1. BEHAVIOUR OF ARMY PERS IN CI-OPS
ENVIRONMENT
INTRODUCTION
Numerous incidents of arrogant and high handed
behavior of Army pers have been occurring in CI-Ops
environment while interacting with the Civ population.
These incidents are especially so for CMP/GMP/unit
reps and sentries who is actually “personify” the whole
Army’s image for the Civ population.
2. REASON FOR ARROGANCE & HIGH -
HANDED BEHAVIOUR
• Lack of Edn.
• Psychological problem - sense of security.
• Sudden change in status and environment.
• Ethnic difference.
• Dispersion.
• Personal problem.
• Stress and strain.
• Lack of command and control.
• Personality of Cdrs.
• Basic frames and behavior pattern of different Gps.
• Trg & motivation of JCOs/ NCOs.
• Taking the path of least resistance.
• “ Leave me alone” syndrome.
• Media hype.
• “They” & “we” syndrome.
• “ I am ok, you are not ok ”.
3. PROVIDING AID TO CIVIL AUTHORITY
DO`s
Act in closest possible co-operation with civil
authorities through out.
Maintain communication links if possible, by telephone or
radio.
Get permission or requisition from the magistrate
when present.
Use a little force & inflict as little as injury to a
person & properly as may be consistent with the
attainment of the objective in view.
4. (e) IN CASE YOU DECIDE TO OPEN FIRE :-
Give warning in local language that that you are about
to open fire. Attract attention before firing by bukge
or other means. Distribute your men in fire units
with specified Commanders. Control the number of
rounds fired. Aim at the front of crowd actually
rioting or inciting to at conspicuous ring leader. Do
not fire into the thick of the crowd or at the back.
Aim low and shoot for effect. Cease Firing Immediately
Once The Objective has been attained. Take
immediately steps to secure the wounded and provide
first aid.
(f) maintain cordial relations with civil authorities &
paramilitary forces.
(g) Ensure high standards of discipline.
5. ACTION DURING OPERATION
• In case of necessity of opening fire and using any force
against the suspect or any person acting in contravention of law
and order, ascertain first that it is essential for maint of public
order. Open fire after due warning.
• Arrest only those who committed a cognizable offence,
who are about to commit a cognizable offence or against whom a
reasonable ground exists to prove that they have committed or
are about to commit cognizable offence.
• Ensure that troops under command do not harass
innocent people, destroyed public property or un necessarily
enter into the dwelling of people not connected with any un lawful
activity.
• Ensure that women are not searched or arrested with out
the presence of any female police. Women should be searched by
female police only.
6. DEALING WITH CIVIL COURTS
• Directions of the high court or supreme court should be
promptly attended to.
• Whenever summoned by the courts, the decorum of the
court must be maintain and properly respect paid.
• Answer questions of the court politely and with dignity.
• Maintain a detailed record of the entire Op correctly and
explicitly.
7. MEASURES TO BE ADOPTED
• Involve locals, that is the surpanch or village headman
in search and seize operations.
• Incorporate police women in search of women and
houses where there are women.
• Hold prompt inquiries in case of civil offences like rape,
theft or murder and award of punishments.
• Prevent death or injuries in custody.
• Avoid undue harassment while carrying out cordon
and search operations.
8. ACTION AFTER OPERATION
• After Arrest, Prepare A List Of The Persons So Arrest .
• Hand over the arrested persons to the nearest police
station with the least possible delay.
• While handing over some one to the police, a report
should be submitted, describing in detail the
circumstance occasioning the arrest.
• Every delay in handing over the suspects to the police
must be justified and should be reasonable, depending
upon the place the time of arrest and the terrain in which
such person (s) has been arrested. There should be the
least possible delay, extendable to 24 hours. Depending
upon a particular case.
9. After a raid, make out a list of all Arms, Amn or any other incriminating
Mtrls or documents taken into possession.
. All such Arms, Amn, stores etc, should be handed over to the
police Stn along with the seizure memo. Obtain receipt of persons,
Arms & Amn, stores, etc. So handed over to the police.
Make a record of the area, where the op is launched, incl the date, the
time and the person participate in such raid.
Make a record of the commander and other officers, jCOs, NCOs
forming part of such source.
Ensure medical relief to any person injured during the
encounters, his body should be handed over immediately to the police
along with the details leading to such death.
10. HUMAN RIGHTS AND INDIAN ARMY
To enable the Army to act effectively to maintain public order. There
are special legislations, many of which are area specific. these fall under the
categories of the Armd forces (Spl powers), acts, The disturbed areas act, the
national security act and the defense of India act and rules. These enactments
give commissioned, junior and non junior commissioned officers power to :-
(a) Arrest any one disturbing the peace. Such a person should be
handed over to the nearest police stn with the least possible
delay.
(b) Search with out warrant and seize offensive mtrls.
(c) Destroy arms and Amn dumps, fortified areas or shelters
which are likely to be made use of subversive activities.
(d) Prohibit the assemblies of five or more persons.
(e) Use force including the use of firearms.
Detailed instructions are issued by the army auth, in the forms of Do’s
and Don’t’s. The sample is given below :-
11. DONT’S
• Do not keep a person under custody for any period longer
than it is necessary for handing over to the nearest police stn.
• do not use any force after having arrested a person except
when he is trying to escape.
• Do not use third degree methods to extract information or
confession or about their involvement in un lawful activities.
• After the arrest of a person by a member of the Armd forces,
he shall not be interrogated by the member of the Armd
forces.
• Do not release the person directly on your own after
apprehending. If any person is to be released, which should
be through civil auth.
• Do not tamper with official records.
• The Armd forces shall not take back a person after he
is handed over to the police.
12. SPECIAL POWER ACT 1958
DO’S
ACTION BEFORE OPERATION
• Act only in the areas which are declared ‘disturbed area’
under section 3 of the act.
• Power to open fire, using force and arrest, is to be exercised
under this act only by an officer, JCO, warrant officer and
NCO.
• Before launching any raids or search, definite info about the
activity is to be obtained from the civil local auth.
• As far as possible, co-opt representative of local civil adm
during the raid.

15. DEALING WITH CIV POPULATION: KNOWLEDGE AND
LANGUAGE OF LOCAL POPULATIONS AND OWN
BEHAVIOUR
• Psychology of Civ in Ci-Ops environment.
• Cultural and demographical details.
• Prevalent important customs, traditions and
cultural sensitivity.
• Knowledge of certain important words and
phrases of local language.
• Demos on negative and positive methods of
handling Civ populations.
16. AIM
To materialize / analyse these arrogant and
high - handed incidents with the Civ population in
CI-Ops environment, It becomes necessary to
impart the trg for gathering knowledge to
enhance/improve the behavior of Army pers
deployed in CI-ops environments.
17. MEASURES TO CONTROL ARROGANCE & HIGH-
HANDEDNESS
• Educating pers about phychology of civ populations in CI-
Ops environment.
• SF should be made to learn the history of the area. also past
and present contributions of the locals to the national
cause.
• Creation of expert Gps to handle Civ within the regular
forces.
• constant and reliable comn between deploy persons and
their leaders.
• Incorporation civ leaders and civ auth with all activities of
security forces.
• Amalgamation of Tps Belding to insurgency affected areas
with all forces deployed there. With due consideration of security.
18. • Motivation, trg and constant guidance. Encouraging selfless
service.
• Prompt relief and recycling of Army pers deployed in CI-Ops
environment.
Prompt care of basic needs viz food, hygiene and shelter for
security forces.
• Development of national spirit and identification with affected
population in affected areas.
• Due attention to personal problems of committed tps.
• Collection of personnel.
• Briefing/ de briefing.
• Supervision and monitoring.
• Auth to deal with Civ.
• Incorporative Civ police.
