1. Etymology:
Latin word tortum, to twist mean wrong or injury
Meaning:
Injury or wrong.
Legal sense of "breach of a duty, whereby someone acquires a right of action
for damages1
.
Definition:
A wrongful act other than a breach of contract for which relief may be obtained in the
form of damages or an injunction2.or
A wrongful act other than a breach of contract that injures another and for which the
law imposes civil liability: a violation of a duty (as to exercise due care) imposed by
law as distinguished from contract for which damages or declaratory relief (as an
injunction) may be obtained; also: a cause of action based on such an act3. Or
A civil wrong independent of a contract for which the remedy is liquidated damages.
Nature . Civil injury other than breach of contract.
Typology:
i. Intentional torts
An intentional tort is an act that is intentionally committed against another person with
the aim of causing harm.
ii. Negligence torts
Negligence occurs when a party fails to demonstrate the kind of care a prudent person
would take in the same situation and an injury results from the action or inaction
iii. Strict liability torts4
Strict liability is the type of tort where a defendant is legally responsible for injuries or
damages suffered by the plaintiff5.
Remedy:
The two principal remedies available to the victim of a tort are liquidated damages to
compensate for the harm he has suffered and, where appropriate, an injunction to
prevent future harm. Damages are the predominant remedy.
