Air Transport Agreement between the
Government of Australia
and the Government of the United States of
America
done at Washington D.C. on 31 March 2008
(By-lateral)
8
1st Freedom of air 2nd Freedom of air Agreement
● The right to fly over a
foreign country without
landing
● The right to refuel or
carry out maintenance
in a foreign country
without embarking or
disembarking
passengers or cargo
● Under Article 2 of the
proposed Agreement,
each Party grants the
airlines of the other Party
the right to overfly its
territory and to make
stops in its territory for
non-traffic purposes (such
as refuelling), as well as
rights otherwise set out in
the proposed Agreement.
9
3rd Freedom of air 4th Freedom of air Agreement
● The right to fly from
one's own country to
another
● The right to fly
from another
country to one's
own
● Proposed ‘open-skies’ Agreement
provides Australian and US
carriers with the freedom to
operate unlimited services
between any point in Australia
and any point in the US. The
proposed Agreement also
improves the capability of
Australian airlines to operate
between Australia and the US via
any other point, as well as beyond
the US to any other point
10
5th Freedom
● The right to fly between two foreign countries on a flight originating or ending in one's own country
Example: Emirates flight in 2004 from Dubai to Brisbane, Australia and onward to Auckland, New Zealand,
Fifth freedom traffic rights are intended to enhance the economic viability of an airline's long haul routes
11
6th Freedom
Agreement
● Right to carry passengers or cargo from a second country to a third country by stopping in one's own
country
The Committee notes the new development in this Agreement, which removes such restrictions to provide
fifth freedom services (By-lateral agreement between Australia and USA)
For example, under the new Agreement, Australian carriers can now operate services originating in the
United States through points in New Zealand and Australia and beyond points in South-East Asia without
restriction
12
7th freedom
● The right to fly between two foreign countries while not offering flights to one's own country
As example: A USA airline operate between Australia (Sydney) and New zealand (Auckland)
