New berlin regulation on holiday rental
1. In Berlin, there are currently around 15,000 holiday apartments. For tourists, a holiday apartment
is usually cheaper and more comfortable than a hotel. What pleases the tourists may be annoying
for many tenants who want to rent an apartment on a long-term basis. Living spaces are
continuing to diminish in Berlin.
For the owners, renting out of a holiday apartment is lucrative and higher returns can be achieved
through it than through long-term rental.
A new law on the prohibition of misuse of living spaces is now on its way and the Coalition of
SPD and CDU in Berlin will approve it. The districts of Berlin will be able to prohibit the use of
living spaces as holiday apartments in the future.
2. Holiday apartments will not disappear immediately however. For the existing apartments, there
is a transitional period of 2 years. Anyone who wants to use a new holiday apartment must apply
for it at the district level in the future from March 2014 onwards. The district must issue its
decision within 8 weeks after the application is filed and at the latest after 14 weeks in case of
extension. If this deadline period passes and the application has still not been processed, the
authorization shall be deemed to have been granted on a long-term basis.
It can thus be assumed that the applications may not be processed quickly enough since there is
shortage of employees at the district level. Hence, anyone who acts now and sets up a holiday
apartment can benefit from a long-term approval in this way.
