3. IntroductionIntroduction
Government, using its compulsory force,
provides protection and absolute
implementation of legal norms.
Therefore, legal acts set standards that
provide the involvement of legal liability of
individuals, whose behavior does not
conform to the mandatory regulations.
Legal liability is incurred in violation of the
terms of law and is manifested by
application of coercive measures to the
violator.

Legal liability is a special kind of matters, which is
applied by measures of state coercion to the infringer,
under sanction of legal norms expressed in the form
of deprivation of personal, organizational or estate
nature, established in the procedural order.
The purpose of legal
responsibility is manifestation of
its social necessity and
effectiveness.
5. Legal liability is divided into:
Perspective legal
responsibility - the
conscientious
compliance of their
duties towards
society, country,
team of people and
individual.
Retrospective legal responsibility -
specific relations between the state
and the infringer as a consequence
of state law enforcement, that are
characterized by the condemnation
of the wrongful act and the subject
of the offence, by compulsion to
endure deprivation and adverse
effects of personal, property,
organizational nature for the
offence.
6. Functions of legal responsibility are the main
directions of legal influence on both the offender and other
persons, in purpose of protecting the law and the education
of law subjects that have committed or may commit an
offence.

The foundations of legal liability are: presence of legal norms
providing the composition of offence; legal fact - the fulfillment of
the offence; the presence of the enforcement act, which entered
into force.
There are the following grounds of legal liability:
1) Formal (legal) basis - securing the appropriate structure of an
offence in terms of law.
2) Factual basis – the presence in the individual’s act the signs of an
offence under the law.
3) Procedural basis – the decision of court or other competent authority
of involvement of particular individual who committed the offence to
legal liability.

10. • The criminal liability – it is assumed for the crime, and only by the
court in the form of criminal punishment. (ККУ, КПКУ, КУ)
• The administrative liability – for administrative offences, and is
assigned by various administrative bodies (Executive Committee,
customs service, border service) in the form of arrest, a fine, deprivation
of special rights and other. (КупАП)
• The disciplinary liability – it is for disciplinary offences within the
service activity, imposed by the chief, subordinate to which the offender
is. (ст.147-152 КЗпП України)
• The civil liability – it is imposed for civil non-contractual violations that
cause material damage or moral damage to the victim, as well as for the
breach of contractual obligations (penalties, fines, damages). (ЦК
України)
• The material liability – it is incurred for material damage caused to
the company or institution in executing their duties; it is limited. (ст.130
КЗпП)
11. Law provides not only various penalties and the procedure for its
assignment, but the conditions of the exclusion, limitation and
exemption from liability.
Liability exclusion suggests that
it does not occur in special
conditions, from the time of
committing the act.

12. CONCLUSIONCONCLUSION
Summing up, it should be noted that in the case of breaking the law, the subject enters into the
scope of the law jurisdiction and chooses between different actions (legal and illegal). The
choice of legal option provides the following benefits: other entities are required to contribute to
its actions or not to intervene in them; in the case of any breach of their duties, government, in
the legal form of coercion, provides restoration of violated rights and fulfillment by duty subjects
the corresponding duties.. Therefore, lawful behavior as a legal fact entails not just the
appearance of relations, but certain funds of legal regulation aimed at ensuring, protecting and
preserving of the legal form of the realization of the interests of the subject and society. This
action of state and law is only one among all tools in their response to lawful behavior. Other
includes direct encouragement of lawful actions by the state. This applies using both subjective
rights and duties.
The implementation of offences causes legal responsibility in form of measures of state
coercion, punitively orientated, incurring losses of personal, organizational or material nature.
As a result of violations the protective relations occur, in which the state has the right to take
punitive and remedial measures for offenders. The latter must bear some losses and
compensate the victim his incurred losses.
The social purpose of legal responsibility – the protection of public relations – is implemented in
its law enforcement and educational functions. The law enforcement function of legal
responsibility, in its turn, is divided into law-restorable and punitive, the educational function –
into special and general prevention functions.
The processes of implementation of legal liability are strictly regulated by the law and
implemented on the principles of lawfulness, reasonableness, appropriateness, inevitability,
justice.
