100/- ACCORDING TO ADAPTATION ACT 1952.
NOTE: 1. RAILWAY SERVANTS GOVERNED BY PAYMENT OF WAGES ACT CAN NOT STATE AS SURETY.
2. STAMP PAPERS TO BEPURCHASED IN THE NAME OF THE TRAINEE.

Which expression shall include his/her hairs, executors, administrator and representatives where the

(herein after referred to as ‘Surety’ which expression shall include his, heirs, executers. Administrator
and representatives where the context so admits) of the ONE PART AND THE PRESIDENT OF INDIA
OWNER AND ADMINISTRATOR of the Railway (herein after referred to as the Government of the other
Part.
Whereas the government has engaged the trainees on the terms and conditions mentioned in
the joining report dt. Executed by and between the trainee and the government. This deed of Indemnity
shall be deemed to have into effect date of admission of trainee in course.
And whereas the surety is interested in the welfare of the said trainee and therefore has agreed
to these present as surety.
And whereas on of the terms and conditions to the said engagement of the trainees is that the
trainee shall complete the prescribed training and after such completion. Shall accept service under the
Govt. and serve the Govt. for a minimum period of five years and if the trainee deserls service or resigns
from service during the period of training and thereafter without the written consent of the Govt. or is
discharge of there from the ruscoriduci or any other offences as numerated in the deed the trainees
shall repay on demand by the Government the whole cost of training and pay other amounts including
traveling and running allowances drawn by the trainee from the Govt. under these terms and
conditions.
And whereas the surety bas agreed to indemnity and or to reiniourse the Govt. to that extents ;
Now these present witness and it is hereby agreed by and between too parties as follows ;
1. That in consideration of the premises and in consideration of the Govt. of engage the train as for
the course mentioned in the joining referred to above, the trainees after completion the training
satisfactorily shall serve the Govt. for a minimum of five year thereafter in accordance with the said
joining execute between the trainees and the Govt. to the complete satisfaction of the Govt. (decision of
the Government about which shall be final and conclusive)
2. The apprentice shall employ himself/herself honestly, efficiently and diligently under the orders
and ………………………. Authorities under whom he/she shall from time to time as placed by the
Government in any locality in Indian and shall do all thing maybe required of his/her or which are
necessary to be done in his/her capacity as an apprentice.
3. The apprentice shall not on any presence absent himself/herself from his/her duty without
having first obtained the permission of the officer authorized in their behalf by the Government or in
case of sickness or accident without forwarding a medical certificate satisfactory to such office.
4. The apprentice shall devote his/her whole time to there training and shall not carry on or be
concerned in any other trade or business or occupation whatsoever.
5. The apprentice shall be responsible for the charge and care of the government money goods
and stores and other property entrusted to him/her or in his/her or in his/her hands and shall truly and
faithfully account for or pay over or deliver to the proper officer all money, goods and stores and
property which shall at any time come to his/her hands or be under his/her charge on account of the
government.
6. The apprentice shall conform to all the rules and regulation of the department to which he/she
may be attached for training at any time and shall obey all such orders and directions as he/she shall
from time to time receive from the officer and/or officers placed in authority above him.
7. The Government shall be at liberty to deduct from time to time out of the monies due to be paid
to the apprentice, as aforesaid, any sum or sums of money which may be reasonable for any lose of time
occasioned by the absence, sickness without any approved medical certificate or other incapacity to
work and also for any loss which the Government may sustain by reasons of the negligence or
misconduct of the apprentice.
8. The apprentice will not during the period of apprentice ship be allowed to subscribe to the state
railway provident fund. The period of apprenticeship will not count for pensionery benefits.
9. Should the apprentice be guilty of any insubordination, iterance or other misconduct or any
breath or non-performance of the provision of these presents at any time during the continance of the
officer having authority in that behalf to discharge him/her from the apprenticeship. The decision of the
Government or the Officer having authority in that behalf, on the question whether the apprentice has
been guilty of any insubordination. Interference or other misconduct or has committed any branch in
the performance of the provisions of the provisions of these presents shall be final. The apprentice shall
be given an opportunity to defend himself/herself before any action is taken against his/her under this
clause.
10. It shall be lawful for the Government if satisfied on the medical evidence before them that the
apprentice is un fill and it likely for a considerable period to continue unfit by reasons of ill-wealth to
obtain or the complete the training, to determine the apprenticeship without previous Notice ( The
decision of the Government being conclusion) and thereupon his apprentice ship shall be terminated.
11. During the period of apprenticeship the apprentice shall be eligible for leave in accordance with
the rules for the time being in force applicable to apprentices of Indian Railways.
12. That the trainees and the surety hereby undertake jointly and severally to indemnity and
reimburse the Govt. to that extent as aforesaid,
13. That in the event of the trainees getting on adverse report regarding the progress of his/her
training of studies or conduct or on discounting his studies or being discharged from the course or on
refused to continue for any reason not beyond the control of the trainees or dose not continue in
service as aforesaid the trained and the surety shall jointly and severally be fiable to decision of the
Govt. As to the amount so payable shall be final together with interest of the said money calculated at
the rate then in force for Govt. Loans.
That the liability of the surety here under shall not be imparted discharged by reason of time
being granted or any one bearance act of commission of the Govt. of any person authorized by the Govt.
(Whether with or without the knowledge of consent of the surety not shall if he necessary for the Govt.
To see the trainee before suing the surety for the amount due here under.
That if there is any dispute as to the effect or meaning of these presenis or otherwise however
except to a matters for which specified provision has been made in the same shall be referred to the
sole arbitration of the secretary to the Govt. of India in the Ministry of Railway or any person appointed
by these the whose decision shall be final and binding on the parties. The provision of the Indian
Arbitration Act 1940 as amended from time to time shall apply.

Western railway deed of indemnity

  • 1. WESTERN RAILWAY DEED OF INDEMNITY TO BE EXECUTED ON NON JUDICIAL STAMPED PAPER OF PROPER VALUE OF RS. 100/- ACCORDING TO ADAPTATION ACT 1952. NOTE: 1. RAILWAY SERVANTS GOVERNED BY PAYMENT OF WAGES ACT CAN NOT STATE AS SURETY. 2. STAMP PAPERS TO BEPURCHASED IN THE NAME OF THE TRAINEE. This deed of Indemnity made this …………………………………………… day of ……………………………………… By Shri/Smt. Kum ………………………………………………………… Son/ Daughter of ……………………………………………… Residing at …………………………………………………………………………….. Where in after referred to as Trainees. Which expression shall include his/her hairs, executors, administrator and representatives where the context so (Admits …………………………………………… and shri…………………………………………………) (Surely on of …………………………………………………..residing at full address ……………………………………………………………………….) (herein after referred to as ‘Surety’ which expression shall include his, heirs, executers. Administrator and representatives where the context so admits) of the ONE PART AND THE PRESIDENT OF INDIA OWNER AND ADMINISTRATOR of the Railway (herein after referred to as the Government of the other Part. Whereas the government has engaged the trainees on the terms and conditions mentioned in the joining report dt. Executed by and between the trainee and the government. This deed of Indemnity shall be deemed to have into effect date of admission of trainee in course. And whereas the surety is interested in the welfare of the said trainee and therefore has agreed to these present as surety. And whereas on of the terms and conditions to the said engagement of the trainees is that the trainee shall complete the prescribed training and after such completion. Shall accept service under the Govt. and serve the Govt. for a minimum period of five years and if the trainee deserls service or resigns from service during the period of training and thereafter without the written consent of the Govt. or is discharge of there from the ruscoriduci or any other offences as numerated in the deed the trainees shall repay on demand by the Government the whole cost of training and pay other amounts including traveling and running allowances drawn by the trainee from the Govt. under these terms and conditions. And whereas the surety bas agreed to indemnity and or to reiniourse the Govt. to that extents ; Now these present witness and it is hereby agreed by and between too parties as follows ; 1. That in consideration of the premises and in consideration of the Govt. of engage the train as for the course mentioned in the joining referred to above, the trainees after completion the training satisfactorily shall serve the Govt. for a minimum of five year thereafter in accordance with the said joining execute between the trainees and the Govt. to the complete satisfaction of the Govt. (decision of the Government about which shall be final and conclusive) 2. The apprentice shall employ himself/herself honestly, efficiently and diligently under the orders and ………………………. Authorities under whom he/she shall from time to time as placed by the Government in any locality in Indian and shall do all thing maybe required of his/her or which are necessary to be done in his/her capacity as an apprentice.

The apprentice shall not on any presence absent himself/herself from his/her duty without having first obtained the permission of the officer authorized in their behalf by the Government or in case of sickness or accident without forwarding a medical certificate satisfactory to such office. 4. The apprentice shall devote his/her whole time to there training and shall not carry on or be concerned in any other trade or business or occupation whatsoever. 5. The apprentice shall be responsible for the charge and care of the government money goods and stores and other property entrusted to him/her or in his/her or in his/her hands and shall truly and faithfully account for or pay over or deliver to the proper officer all money, goods and stores and property which shall at any time come to his/her hands or be under his/her charge on account of the government. 6. The apprentice shall conform to all the rules and regulation of the department to which he/she may be attached for training at any time and shall obey all such orders and directions as he/she shall from time to time receive from the officer and/or officers placed in authority above him. 7. The Government shall be at liberty to deduct from time to time out of the monies due to be paid to the apprentice, as aforesaid, any sum or sums of money which may be reasonable for any lose of time occasioned by the absence, sickness without any approved medical certificate or other incapacity to work and also for any loss which the Government may sustain by reasons of the negligence or misconduct of the apprentice. 8. The apprentice will not during the period of apprentice ship be allowed to subscribe to the state railway provident fund. The period of apprenticeship will not count for pensionery benefits. 9. Should the apprentice be guilty of any insubordination, iterance or other misconduct or any breath or non-performance of the provision of these presents at any time during the continance of the officer having authority in that behalf to discharge him/her from the apprenticeship. The decision of the Government or the Officer having authority in that behalf, on the question whether the apprentice has been guilty of any insubordination. Interference or other misconduct or has committed any branch in the performance of the provisions of the provisions of these presents shall be final. The apprentice shall be given an opportunity to defend himself/herself before any action is taken against his/her under this clause. 10. It shall be lawful for the Government if satisfied on the medical evidence before them that the apprentice is un fill and it likely for a considerable period to continue unfit by reasons of ill-wealth to obtain or the complete the training, to determine the apprenticeship without previous Notice ( The decision of the Government being conclusion) and thereupon his apprentice ship shall be terminated. 11. During the period of apprenticeship the apprentice shall be eligible for leave in accordance with the rules for the time being in force applicable to apprentices of Indian Railways. 12. That the trainees and the surety hereby undertake jointly and severally to indemnity and reimburse the Govt. to that extent as aforesaid, 13. That in the event of the trainees getting on adverse report regarding the progress of his/her training of studies or conduct or on discounting his studies or being discharged from the course or on refused to continue for any reason not beyond the control of the trainees or dose not continue in service as aforesaid the trained and the surety shall jointly and severally be fiable to decision of the Govt. As to the amount so payable shall be final together with interest of the said money calculated at the rate then in force for Govt. Loans. That the liability of the surety here under shall not be imparted discharged by reason of time being granted or any one bearance act of commission of the Govt. of any person authorized by the Govt. (Whether with or without the knowledge of consent of the surety not shall if he necessary for the Govt. To see the trainee before suing the surety for the amount due here under.
  • 3. That if there is any dispute as to the effect or meaning of these presenis or otherwise however except to a matters for which specified provision has been made in the same shall be referred to the sole arbitration of the secretary to the Govt. of India in the Ministry of Railway or any person appointed by these the whose decision shall be final and binding on the parties. The provision of the Indian Arbitration Act 1940 as amended from time to time shall apply. In witness whereas the parties have set their hands on the day year first above mentioned.
