8. 3.2 PARTIAL IMPLEMENTATION
1. Item 3 of MC 2020-027, or the actual or physical
removal or abatement of road and sidewalk obstructions
that are considered hazardous to motorists and
pedestrians such as, but not limited to, unauthorized
parked vehicles, illegal structures, nuisances, and any
other structures erected along or standing on , made
immovable or otherwise , that impede safe and
convenient passage through public road or sidewalk

13. Specifically, all LGUs shall:
1. Enact or review existing ordinance/s that provide
for the conduct of road clearing operations and
the prohibition of road obstructing structures and
constructions; providing a definition of
obstructions and illegal structures, mechanisms
for raising public awareness on road clearing,
and a set of clear and reasonable penalties for
violators
14. 2. Conduct an inventory of roads within its
jurisdiction, which may be conducted in
coordination with the concerned DPWH District
Engineering Office, and shall include road
classification, determination of road measurements,
and identification and documentation of obstructed
roads and natures of obstructions;

15. 3. Cause the removal of the said obstructions
through the regular conduct of road clearing
operations in all provincial, city, municipal
and barangay roads;

16. 4. Implement a displacement strategy for those
affected by the conduct of road clearing
operations, such as removed vehicles or
vendors, which may include designation of
unused spaces for their relocation, provision of
alternative livelihood for vendors, and other
similar efforts;

17. 5. Ensure that the cleared roads are rehabilitated
and restored for public use, through efforts such as
cleaning and flushing, installation of street lights,
erection of appropriate signage, setting of
appropriate speed limit, and the like; and

18. 6. Establish a grievance mechanism, either
physical or electronic, through which citizens
can report unremoved obstructions, provide
suggestions, and air out implementation
concerns.

Guidelines for Road Clearing Operations”
In the conduct of road clearing operations, the
following guidelines shall be observed:
22. Road clearing shall mean the removal of illegal or
unauthorized road obstructions along the road
right-of-way, which encompasses the entire width of
the road carriageway and sidewalk;
TAKE NOTE:
The widening of the cope of the existing road right-of-way and
activities undertaken for such purpose are beyond the scope of this
directive.
23. Road obstructions are structures, materials, or
activities within the road right-of-way that impede
the free and clear passage of motor vehicles or
pedestrians and/or pose danger or cause injury to
motorists, pedestrians, or occupants of nearby
structures.

24. Obstructing and/or hazardous trees may be
pruned or removed by the local government unit
in accordance with rules imposed by the
Department of Environment and Natural
Resources
25. In cases wherein structures or facilities owned by
utility service providers, such as posts, meters,
instrumentation boxes, and the like, cause
obstruction to the road right-of-way, due
coordination shall be made by the concerned utility
company and the LGU to remove or relocate the
obstructing structure or facility.

26. To assist in their inventory, LGUs may refer to
the road classification implemented by the
DPWH in identifying national primary, national
secondary, provincial, city, municipal, and
barangay roads.

27. LGUs may coordinate with the DPWH in
conducting road clearing operations in national
roads or any other roads under direct management
and maintenance of DPWH.
LGUs may coordinate with and request assistance
from the PNP and the BFP in ensuring security and
order during the conduct of road clearing
operations.
28. Exemption from removal or apprehension
by LGU, except in extraordinary
circumstances:
• Parked ambulances and public emergency
vehicles
• Checkpoints established and duly authorized by
the LGU, the IATF, PNP and AFP
• Temporary obstructions caused by the
establishment of bicycle lanes, as defined in MC
2020-100
29. All road closures currently set up by Barangays
without respective enabling ordinances nor
approval from concerned authorities shall be
dismantled and cleared to ensure unhampered
public conveyance.
Barangays under ECQ or MECQ may put up such
road closures subject to the approval of concerned
authorities.
30. Structures or obstructions erected or caused
by locally stranded individuals (LSIs) shall be
removed upon their return to their intended
LGU destination.
LGUs are advised to refer to the DILG MC
2020-087 for guidelines on facilitating the
return of LSIs.
32. Resumption of road clearing is set on
November 16, 2020 – January 15, 2021
Nota bene: Road clearing is a year-round activity
that requires sustained effort and
implementation
34. All Barangays implementing Road Clearing, whether
partial or full implementation, are directed to resume the
submission of their regular reports to DILG Bacolod using
Annex A template.

37. Validation
The validation of Iloilo Province compliance
with this Memorandum Circular shall be
conducted on January 18-22, 2021.
Guidelines in the conduct of validation for all
LGUs,

issued subsequent to this MC.
