’s onsideration as it is an invitation to treat.
2.3 About Priyantha’s Salary case
In this situation JJ Promised to pay Rs.200,000 salary for Priyantha at the interview. But
Priyantha gets RS. 150,000 commission for month 25% increase in sales which seemed
an impossible target.
In this case Priyantha will entitle to the contact salary of Rs. 75,000. Not only that,
Priyantha can discussed to get down the percentage of sales increase at least up to 10%-
12% to get his commission played.
10. Task 03
3.1Introduction of sales of good ordinance
Sale of good is a contact by which the seller transfer or agrees to transfer the property
in goods to the buyer for a money consideration called the price.
Goods contract following four elements are required.
1. There should be a seller and buyer
2. There should be a good
3. There should be a consideration (price)
4. Passing of property in goods at the time of contract or in a future date
3.2 Legal action for under the potential low
There is only 350ml actual contains in a bottle of JJ through it’s label says
350ml.Aruna find out the bottle actually contains only 350ml.
In this situation, Aruna can makes complain against JJ. Trader will get punishments
under the consumer protection low according 10 of the act . As tenders should legally
bound to company with the direction issued by the authority JJ will punish at the court or
JJ has to hold any get back all the stocks which contains only 350ml through it’s a loss to
the company.
Sri Lanka Government can get any legal action again trades and manufacture who are
engaged in unfair trade practices and to protect them from unfair trade under act no.9 of
2003.
3.3 Government rules regarding sugar content violation
In this situation this case falls under the section 12 of the Consumer Affairs Authority
Act no.9 of 2003.
JJ saying that JJ has to be use if the sugar level is below 29 per 100ml. So, he display
green label. But actual sugar level per 100ml contains 2.1g. JJ has violate government
rules and regulation regarding the sugar content violations.
In this case, JJ will punish at the court. So, He should refill the green label bottle 2g of
sugar 100ml or keep 2.1g of sugar per 100ml and it’s label to yellow.
