1. GEPF discrimination redress project
Initiative to redress past discrimination with regard to government pensions
Current and former SARS employees, and all other public servants, who were discriminated against with regard to government pensions are to receive
redress. The deadline is 31 August 2010.
This is due to a Public Service Coordinating Bargaining Council (PSCBC) resolution taken in 1998. According to the resolution employees who were
discriminated against in terms of race, gender or status of employment and were therefore prevented from contributing to the GEPF (Government Pensions
Fund) will now have those periods of service recognised as pensionable.
SARS has initiated a process to identify current and employees who are eligible for redress.
To qualify for redress employees should have been in public service as at 2 September 1998 and belong to one of the following categories:
• Employees who had to complete a waiting period before being admitted to government pension funds. (Note: a probation period is not
regarded as a waiting period). Admission to the following pension funds were subject to a waiting period:
o Temporary Employees Pension Fund (between 2 and five years).
o Black Authorities Superannuation Fund (between 2 to 5 years).
o Non-White Government Employees Pension Fund (5 years).
o Employees admitted to temporary funds due to medical/physical status (i.e they were under or over weight).
• Females in public service who lost pensionable service due to changes in marital status and/or had to resign to give birth and were admitted to
the Temporary Employees Pension Fund upon their return to service.
• RSA citizens who were employed in the former TBVC states.
• Employees dismissed for participating in the following industrial action:
o 1987 strikers at the Natalspruit, Sebokeng, Helen Joseph and Kopanong Hospitals
o Employees of former TPA and certain Free State hospitals dismissed for participating in the 1987 strikes
o All other employees dismissed for participating in the 1987 strikes
o Former Natal Provincial Administration employees dismissed as a result of 1988 strike
o SAP members dismissed in 1990
o The 1991 and 1993 industrial action in the former Transvaal Provincial Administration
• Kits konstabels
• Former Municipal Police employees who belonged to the Municipal Pension Funds and were incorporated into the SAP in 1989 and into the
GEPF with effect from 1 June 2003.

GEPF requirements with regard to applications
• All applications must be on the compulsory GEPF application form which will be available
• For in-service members, only the official GEPF application form is needed. For members who are no longer employed in the public service the
official GEPF application form and Z894 must be completed and bank details must be provided on the Z864 form.
• For deceased employees, beneficiaries must complete the official GEPF form, the Z864 and Z894 (where beneficiaries have attained maturity).
These forms must be accompanied by the following documents: death certificate, ID of the deceased, ID of the applicant.
• An Estate Account is compulsory for all members who died after leaving public sector employment. The Estate Account has to be accompanied
by an appointment letter from the court.
In addition, the following documentary proof in support of applications will be accepted:

• Affidavits: in the absence of acceptable documentary proof as listed above, comprehensive affidavits may be submitted for consideration by the
GEPF.
