2. An enabling act which :
 Aims to improve the material health scenario

3.  Continuation of pregnancy constitutes risk to the life or
grave injury to the physical or mental health of woman
 Substantial risk of physical or mental abnormalities in
the foetus as to render it seriously handicapped
 Pregnancy caused by rape ( presumed grave injury to
mental health )
 Contraceptive failure in married couple ( presumed
grave injury to mental health )
 “In determining whether the continuance of pregnancy
would involve such risk of injury to the health , account
may be taken of the pregnant woman’s actual
reasonable foreseeable environment “

4.  Termination done for conditions and within the
gestation prescribed by the Act with the consent of
women
 Termination done by a medical practitioner
approved by the Act
 Termination done at a place approved under the
Act
 Other requirements of the rules & regulations with
the act are compiled

5.  Up to 20 weeks of gestation , with the consent of
the woman, if the woman is below 18 yrs or is
mentally ill , then consent of a guardian.
 The opinion of a RMP has been formed in good
faith, under certain circumstances
 Opinion of two RMPs required for termination of
pregnancy between 12 and 20 weeks

6.  Experience in the practice of Gynaecology and
obstetrics for a period of not less than three years.
 Completed six months of house surgery in
Gynaecology and obstetrics
or
 Assisted a RMP in the performance of twenty five
cases of Medical termination of pregnancy in a
hospital established or maintained or a training
institute approved for this purpose by the
government.

7.  A MP registered in a state medical register
immediately before the commencement of the Act,
should have not less than 3 yrs experience in the
practice of gynecology and obstetrics.
 In case of RMP who holds a PG degree or diploma
in gynecology and obstetrics ,the experience or
training gained during the course of such degree
diploma is considered .

8.  GUARDIAN – a person having a care of a minor or a
lunatic
 Minor – a person who , under the provisions of the
Indian Majority Act 1875, is to be deemed not to
have attained his majority
 RMP – A M.P. who possesses any recognized
medical qualification as defined in Clause (h) of
Section 2 of the IMC Act 1956 , whose name has
been entered in a state medical register and who
has such experience or training in gynecology and
obstetrics as may be prescribed by rules made
under this Act.

9.  Only if
 The government is satisfied that the termination of
pregnancies may be done there in under safe and
hygienic condition
 The following facilities are provided :
 Operation table
 Anesthetic equipment
 Sterilization equipment
 Drugs & parental fluids for emergency use
