An American water company, Aleba Water LLC, has had its property in Lantian County, China confiscated by local gangsters and the county government. Despite appeals to Chinese officials, including the Shaanxi Governor and Mayor of Xi'an, the situation has deteriorated further with the property now completely taken over. The company is requesting the Mayor to direct the Lantian County government to return the investment in accordance with Chinese law protecting foreign investments and property rights. Failing a satisfactory response, the company warns it will appeal directly to the Chinese President through US Congressional representatives during his upcoming visit.

As you know, the U.S. Ambassador Baucus has been following our case quite
closely. In his Xi’an meetings in July, Ambassador Baucus delivered a written mes-
sage to Shaanxi Governor Lou Qinjxan. In addition, you will recall, former Am-
bassador Locke also brought the Aleba Water case to the attention of Shaanxi
governor.
Despite these requests to your government to protect U.S. investor property, the
situation in Lantian County has deteriorated. Gangsters, headed by former Deputy
Police Chief Sunjun Hong, took over our property completely in June. When we
made an urgent appeal to the Lantian County police, the police officials refused to
protect our investment. This protection is required under China’s Joint Venture law.
You should also know that our Joint Venture was approved by the Commercial
Ministry of the State Council. Lantian government officials have done nothing to
protect our investment. Our property is now completely confiscated by the Lantian
government. The Lantian Government has illegally handed over our property to
Sunjun Hong’s criminal gang.
In the past year, I have sent numerous letters to you through 如⻛风 Zhang Rui
<randychang@126.com> of your Foreign Affairs office. I have yet to receive any
response to our many requests for assistance. The Lantian Government continues
to operate outside your control.

2. We request that you direct the Lantian County government to return our investment
to Aleba Water, LLC. It is your responsibility, as a senior government official, to
ensure that the Lantian Government and its police officials follow Chinese law. Ul-
timately, you are responsible for enforcing our property rights in Xi’an. Your gov-
ernment should direct the Lantian government to return our investment and require
that Sunjun Hong’s gang open the entrance to our factory immediately.
China’s President Xi is to visit the U.S. soon. In view of the inaction of the Lantian
government, we are working now to make an appeal to President Xi directly
through our Congressional representatives. I hope that you can now see that the
investors in Aleba Water Company, although perhaps a relatively small investment
in your eyes, can reach the highest levels of the U.S. government.
We hope our efforts to bring this matter to President Xi’s attention will not be nec-
essary. Please take clear, decisive steps now to return our property that has been
confiscated by the Lantian Government.
