3. MTP Act:Objectives
Aims to improve the meternal health scenario by preventing large number
of unsafe abortions and cosequent high incidence of maternal mortality &
morbality
Legalizes abortion services
Promotoes acess to safe abortion service to women
Offers protection to medical practitioners who otherwise would be
penalized under the Indian Penal Code (section 315-316

5. Minor
A person who under the provision of the Indian Majority
act 1875 is to be deemed not have attained his majority.

6. RegisteredMedical Practitioner
A medical Practitioner who possesses any recognized medical qualification as defined in
clause (h) of section 2 of the Indian Medical Council Act 1956,whose name has been
entered in a state medical register and who has such experience or training in gynecology
and obstetrics may be prescribed by rules made under this act.

Experience in the practice of Gynecology and obstetrics for a period of not less than
three years.
Completed six months of house surgery in Gynecology and obstetrics
Or
Assisted as RMP in the performance of twenty five cases of Medical termination of
pregnancy in a hospital establishment or maintained or a training institute approve for
this purpose by the Government.

7. Place
It is a building tent, vehicle or vessel or part thereof used for the establishment
or maintenance therein of hospital or clinic
Which is used or intended to be used for the termination of pregnancy

8. Owner
In relation to place, means any person who is administrative head
or otherwise responsible for the working or maintenance of such
hospital or clinic.

9. Circumstancesfor tremaintionof Pregnancyby RMP
1.Pregnancy is not more than 12weeks old:
Conditions:
A- Serious injury or mental health of the women and
B- Child to be born would be seriously handicapped.
2. More than 12 weeks but less than20 weeks:
If pregnancy caused because of rape or as a result of failure of any contraceptive device used
by any married women or husband for the purpose of family planning, it may presumed to
constitute a grave to the mental health of pregnant women
3.Women with 18 years or more: with her written consent
4.Women with less than 18 years: lunatic with written consent other guardian.

10. Experienceor Training
ThisactprescribestheexperienceandtrainingingynecologyandobstetricsforRMPwho shouldhaveto
terminatethepregnancy.
1.Before commencement of the act : Should have registration in state medical register and
have more than 3 years of experience and practice in mentioned field.
2. After Commencement of the act:
•Should have complete 6 month of house surgency in gynecology and obstetrics
•More than 1-year experience in the practice of gynecology and obstetrics at any hospital.
•Assisted RMP in the performance of 25 cases of medical termination of pregnancy in the
hospital established or maintained by govt.for this purpose
3.RMP who holds post-graduate degree or diploma in gynecology and obsterics,the experience
or training gained during the course of such degree or diploma.

11. PlacesforPregnancyTermination
•Should have approval from government.
•Termination o pregnancies may be done under safe hygienic conditions
•Facilities required: Operation table, instruments, anesthetics equipment, resuscitation
equipment, sterilization equipment, Drug and parenteral fluids for emergency use.

12. Maintenanceof admissionregister
1. Head of the hospital or owner of the approval place should maintain register
in prescribe from of the admission of women for the termination of their
pregnancies.
2. Serial number should be given to each entry in the register.
3. Fresh serial number need to be given in each calendar year
4. Fresh serial number of each year should be distinguishable
5. Information should not be disclosed.

13. Approvalof a place:Clause(b)of section-4
Forsitesup to12 weeks( 1st trimester)
• Gynecology examination / labor table
• Resuscitation and sterilization equipment
• Drugs & parental fluids
• Back up facilities for treatment of shock
• Facilities for transportation
Forsitesup to20 weeks(1st & 2nd trimester)
• All requirements for up to 2 weeks+
• Operation table and instrument for performing abdominal or gynecological
• Surgery & anesthetic equipment.

14. ApprovalProcess
• Application in Form A to be adderssed to CMHO by place seeking approval
• Verification by CMHO
• CMHO recommends approval to the committee
• Committee considers application & recommendation and approve and issue certificate of
approval in Form B
• Place to be inspected within 2 months of receiving application
• Certificate to be issued within 2 months of inspection
• If deficiency found, within 2 months of deficiency having been rectified
