I recently read your Press Release regarding the Court Judgement which you claim “speaks for
itself”. The Court Judgement certainly does speak for itself and I do not understand why you are
celebrating. You clearly missed the meaning of the first and second paragraphs of the Judgement
in which the judge clearly stated that “The issue is narrow; whether Chief Mbulu told one or
more of the Ds that the pending motion for an injunction would be withdrawn”. What this means
is that an injunction was granted to the legitimate NidoCanada because you and your group
(Peter Ozemoyah, TundeOlagundoye et al ) did not present yourself at the trial. The injunction
was to prevent you and your group from using the name NidoCanada (and other variations) and
to turn over all relevant documentation associated with your illegal use of the name NidoCanada
(including books, records and bank account details). At the trial held on May 9, 2012, the Judge
gave you a chance to defend yourself thereby setting aside the motion. So why the celebration?
When this case does get heard, it is very likely that the Judge will award the legitimate
NidoCanada the injunction it seeks.

On Aug 8, 2011 you lost the original court case and never appealed. It is now on record, that you
and your group stole the NidoCanada identity (indefensible!). That is what we Nigerians call
419. I do not recall you celebrating then nor do I recall any Press Release at that time. Stop
playing on our intelligence. I can assure you that most of the community is aware of the reasons
why you and your group are desperate to associate yourselves with the NIDO name. Over the
past 4 years, you mislead the community and tried to implicate some good members (like Peter
Ozemoyah and BenedictaEgbo) in your 419 scheme. You are a Doctor and should know better.
How could you substitute the names of Directors of a (CANADIAN) corporation with yours and
some of your friends? It seems that you got away easy, you could have been charged with fraud
– and this may still be an option. Now, you prematurely celebrate an injunction which was set
aside to be heard soon. The Aug 8, 2011 judgement is set in stone, so why are you still trying to
confuse the Nigerian Community?

I can say that when I look at the board of the legitimate NidoCanada, I see a list of directors and
members with exemplary reputations. Likewise, when I look at NidoCanada’s newly formed
Chapters, all of their officers also have exemplary reputations. The same could not be said for
you and your former group of directors. I ask myself, why are some of the most respected
members of our community eager to join the legitimate NidoCanada. To me it is obvious - they
believe in the morals, values and ability of its leadership.

I get the sense that you are picking on Mbulu. He and his family have been strong supporters of
the Nigerian Community for over 20 years. Even before there was a NIDO, he was a selfless
supporter of this community. It is a shame that you and your group are bent on disrupting his
plans for our community. You illegitimately took your chance by stealing the NidoCanada
identity and then proceeded to do nothing with it over a 4 year period. The legitimate
NidoCanada represents a group of serious and accomplished Nigerians and you are bent on
disrupting their progress. You keep claiming that Mbulu is the personal owner of NidoCanada.
Anyone with a computer can check the Industry Canada directory and see that NidoCanada is a
registered non-for-profit corporation. You know that NidoCanada has a legally constituted board
of accomplished Nigerians and yet you continue to refer to it as a sole proprietor. It seems
personal to me. I wonder what you have against this gentleman who has given so much to
enhance the lives of many in our Community. Rather than celebrate a good man, you choose to
malign his character. In addition to fraud, perhaps a charge of slander should be levied against
you.

As for the new name you are trying to use in Canada, NidoAmericaInc Region 7 or/and
NidoAmerica-Canada Inc - which NidoA faction do you belong to? You left Nido many years
ago and now claim to have gone back. Where and when did you register such a company? You
appear to be very desperate to use the name NIDO in any way possible even though you
acknowledge that it is a Registered Trademark in Canada. You seem to have no regards for
Canadian law and I wonder how a seemingly intelligent man can be so reckless. Ola Kassim, the
time has come for you to retire from the internet. Your actions and words have been an
embarrassment to our Nigerian community. I suggest that you spend time with your family and
think of the legacy you are going to leave. Each time you blog (which is quite often) you erode
the little credibility you have left. Over the past 7 years, you seem to have erased any good you
could have possibly done. Even more damaging is that in your reckless abandon you are
hindering the progress of some well-meaning Nigerians.

To the legitimate NidoCanada, I applaud you for the way you have handled yourselves. You
stayed off the internet and followed the rule of law (even though it took many years). You
continue to impress me. Focus on your mission, and continue to use the Courts to silence these
imposters. You have already won your name back and, in doing so, have silenced these
imposters to the point where they do not show up to their own trial. The case would have ended
there, if only Kassim and his group turned over all their books and kept quiet. Instead they
continued to try to use different permutations of NIDO and that is why the case is still in Court.
These are the simple FACTs for those who really want to know the truth. All the court
documents are on-line for those who care to read the truth.

You were the Chairman of NidoAmerica for many years with nothing to show for it. You had a
quarrel with the board then decided to become a director of NidoCanada by removing the names
of the original directors and re-submitting a new list to Industry Canada (forgery). You and
TundeOlagundoye ran this organization (illegitimately) for another 4 years, again, with no
results. Now you refuse to allow the real directors to run their organization in peace. At the very
least you should give them some breathing room to work. If they do not perform, you can then
criticize if you wish. It is your right as a Nigerian.

Your friend and predecessor (former Chairman of NidoAmerica), Barrister EmekaUgwuonye is
currently being sued by the Nigerian Government and you are being sued by NidoCanada. You
have succeeded in causing havoc in 2 Countries. How ironic- the same character in both
Countries. Food for thought!
