Статья 12 "Просто передача информации" (mere conduit) 1. В тех случаях, когда информационные услуги состоят в передаче информации, предоставленной получателем услуг, через коммуникационную сеть, или в предоставлении доступа к коммуникационной сети, государства-члены ЕС должны гарантировать, что поставщики услуг не несут ответственности за переданную информацию при условии, что поставщик: a) не инициирует передачу; b) не выбирает получателя передачи; и c) не выбирает или исправляет информацию, содержащуюся в передаче. 2. Передача и предоставление доступа, упомянутые в параграфе 1, включают в себя автоматическое, промежуточное и кратковременное хранение передаваемой информации в течение того периода, который необходим для осуществления передачи в коммуникационной сети, при этом предусматривается, что информация не будет храниться в течение более длительного периода, чем необходим для передачи. 3. Данная статья не должна влиять на возможности судов или административных органов власти, в соответствии с законодательной системой государства-члена ЕС, требовать от поставщика услуг прекращения или предотвращения нарушений.

A French court has defined an access provider as “someone who offers an access to an online communication service”. However, the exact scope of this interpretation remains unclear: The Cour d’appel de Paris qualified a bank as an access Provider (before the ECD had been implemented into French law) which has not been contradicted by other French courts, yet. The case concerned the obligation of the bank to keep identification data and to communicate it to the authorities. The court argued that the bank gave access to other communication networks like the internet.
a host provider has been found to have actual knowledge of the illegal nature of material (here: incitement to hatred of sexual minorities) on a website without removing it, it may be found guilty as an accomplice of complicity in crime. In the “online guestbook” case the operator was found guilty of complicity in incitement to hatred of sexual minorities. The court found that by failing to remove and by commenting on the message he was aiding and abetting the crime of the user. Just recently the Swedish Supreme Court decided that an operator of a bulletin board under general criminal law did not have any obligation to delete a user’s illegal message. Since it had not been “obvious” that the message was illegal the operator had no obligation to do so under the Act on the Responsibility for Bulletin Boards.
Firstly, the Courts have considered people in charge of blogs and forums liable for the contents they host, following the Press law Then French jurisprudence distinguishes between the categories and the level of intervention. The TGI of Toulouse explained that blogs (of the second category) are not liable if they promptly remove the allegedly illicit contents (principle of Duty of care). The TGI of Lyon explained that blogs and forums (of the first category) must follow the same legal regime as the Host provider Recently, the TGI of Paris has considered that the Press law has to be applied to the blogs (of the third category)
