Drug Inspector
Pharmaceutical Jurisprudence

DRUG INSPECTORS
Appointed by central and state governments.
They are considered as public servants and are
officially subordinate to the controlling authority.
He/She should be a person without any financial
interest in the import, manufacture or sale of drugs
or cosmetics.
QUALIFICATIONS OF DI
Person must have a degree in
pharmacy/pharmaceutical chemistry/medicine
with specialization in clinical
pharmacology/microbiology from a recognized
university.
For inspection of manufacture of substances in
Schedule C.
1.)18 months of experience in manufacture or
testing of the substance.
2.)Gained experience of NLT 3yrs in inspection
of firms manufacturing any of the substances.
POWERS OF DI
• Any premises wherein any drug or cosmetic is -
• 1.)Manufactured and the means employed for
standardizing and testing.
• 2.)Sold, stocked, exhibited or offered for sale or
distributed.
INSPECT
• Any drug or cosmetic-
• 1.)Which is being manufactured, stocked,
exhibited, sold, offered for sale or is being
distributed.
• 2.)From any person who is in the course of
conveying, delivering or preparing to deliver such
drug or cosmetic to a purchaser or a receiver.
COLLECTION OF
SAMPLES
• Any place in which he/she has reason to believe
an offence related to manufacture, sale or
distribution of drug or cosmetic .
ENTER AND SEARCH
• Vehicle, vessel or any other
conveyance which is being used for
carrying any drug or cosmetic in
respect to sell which has been already
crossed it safety limits i.e. the expired
drugs or cosmetics.
STOP AND
SEARCH
• Examine any record, register,
document or any other material object
with any person or in any place which
gives all the information of the
manufacturing, selling, packing of
drugs or cosmetics.
EXAMINE DATA
DUTIES OF INSPECTORS
 Inspection of premises licensed for sale :-
• Inspect NLT twice an year all establishments licensed for sale of drugs
within the area assigned to him and to satisfy himself that the conditions of
license are being observed.
• Procure and send for tests or analysis, if he has reason to think that the
drugs are sold in contravention of provisions of Acts or Rules.
• To investigate any complaints made to him in writing and to institute
prosecutions in respect to the braches of the acts.
• To maintain all records of inspections made and actions taken by him
including taking of samples and to submit copies of such records to the
CA.
• Make enquiries such inspections as may be necessary to detect sale of
drugs in contravention to the Act.
• When so authorized by state governments to detain imported packages
which he has reason to suspect to contain drugs whose import is
prohibited.
Inspection of manufacture of drugs :-
• Inspect NLT twice a year all premises licensed for the manufacture of
drugs within the area allotted to him and satisfy himself that the condition
of license and provisions of Acts and Rules are observed.
• In establishments licensed to manufacture products specifies in
Schedule C and C1 inspect the process of manufacture.
• To send controlling authority after each inspection a detailed report
indicating conditions of license and provisions of Acts and Rules which
are being observed and which are being not observed.
• To take samples of drugs manufactured on premises and send them for
test or analysis.
PROCEDURE
Collection of sample and pay
its fair price, if refused then
issue the receipt(form 19) and
inform the concern(form 17).
Inspector should sent the
sample to government analyst
by registered post or by hand
in sealed packet enclosed
together with memorandum in
form 18.

• It should be reported to court
accordingly and court may order
destruction of drug under
supervision of the drug inspector.
CASE 1
If drug is not of
standard quality.
• Inspector may report in the court
accordingly and court may order
sale of drugs by public auction to
any party holding a license and
documents or records should be
registered within 20 days.
CASE 2
If drug is of
standard quality.

  • 1. Qualifications and Duties of Drug Inspector Pharmaceutical Jurisprudence Presented By :- Anushka Dubey Pharm.D 3rd Yr Parul Institute of Pharmacy
  • 2. DRUG INSPECTORS Appointed by central and state governments. They are considered as public servants and are officially subordinate to the controlling authority. He/She should be a person without any financial interest in the import, manufacture or sale of drugs or cosmetics.
  • 3. QUALIFICATIONS OF DI Person must have a degree in pharmacy/pharmaceutical chemistry/medicine with specialization in clinical pharmacology/microbiology from a recognized university. For inspection of manufacture of substances in Schedule C. 1.)18 months of experience in manufacture or testing of the substance. 2.)Gained experience of NLT 3yrs in inspection of firms manufacturing any of the substances.
  • 4. POWERS OF DI • Any premises wherein any drug or cosmetic is - • 1.)Manufactured and the means employed for standardizing and testing. • 2.)Sold, stocked, exhibited or offered for sale or distributed. INSPECT • Any drug or cosmetic- • 1.)Which is being manufactured, stocked, exhibited, sold, offered for sale or is being distributed. • 2.)From any person who is in the course of conveying, delivering or preparing to deliver such drug or cosmetic to a purchaser or a receiver. COLLECTION OF SAMPLES • Any place in which he/she has reason to believe an offence related to manufacture, sale or distribution of drug or cosmetic . ENTER AND SEARCH
  • 5. • Vehicle, vessel or any other conveyance which is being used for carrying any drug or cosmetic in respect to sell which has been already crossed it safety limits i.e. the expired drugs or cosmetics. STOP AND SEARCH • Examine any record, register, document or any other material object with any person or in any place which gives all the information of the manufacturing, selling, packing of drugs or cosmetics. EXAMINE DATA
  • 6. DUTIES OF INSPECTORS  Inspection of premises licensed for sale :- • Inspect NLT twice an year all establishments licensed for sale of drugs within the area assigned to him and to satisfy himself that the conditions of license are being observed. • Procure and send for tests or analysis, if he has reason to think that the drugs are sold in contravention of provisions of Acts or Rules. • To investigate any complaints made to him in writing and to institute prosecutions in respect to the braches of the acts. • To maintain all records of inspections made and actions taken by him including taking of samples and to submit copies of such records to the CA. • Make enquiries such inspections as may be necessary to detect sale of drugs in contravention to the Act. • When so authorized by state governments to detain imported packages which he has reason to suspect to contain drugs whose import is prohibited.
  • 7. Inspection of manufacture of drugs :- • Inspect NLT twice a year all premises licensed for the manufacture of drugs within the area allotted to him and satisfy himself that the condition of license and provisions of Acts and Rules are observed. • In establishments licensed to manufacture products specifies in Schedule C and C1 inspect the process of manufacture. • To send controlling authority after each inspection a detailed report indicating conditions of license and provisions of Acts and Rules which are being observed and which are being not observed. • To take samples of drugs manufactured on premises and send them for test or analysis.
  • 8. PROCEDURE Collection of sample and pay its fair price, if refused then issue the receipt(form 19) and inform the concern(form 17). Inspector should sent the sample to government analyst by registered post or by hand in sealed packet enclosed together with memorandum in form 18.
  • 9. Collection of samples Government analyst Warrantor Restored by person Present in the court
  • 10. • It should be reported to court accordingly and court may order destruction of drug under supervision of the drug inspector. CASE 1 If drug is not of standard quality. • Inspector may report in the court accordingly and court may order sale of drugs by public auction to any party holding a license and documents or records should be registered within 20 days. CASE 2 If drug is of standard quality.
