The Supreme Court has cracked the whip on Rohtak superintendent of police
and the medical director of a private hospital in Gurgaon after getting a first-
hand experience of the common perception that politicians take medical
asylum to evade court process or arrests.
The SC had on October 24, 2013 cancelled the bail of former Indian National
Lok Dal MLA from Meham, Balbir Singh aka Bali Pahalwan, who is an accused
in an indiscriminate firing incident at Kalanaur grain market that left one
person dead and eight injured on May 5 that year. The court had directed
him to surrender.
The victim's brother through advocate Rishi Malhotra filed a contempt
petition accusing the ex-MLA of hoodwinking the SC order by admitting
himself to various hospitals to evade surrender. A bench headed by Justice T
S Thakur on January 15 had sought an affidavit from Rohtak SP Shashank
Anand on this issue.

The SP , in his affidavit, told the court that Balbir was admitted to PGIMS, Rohtak,
but since April 11, 2014, was admitted to private hospital Dr Sachdev Pvt Ltd, DLF
PhaseII, MG Road, Gurgaon. The SP also said a policeman had made an on-the-spot
inquiry and found the ex-MLA admit ed to the private hospital.
A bench of Justices Tha kur and R Banumathi was surprised last week to find he
Haryana government producing a copy of Balbir's medical certificate of Apri 11,
2014, which indicated that his condition had sufficiently mproved and was fit to be
produced in court.
Attempting to find the ruth behind the continuous admission in hospital, the bench
said, “From the docu ments placed on record, we are prima facie of the view that
the hospital, aforementioned, is providing some kind of medical asylum to the ex-
MLA who has, despite the direction of the court, failed to surrender to custody .
The whole purpose of his continued admission appears to be to avoid arrest.“ It
directed the Rohtak SP, who had filed the affidavit, and the medical director of Dr
Sachdev Pvt Ltd, Gurgaon, to be present in court on July 8.
