3. Introduction
• There are 3 kind of people
1. Person (Anyone including foreigner)
2. Citizen
3. Minority (based on religion, based on language)
• Citizenship is the status of a person recognized under the custom or law as being the legal
member of a nation
• Citizenship is like kind of certificate. Ex- Voter ID card
• Citizens have all kind of freedom. (like taking part in elections, high job position, judge of
SC , voting)
• The conferment of a person as a citizen of India is governed by the Part II of the
Constitution of India (Articles 5 to 11)
• It has implemented in 26 January 1950

4. Article 5
• Implemented from 26th January 1950
• At the commencement of this Constitution, every person
who has his domicile in the territory of India and-
1. who was born in the territory of India or
2. either of his parents was born in the territory of India or
3. who has been ordinarily resident in the territory of India for more
than five years immediately preceding such commencement,
shall be a citizen of India.

5. Article 6
Rights of citizenship of certain persons who have migrated to
India from Pakistan
• Permit 19th July 1948
• Indian citizenship can be given on two basis here,
1. he or either of his parents or any of his grandparents was
born in India
2. The person who came before the permit date
3. Person came after this date, has to registered his name
and after 6 months he will be given permit

6. Article 7
Rights of citizenship of certain migrants to Pakistan
• Before partition of India and Pakistan (1st march 1947) those
person who migrated to Pakistan
• But want to move back to India after partition, will be given
citizenship of India after the registration
• After 6 months he will be given certificate

7. Article 8
Rights of citizenship of persons of Indian origin residing
outside India
A person who born outside India will be given citizenship if his
parents or grandparents was born in India as defined in the
Government Of India Act, 1935, will be given citizenship.

Persons voluntarily acquiring citizenship of a foreign State not
to be citizens

8. Article 10
Continuance of the rights of citizenship
• Every person who is a citizen of India subject to the
provisions of any law that may be made by Parliament,
continue to be such citizen.
• It he does any crime or break the rule, citizenship will be
revoked.
• Ex- Activity against nation

9. Article 11
Parliament to regulate the right of citizenship by law
• Nothing in the foregoing provisions of this part shall
derogate from the power of Parliament to make any
provision with respect to the termination of citizenship and
all other matters relating to citizenship
• Law is controlled by Home Ministry
