2. Safe Water
On January 4, 2014 the Federal Government mandated
that the wetted surface of every pipe, fixture, and fitting
sold or installed in, potable water applications cannot
contain more than 25% of lead by weight.
• States are responsible for enforcing the mandate
through codes and appropriate means.
• Fines, installed removal costs, and/or lawsuits by
private parties or governmental agencies may result
with non-compliance.
• Many state plumbing codes require the use of
products that comply with the NSF/ANSI standards
61 and 372

3. SDWASection 1417 of the Safe Drinking Water Act (SDWA)
establishes the definition for “lead free” as a weighted
average of 0.25% lead calculated across the wetted
surfaces of a pipe, pipe fitting, plumbing fitting, and fixture
and 0.2% lead for solder and flux. The Act also provides a
methodology for calculating the weighted average of
wetted surfaces.
The Act prohibits the “use of any pipe, any pipe or
plumbing fitting or fixture, any solder, or any flux, after
June 1986, in the installation or repair of (i) any public
water system; or (ii) any plumbing in a residential or non-
residential facility providing water for human consumption,
that is not lead free.”

Lead Free is:
• There is less than 0.2 percent lead when used in respect to
solder and flux; and
• The weighted average is less than 0.25 percent lead when
used with respect to the wetted surfaces of pipes, pipe
fittings, plumbing fittings, and fixtures.
The concern came from the fear that people are using the
water from these hose bibs to fill water coolers, swimming
pools (small or large), in outdoor kitchens, and often drink from
the hose connected to them. This provides possible exposure
to lead in the hose bib if the lead has been leached out.

6. Water For Human
Consumption
What is included under the definition for
human consumption?
• The definition of human consumption
includes drinking, bathing, showering,
cooking, dishwashing, and maintaining oral
hygiene.

7. No Safe Levels of Lead
• According to the CDC there are no safe blood levels of lead.
• Lead is a cumulative toxicant that affects multiple body systems and is particularly
harmful to children.
• Lead in the body is distributed to the brain, liver, kidneys and bones, and can

• Lead found in bones may be released into the blood stream during pregnancy and
become a source of exposure to the developing fetus.
• CDC: 1 in 38 children tested have lead poisoning to some degree.
• One thing to note is lead exposure can be prevented.

9. Q. I am a manufacturer of hose bibs (threaded
faucets with nozzles bent downward). I market them
and sell them primarily for use outdoors (e.g. to
connect to a garden hose, sprinkler, or irrigation
system) but they could be used for services associated
with human consumption as well. Are the hose bibs
required to meet the new definition of lead free?
A. A hose bib is a pipe, fitting or fixture under the
language of the statute and therefore it is subject to
the requirements in Section 1417 unless it is used
exclusively for nonpotable services. If you market and
sell hose bibs for nonpotable services, and the bibs
are prominently and clearly labeled as illegal to use for
potable services and not anticipated to be used for
human consumption, then EPA would generally
consider them to be used exclusively for nonpotable
services and therefore, exempt from the lead free
requirements in SDWA 1417(a)(1) and (3).
