Summary of the MDPH presentation (Study visit on handicap, Strasbourg, April 8th
2013)
The MDPHs (MaisonsDépartementales des PersonnesHandicapées – Departmental Homes
for Disabled Persons) exist in France since the 2005 lawon equality of opportunities, rights,
participation and citizenship of disabled persons. The guiding principles of this law are
those of taking the individual’s needs into account, giving an individualresponse in
accordance with the person’s wants and plans, and transitioning from seeing the disabled
person as someone who is “being taken care of” to seeing them as someone who is in charge
of his or her life.
The MDPHs have four main tasks:
1. Hosting
2. Listening
3. Counseling
4. Guiding
The MDPHs are so-called public interest groups, made up of several entities: the General
Council of the Bas-Rhin (local government), the regional Public Health Agency (ASR), the
Ministry of Education, the Family Allowances Fund (CAF) and the localSocial Security office.
The MDPH of the Bas-Rhin treats more than 50 000 demands per year; on average, 100
demands are treated per day. It is made up of five units:
1. The Directorate
2. The Intake (or Accepting) Unit
3. The Evaluation Unit
4. The Administrative Instruction Unit
5. The Assistance and Development Unit
Each MDPH also includes a Commission for the Rights of the Disabled, which among other
things is competent when it comes to assessing appeals made by families or persons who do
not agree with the decisionsmade by the MDPH (in terms of assistance, allocations, etc.).
These Commissions are made up of representatives of the different public structures that
make up the public interest group that is the MDPH, a representative of the employers’
organization, a representative of the labor union, and a number of civil society
representatives (parents’ organizations, members of handicap organizations …).
Concerning the allowances paid to the beneficiaries of the MDPH, these are determined
according to a scale guide that distinguishes between three different degrees of disability:
- Less than 50%
- 50 – 80 % (the disability impedes the social life of a person, but can be compensated
for e.g. by means of speech therapy, specials needs assistants in school, specialized
home education and health care services)
- More than 80 % (the disability severely restricts personal autonomy, the person
requires assistance for the most basic day-to-day tasks)
The evaluation to determine in which of these categories a person falls does not depend on
a medical diagnosis alone, but also takes into account the level of incapacity(that is, the
difficulties encountered in daily life).
